I brought a 2012 **** *** Pop to ******* auto in June, 2022. This vehicle had been used as my daily driver and had functioned properly upon drop off. The vehicle was brought to ******* auto to address a check engine light and erratic oil pressure light. ******* auto identified that there had been a lubrication failure in the engine, and that the engine needed to be replaced. I agreed to the repair and placed a $5000 deposit on it. ******* auto thereafter reported having issues with installed parts (the new engine). ******* auto later reported that the vehicle had been transported to a third party (******** at 7720 Katy Freeway, 77024) for a warranty claim on the replacement engine. There were disagreements between these parties with respect to the condition of the installed parts, with respect to the installation quality of those parts, and with respect to responsibility for payment of services. These disputes lasted until October at which time ******* auto made a payment to ********. According to records provided to me, ******* auto accepted the vehicle on Oct 27, 2022 from ********. When I arrived to pick up the vehicle on 10/28 I was informed that the transmission did not function properly. I also found upon inspection that the air-conditioning did not function. The vehicle has a 5 speed transmission with reverse which functioned properly upon drop off. At pickup it was not able to engage more than 2 forward gears and was unsuitable for driving. I did not make payment on 10/28 in light of the state of the vehicle. I returned on 10/31 and indicated that I could not accept the condition of the vehicle. I desire that the vehicle be repaired, or in lieu of repair that the deposit I placed for repair of the vehicle be returned to me and that I be reimbursed for the value of the now unusable vehicle.
