I just spoke with James (May 9, 2024) regarding my IRS resolution. I am extremely frustrated with the outcome of this as James informed me I still will owe the IRS the full amount. I was told in the beginning process that my amount owed to the IRS would be lowered from $9,047 to approximately $905. I was also told that my savings account is considered future income and could not be part of my debt to income ratio. I paid $1,900 upfront for a service that did nothing. I have no documentation in the portal indicating that anything was done on the part of Finish Line Tax Solutions regarding this matter. This sounds like nothing more than a scam. I provided a lot of personal identifiable information which I am now very concerned about.

      Official Response: Susan ********
BBB Case # ******** - FinishLine Tax Solutions, LLC
      Customer Information:
      1. Communication with James: The customer spoke with James on May 9, 2024, regarding their IRS resolution.

Response: This is true. Financial information was completed (Form 433-A attached) and resolution options were discussed with the client. Based on this information, the client was informed of her resolution option.

      2. Frustration with Outcome: The customer is extremely frustrated with the outcome, as they were informed by James that they still owe the IRS the full amount.

Response: While the client may be frustrated with the outcome, the service agreement clearly explains the scope of our service.

      3. Initial Promises: The customer was told at the beginning of the process that their amount owed to the IRS would be lowered from $9,047 to approximately $905.

Response: I cannot determine if this information was or was not discussed with our Settlement Officer because each client's ability to receive a reduction varies.

      4. Savings Account Consideration: The customer was informed that their savings account is considered future income and could not be part of their debt-to-income ratio.

Response: The client has a substantial savings account which is more than the tax debt and is considered to be a liquidable asset that can satisfy the tax debt by the IRS. This limits eligibility for some IRS programs but not all. The client did not present any special circumstances for consideration.

      5. Upfront Payment: The customer paid $1,900 upfront for the service.

Response: The client did not engage with an upfront fee. She was presented with the fee for both services (consultation/resolution) as outlined in the service agreement.

      6. Lack of Documentation: The customer has no documentation in the portal indicating that anything was done by Finish Line Tax Solutions regarding their case.

Response: Although the client stated a lack of documentation, all documents were at the client's disposal via our online Client Portal, which the client has acknowledged knowledge of.

      7. Accusation of Scam: The customer feels that this situation sounds like nothing more than a scam.

Response: While the client may feel this is a scam, it is not. Most clients that engage in our service are informed during our welcome call and emailed an expectancy email regarding our services. While many fail to review this information, our staff strives to communicate via the client portal, email, and SMS. The client could have requested this information at any time.

      8. Concern for Personal Information: The customer provided a lot of personal identifiable information and is now very concerned about its security and use.

Response: While the client may be concerned about personal information, rest assured we handle our clients' information with the utmost security. While the client may disagree with our methods, the client did not follow our outlined cancellation policy regarding formally sending an email to our billing department for account closure. Based on this complaint, I will begin processing the request and issue a signature page for the release of these funds. Per the cancellation section, the client will be charged for the initial consultation fee and half of the resolution fee (attached Service Agreement) for review. Any other disputes, the client will need to review the arbitration section.
Thank you for your attention to this matter.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.

I would like to start by stating that I never received from Finish Line Tax Solutions the 433-A nor the Case Notes which they've attached hereto as part of their response .  Furthermore, when initially engaging with Finish Line Tax Solution, I requested to review their Exhibit A as referenced in their Service Agreement (Section 8 "Refunds", subsection 8.2).  I never received the Exhibit nor was it ever uploaded into their portal.

I received an email from Finish Line Tax Solutions on 5/17/2024 with a "Cancellation Agreement; BBC Complaint" to refund me $750.00 from the initial upfront payment of $1,900.00 (I know they stated on this website that the $1,900.00 was not upfront, but it was). On 5/18/2024, I responded to Finish Line Tax Solutions again requesting a copy of their Exhibit A to the Service Agreement (due to the fact of no longer having access to the portal for information) and was informed that due to my BBC complaint all communication needs to be addressed here.

The fact that this business states they can assist in resolving tax issues and then provided me with zero resolution (I still owe the IRS the full amount and paid this business $1,900.00 on top of that....just to put me in deeper debt).  I could have just contacted the IRS myself to review the 2 options I was provided with from Front Line Tax Solutions.

