      Business response

      09/15/2022

Good Morning to whom it may concern,
The following information that was provided from Tara **** is incorrect. We started the job Mid of April and and completed to the stopping point that Tara **** told our Project Manager Javier to pause on the job until she got confirmation to continue the job. Javier had reached out multiple times to Tara via messages the following day to confirm if we were ok to go back, Tara Never gave an OK till 8:03am after our Crew was in route to another job site due to late response from Tara. Javier did inform Tara on a date to go back Tara Refused the re schedule and cancelled contract so all warranty was voided. We invoiced Tara for materials and 3 days of labor and for the final invoice, we refunded half of the amount for the haul away she had hired ( which was not brought to our attention till 3 months later after trying to collect payment not including haul away discount ) since we did demo the fence. Please see attached files of conversation with Tara and APC MGMT. We have also attached pictures of the conversation between Javier and Tara ****.
Down Below is a preview of the conversation between tara and Javier.
May 12, 2022 7:46am Javier tried to confirm if we can continue the fence installation.
May 12, 2022 8:02am Javier had to inform you that the crew had to go to a different job. Since he didn’t get a ok or a confirm notice.
May 12, 2022 8:03 am. You gave the Ok after Javier informed that we had to send the crew to a different job.
May 12, 2022 8:04 am. You stated that you confirmed at 7:31am that you gave the OK.
“Stop the new fence at the green, leave old fence for the entir
May 11, 2022 7:37pm Javier reached out to you via text (xxx-xxx-4911) see first attachment.
May 12, 2022 7:31am-7:32am Javier received the picture and following message.e 3102 section-                                                               I’lll give the linear feet of that entire section of what yo are not doing-                                                                                           we have it marked.”
      Tara ****
Per the conversation between Tara and Javier there was no confirmation until 8:03am.

Tara had took the route of breech of contract, we have informed her as to why the crew did not show up.  We did not confirm as the job being “abandoned”. As to further payments we will be billing the scope of work we have completed with all the materials that was bought for your project.
Per text messages with Javier, he stated that we were going to go back. If another contractor closes off the fence that Southland fence & Supply has installed warrant
