      I contacted Leticia ********* for an apartment they advertised on ******** ***********. The apartment **** ** ** **** ****** ** ******** *** *****. I decided to lease the apartment and paid them a deposit of $400. I paid on June 8th, 2020, and it was to be returned to me, but the owner sold the property without telling me. I have asked the owner of this company, a Mr Allan ******, to return my deposit as I actually left the apartment in a condition that was better than when I moved in. Allan ****** denied my request and has not responded to me. These people own and sell multiple properties. Some in excess of $300,000.00. I would like the owner of this business to refund my $400 deposit. Thank you for your assistance.

      Mr. **** and BBB-

      I received this complaint against one of our affiliated real estate agents Leticia *********. Please note Leticia is licensed under *** ***** ****** in the state of CA, *** ***** ****** has no presence and handles no business in the state of Texas. It seems that Leticia was involved in a personal property sale in Texas represented by another realtor/brokerage. The complainant ****** deposit was evidently transferred during escrow to the new owner/landlord of the property. Leticia is not holding the complainant ****** deposit, and *** ***** ****** never had anything to do with this sale. I received the email below from Leticia in regards to this matter. I would ask that complainant **** reach out to the agent in Texas or the new owner regarding his deposit and remove this complaint about *** ***** ****** because our brokerage was in no way involved with this property sale.


      To whom it may concern,

      I am an agent for Carlos ****** Realty. I represented Alan ****** and his company in the sale of the property located at 6623 Ave S, Houston, TX  77011. The sale closed on 01/20/2022.  All deposits where transferred to the new owner on the Final Settlement Statement ( HUD ) on line item #215 in accordance with the contract.  The deposits transferred to the new owner included the $400.00 deposit for Daniel Cruz. Daniel **** was still residing at the property at the time of the sale.  The information for the new owner is Julosmo (281) 808-8040.  Mr. Daniel **** should contact the new owner as it relates to their deposit.  If there are any further questions regarding this matter please feel free to call me to discuss.

      To whom it may concern, 

      My apologies for not responding directly sooner as I was not aware that a complaint had been filed until today. I'm not sure how I missed it, but it looks like our real estate agent that was involved in the transaction did respond on 10/25/2022 after hearing from Leticia *********, see attached. 

      As stated in his response, our company represented Mr. ****** on the sale of the property at 6623 Avenue S, Houston, TX 77011. As is the practice when a rental property is closed, all deposits and pre-paid rents held by the owner are credited to the buyer at closing. That credit appears on the attached HUD Settlement Statement line 215, page 1, under Summary of Borrower's Transaction. 

      The party that has the funds and is responsible for the refund of Mr. Dela****** deposit is the company that purchased the property, JULOSMO LLC. I was told that Julian is one of the owners of the company and can be reached at 281-808-8040. Our agent, Eric Garcia, talked to him this evening to let him know about the complaint. Julian said he would take care of it. 

      Please have Mr. Dela**** contact JULOSMO LLC for the refund.