      Regards,

      Susan ********

My concern is the inconsistent and lack of communication/timely follow-up. Also, whenever you call there is always someone deflecting your concerns as if they can assist you. You can't escalate your concerns accordingly. There is no accountability with matters. And IRS deadlines are never met. Additionally, I've asked to be provided a copy of info presented to IRS and never received a response after numerous emails and phone calls. Lack of professionalism and too many barriers that hinder progress unnecessarily. I've also experienced more accounts compromised/scammed since my interactions with this company.

My first contact with Finishline was in June of 2023. I contacted them to resolve tax issues with my state DOR and the IRS. I was told that the first step was to complete the returns with one of their professionals and then discuss a resolution. During that time, there was to be a hold filed with the state and the IRS to ensure we had time. $3300 was paid, the taxes were completed, but only the standard deduction and I was told the analyst would decide whether to itemize. After that, the person that I was dealing with stopped returning my calls and did not respond to emails. Money was being taken by the state from our checks and bank accounts. Everyone that answered the phone said that the person (Jeff *********) would respond. He never did. Steffany ******* finally replied in October and arrangements were made. More money was needed "now that they had the discovery" situation. More money was paid and then Steffany stopped returning my calls. Twice burned. Eric ******** then finally replied and promised satisfaction. I told him that we had hired another Accountant and their services were no longer needed. I requested a refund. He said he could fix things. I told him that I would need them to guarantee me that I was paid in full. I told him that he had 2 days to get the approval because the other company was putting their charges through. He replied a week later and I told him it was too late. I want a full refund. He required a email to "[email protected]" cancelling services after submitting the same directly to him. No response from that point.

Subject: Response to BBB Complaint - Case #******** (Erik ************)

      Dear Mr. ************,

I appreciate your patience as we address your concerns and provide clarity on the matters raised. Your feedback is important to us, and I want to assure you that we are committed to resolving this situation to your satisfaction.

Based on our recent discussions and the details outlined in your complaint:

      Disputed Amount and Service Agreements:
We have reviewed the service agreements and understand the discrepancy in the disputed amount. As discussed on 01/11/2024, I have initiated the refund process for the accurate and refundable amount of $2,038.96. The signature page for the release of funds has been emailed to you.

      Cancellation Request and Chargeback:
You were notified about the assessment of your cancellation request on December 18, 2023. Unfortunately, before the completion of the account review, a chargeback was initiated on December 24, 2023, resulting in a temporary hold on your account. I also inform you that as of January 5, 2024, FinishLine Tax Solutions successfully resolved and won the chargeback. However, due to the cancellation request, these are the funds to which (you) the client is entitled to receive.

      Refund Discussion and Verbiage Concerns:
On January 11, 2024 - We have thoroughly discussed your request for a refund, and I have clarified the verbiage in the signature page. January 12, 2024 - The refundable amount of $2,038.96 is accurate and PENDING your signature for release. I also understand your concerns about the verbiage, and I want to assure you that it aligns with our service agreements.

      Additional Issues Under Review:
I acknowledge that there are other issues under review, beyond my scope of service and your request has been escalated for review. While I cannot guarantee additional refunds at this time, rest assured that each aspect is being carefully considered.

I appreciate your understanding throughout this process, and I am committed to maintaining open communication. If there are further questions or concerns, please feel free to reach out. We value your business and are dedicated to addressing your concerns promptly.

Thank you for bringing this matter to our attention.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.

      TO THE REPRESENTATIVE.

      Melody,

I have shown a great deal of patience. The disputed amount will now go up to include damages caused by your neglect.

Your attempt to gloat over the bank allowing the chargeback is also not appreciated as I had previously mentioned I did not pursue the matter with the bank when you stated that you would refund the $2,038.96.  You received that money back due as I acquiesced to move the process along for the refund.

Unfortunately, you have used language in your refund that would give you access to not only put money into my account but to take it back out.

The verbal agreement was that you would refund my credit card.  Why would you then need access to my bank.

I will be pursuing this matter in WI Small Claims Court if I don’t receive a revised document addressing the proper method of refund.

In addition, I will be pursuing the original amount of $3,300 that was required of me to produce my tax returns for the years in question.

The taxes were to be done by your team and then gone over with me by an Analyst.

