We hired Simons Customs LLC to build a shop on our property. Contract dated 9.20.21 with an estimated completion date of 10.29.2021. Made our first draw payment on 9.20.21 to begin the construction process. Two progress payments were made on 10.8.2021 after completion of slab and to order building kit (materials to wrap the building). To this date, we have only received the materials to partially complete the roof and the materials that are supposed to be for the wainscoting. We also have terrible drainage issues now, because he ignored my concerns regarding the impact to drainage (photo attached). As of today (6 months later), we have a slab, red iron frame, a partial roof, and the windows we purchased have been "installed" on the frame (photo attached). October 21, 2021 we agreed to an extension/addition to the project and on 10.23.21 we paid a $7000 draw to begin the slab for the addition. Shortly after this payment was made, the excuses began and his crew pretty much stop coming. If I recall correctly, the were not here at all in November and maybe 2 or 3 times in December. We have heard every excuse under the sun from Billy S***** and we are done playing his games. He has a total of $54,184 of our money and has only accounted for approximately $18,435. He claims the metal for our shop cost $22,754 and that it is sitting at his shop. We have asked numerous times for him to deliver our materials and return approximately $10K. He always promises he will and never follows through. As of this morning, he admitted to lying and that he has not ordered the material. In the last month or two, I have found numerous people all over North Texas that are in the same boat as me. He takes money from one client to pay off another. Then he "agrees" to settle, but forces everyone to sign essentially a gag order so that you can't out him or his business for wrong doings on social media. He is a ponzi scam artist and needs to be shutdown immediately.Business response

Business Response /* (1000, 9, 2022/05/04) */ Customer is correct on the statement the job did not meet the required timeline. However no money has been stolen whatsoever. I am in communication with customer on a settled amount to be given back and the contract terminated. Consumer Response /* (3000, 15, 2022/05/27) */ I am not in agreement with his response, he is still lying and not doing anything he claims. My building is still incomplete and he will not return our money. ******* ***** ********* Business Response /* (4000, 17, 2022/05/27) */ I have the customers refund and been advised by my attorney to let him handle it as there is alot more to this case now that will be delt with in court.