THIS DID NOT HAPPEN. I could not even garner a response from anyone in your office for 3 months.

The returns were done with standard deductions and could have been obtained from HR Block for a small percentage of that charge.  I never would have agreed had I known there would be no analysis and those were final.   No more deductions were sought.

In the least, the $300 of the $3300 that you earmarked for “Analysis” should be returned.

You are marketed as a solution for Tax issues with the IRS and state DORs, but the 3 separate times that I was abandoned by your team for long periods of time has only exacerbated the issues.   The charges upon charges that once you have paid in, you feel like you need to just take the abuse in order the get it all over with, but your continued disappearances have resolved nothing in a matter that should have been treated as TIME SENSITIVE.

During the whole process, the State DOR was still pulling money that we could not spare from accounts and payroll checks.

      With great aggravation,

      Erik ************

I would like to address the concerns you've raised in your BBB complaint regarding your experience with our services. Your satisfaction is of the utmost importance to us, and I sincerely apologize for any inconvenience you may have encountered.
I understand that you engaged our services with the expectation that we would handle your tax debt matter with the ********** ********* *** ***** (** ***). I appreciate your patience and willingness to work with us on this issue. After a thorough review of your case, here's the summary of the steps that have been taken:
Consultation with ** ***: Our team-initiated contact with the ** *** on March 28, 2023, and conducted a conference call with you and the state. This is a standard procedure to explore the collections activity, tax filings, and possibility of settling your tax debt for a reduced amount.
Compliance Matter: In the course of our communications with the ** ***, it became apparent that specific tax returns must be finalized before advancing with any resolution options. These outstanding tax years pertain to 2020, 2021, and 2022. As per our discussions, you confirmed your intention to proceed with the preparation of these tax returns. To facilitate progress, we temporarily placed your account on hold, awaiting confirmation of the tax filings. Regrettably, we have yet to receive a follow-up or phone call to proceed with this crucial step.

      Dear Mr. *** *******

I hope this message finds you well. I want to begin by expressing my sincere apologies for any inconvenience you have experienced in this matter. I understand your concerns and frustration regarding the refundable amount for the resolutions service.

I would like to clarify that the refundable amount of $1,200.00 was offered in accordance with our service agreement, and it is not negotiable. Our commitment to helping clients resolve their tax debt is contingent upon their active participation in the process, as outlined in the signed Service Agreement.

I have attached the account's activity notes, which are timestamped to provide a record of all activity related to your account. It is important to note that when a client has a compliance issue, and our services do not include tax preparation, we rely on the client's assistance in resolving these matters. Regrettably, no communication was received from our office between March 29, 2023, and your recent request.

The refundable amount of $1,200.00 remains available, and I am willing to reactivate the signature form for your convenience. However, I must emphasize that, based on our agreement, no other options are available in this regard.

Please let me know how you would like to proceed, and I will do my utmost to assist you in resolving this matter to your satisfaction.

Hello, I have been working with Finishline tax solutions that last 2 years in attempts to assist with 2019 and 2020 back taxes owed (combined 11,000). I signed a contract with Bo *****, and he said that the lawyers would be able to assist me. I asked him if this company was a scam and Bo reassured me that my case would be resolved due to the loss of my teaching career (24 years) due to major health problems, divorce, and financial hardship. Finishline tax solutions had me set up automatic payments ($200/month). Unfortunately I had surgery and was in and out of the hospital for colon cancer. I thought Finishline was handling my case because of the monthly payments drafted from my checking account. I was approved for disability after 4 years and was devastated when I found out that the IRS added penalties and a tax lien was instated. I rent an apartment with my son (18) and daughter (20). I have been communicating with multiple individuals from Finishline and the IRS. I have attached emails, documents that I have sent them on several occasions. Finishline is not telling me that they will not apply any of the money paid to them, and can no longer assist me. I have paid them over 5,000$ Any suggestions? I can’t afford to hire another lawyer. Dear Mrs. *******,

Thank you for contacting us regarding your BBB complaint. The IRS may add penalties and interest to the balance of a taxpayer's debt, and they have the right to file a tax lien against a taxpayer's property or assets as a form of enforced collection. When a taxpayer settles their debt with the IRS through an offer in compromise, the penalties or interest associated with the debt must be taken into account as part of the proposed settlement amount. However, a tax lien is not necessarily released when a taxpayer accepts an offer in compromise. The IRS may continue to maintain a lien against the taxpayer's assets in order to secure future payment of taxes, but it would not be actively enforced against the taxpayer. Given the facts outlined in your complaint, you appear to be a good candidate for an offer in compromise. However, complications can arise when a taxpayer decides to handle their own business with the IRS instead of allowing a professional representative to do so. This may have been the case here, as the IRS has closed our request due to not receiving the documentation you stated was sent directly by you. Please reach out to our office again at your earliest convenience so that we can discuss the options available to you. Thank you in advance. Thank you for contacting us regarding your BBB complaint. Dear Cindy *******,

We understand your frustration in trying to resolve your tax issues with the IRS. We sympathize with your situation and are committed to helping you in any way we can. FLTS can assist you in resolving your tax debt, but for the best possible outcome you must work with our representative and allow us to perform the work and communicate with the IRS on your behalf. Unfortunately, your account is not eligible for a refund based on us satisfying our contractual agreement. Although, we cannot guarantee an accepted offer from the IRS. What we can guarantee is that we will do our best to resolve your tax debt by the best possible option based on your ability or lack of ability to pay the debt. To ensure that you are satisfied as our client, we are willing to explore other settlement options, and if you are a good candidate for an offer, we can possibly reconsider submitting a new offer. If you would like to proceed forward, please contact me directly to discuss.

      Respectfully,

      Melody *******

I still can’t believe that I was contacted by Bo ***** with Finishline Tax services over 3 years ago, making monthly payments to this law firm, to no avail. I received another notice last week that nothing has been resolved.

Please advise. I do not want to complete another offer in compromise. I want all the money I have paid to your company applied to my IRS account balances. I struggled to pay these back taxes because I was awaiting approval for disability (took 4 years), Covid hit, medical expenses, etc. We are both career long educators for the Aiken County School District (my husband just retired after 39 years, I made it to 25 before my health issues).

      Sincerely,

      Cindy and Patrick *******

I contacted ******* *** ********* to try and get help with my tax debt. They referred me to their partner which was FinishLinetaxsolution where I ended up discussing my tax problem. I went through questionnaires with Lou B******* of the company where he told me he could help. That was in March of 2022. He explained that the whole process would take 3-6 months and that I would get a resolution specialist to call once the *** is ready to resolve. I went on a payment through the documents that was signed and proved that I couldn’t pay my taxes at that moment in March because I was the only one working and actually just got hired at *** ****. The total payment that I would pay in the program is $2700.00 dollars to begin resolution. I ended up paying bi weekly payments to the company 3/26/22 and my last payment was 8/27/22 which you make it the 5 month mark for resolution. I called the company after my final payment to check the next step which from my understanding should had been resolution but got not response. September I contacted the company again to try and get information and still go not response. I actually had a rep send me a email and it showed they talk to *** back in April but was sent to me by agent Christian J****** on 9/27/22. The resolution process was suppose to had been started and I should have got a call in September concerning it. In October of 2022 my wife ******** ***** actually found employment which change out finances for our family, but November which is way past the resolution period a rep named Icey S*** called on 11/17/22 to go through the resolution step. I went through all the questions and because my wife got employment she stated that the only thing they could do was prob make an arrangement with the *** to pay the debt. I signed with the ******* resolve my debt and because they waited to contact me past the time frame they set to handle my case now I only have 1 option. I could have set my own payment plan with ***. I would like refund.

I paid FinishLine tax solutions to reduce the debt the *** said I owed them. I paid them $1800 plus an additional $200 or so to file an offer in comprimise back in December of 2020. It's now Oct. 2022 and the issue is not resolved and I'm out more money than I was originally owed. The guy that I was working with was near to impossible to get in touch with and wouldn't return calls in a promt manner. He didn't appear to be very knowledgable either. I was originally promised that the debt would at least be reduced and it hasn't been. This was extremely frustrating and I feel like I was scammed. I will never use them again.

      Dear ***** ********,
Thank you for contacting us regarding your account, and yes dealing with the Internal Revenue Service can be daunting and frustrating; however, the representative who assisted you and is currently working on your account is very knowledgeable and well trained. Your assigned representative has appealed the ***** judgment that your income was higher than you reported. However, it is a process. Should you have any further questions or concerns, please contact our office directly. Thank you in advance.

      Regards,
If my taxes owed remain the same then I want a refund/partial refund of what I paid to Finishline Tax Solutions since I will then be out of pocket the original taxes owed and the fee you all charged and promised some type of reduction in tax payment. If my taxes are not significantly reduced, as promised, hiring you all to help was a complete scam and waste of time.

While I am deeply sorry that you disagree with my response, the case is still ongoing and an appeal has been initiated. Paid for Finishline to assist me with IRS debt; this started in early 2021. Through several representatives of this company, I have been misrepresented to IRS about my offer in compromise. The offer sent to IRS was not discussed or negotiated with me. Bottom line I have paid this company $1900.00 and no satisfaction with my case/debt; they failed to forward a signed POA to IRS on my behalf. IRS had to call me to tell me the mistakes Finishline made. I have received a letter from IRS denying my offer, so at this point I guess I will have to defend myself.

      Dear ********* *****,
Thank you for contacting us about your FinishLine account. The Internal Revenue Service and/or state are both able to settle cases based on the client's ability to pay what they owe, as well as factors such as special circumstances. Your complaint claims, "I have been misrepresentated to the IRS regarding my offer in compromise." “The offer sent to the IRS was not discussed or negotiated with me.” Based on my investigation, I have determined that this statement is inaccurate and that you agreed and signed to have the offer submitted to the IRS.
The Offer In Compromise submitted on your behalf was rejected based on the IRS equity and asset table showing you have the ability to fully pay your tax debt and no special circumstances were provided by you regarding any information that should have been considered by the IRS.
If you need additional assistance, our staff can assist you with other options to resolve your debt. You can reach us through our customer service department by calling (855) 829-5464.
      Again, thank you!

      Better Business Bureau:

Miss ******* a Lump sum payment of $1000 is not a monthly payment, that is why IRS denied my offer. That is what Finishline told IRS I was willing to pay of my $9k debt.  So, in my eyes Finish line has not negotiated a good repayment plan for me so I do not know what you are looking at, but my case has not been resolved to my satisfaction.  I have reviewed the response made by the business in reference to complaint ID ******** and have determined that this proposed action would not resolve my complaint.

I will continue to stand firm on my belief that Finishline did not resolve my case and will spread word of mouth of the poor service I have received.

      Business response

      10/30/2022

      Dear Ms. ********* *****,

I regret to inform you that your request for a full refund is still denied. Based on your recent reply, you believed the lump sum offer amount was the problem. I think that was not the problem. The problem would be assets versus liabilities and if the Internal Revenue Service believes they can recoup all tax debt within your collection statute of expiration dates.
During the offer investigation, the taxpayer’s individual circumstances are evaluated, and the IRS will make a determination for disposition to either return, reject, withdraw, terminate, or accept the offer. This section provides direction to offer examiners, offer specialists, and IRS employees in the Appeals Division who conduct financial analysis of a taxpayer’s offer in compromise. If you believed any of this information was not correct, then your Financial Analyst should have been notified of the inaccuracy and an appeal could have been filed.
In addition, I offered to set up an installment agreement for your tax debt, but you refused. Therefore, I must stand on the cancellation policy you signed on May 20, 2021. Which states the following:
Section 6. Cancellation and refund policy
      1. Client has the right to cancel this agreement within 3 days from the date of this agreement by notifying Finish Line Tax Solutions, LLC. in writing, as attested by date stamped fax or date stamped e-mail.
      2. Client, upon cancellation, can receive up to an 80% refund of the total fee paid as indicated in Section IV of this agreement.
      3. If client cancels after 3 days from the commencement of this agreement, then hourly rate of $350 will be charged against the time allotted to client case and balance owed to either the client or to Finishline Tax Solutions will be invoiced.
      4. Refund amount will be based on any preliminary work, evaluation, and the substantial and valuable advice the client received during the interview process.
      5. 4. Finish Line Tax Solutions, LLC.’s total liability to client is limited to the fee paid by the client as evidenced in Section 4 of this agreement.
      6. The client will not receive a refund should the client fail to perform under this agreement or in breach of any portion of this agreement.

      Sincerely,

      Melody J
