I paid $1200 for puppy with health guaranteed. I paid $500 to meet breeder in ****** to pick up puppy and within 24 hours I noticed the ***** WAS MISSING AN ENTIRE FOOT. I took him to the vet and he also had ear mites. The breeder claims she was unaware of the MISSING FOOT and refuses to reimburse. The vet and specialist have said that the puppy will either need a prosthetic foot or a full amputation! It is requiring an extensive amount of time and money to attempt to save this poor puppys life and I seriously worry about how the other dogs in her care are neglected. The breeder pretty much said she didnt realize but cant give my money back.

I purchased a 4 yr. old female Poodle from this breeder with full AKC papers for the purpose of breeding. The breeder told me that she was clear of Brucellosis, so I bred her because she was in heat. Due to the fact I was told she was clear, I did not test ****. Approx. 7-8 wks. gestation, **** lost her puppies. I contacted ************************* by email to ask her should I be concerned about *********** and she said no. Again telling me she was tested and negative. Then in January another one of my females which I had raised from birth lost her puppies. We took her in for testing and she was positive on the screening RSAT. The female from ***************** was the only dog I had purchased from an outside breeder in many years. I do not stud out my males so they aren't exposed. All of them totaling 7 females were raised here from puppies. We never had any lost litters until I bought the one from ***************** aka Texas Red Toy Poodles. I emailed her again to tell her **** was positive & had to be euthanized. So now all of my poodles are having to be tested to the amount of $180 per dog and will need to be tested more than once. The dog purchased was for breeding, and according to the buyer should be clear to do that or I would have tested her at the time of purchase. Even though she states that there are no refunds, due to the expense and having to euthanize ****, we should at least be reimbursed the $1800 purchase price. I am not asking for over the $5k it will cost in testing OR the cost of having to purchase other poodles for breeding.

This breeder has moved and lives in ****** but something is suspicious about her now that I have had this issue with her.
She has an address in **** **, ***************************** ****, ** ******************************* ******. She doesn't allow anyone to come to her home or to visit and see where her poodles are raised.

I posted **** on my website As Retired mom, as she had already had 3 litters two were registered with AKC and can be verified with ******************** by calling them, the 3rd litter was sold as pets only no papers. I am phasing out my phantoms had 3 females including ****, now have just 1 and will rehome her this summer. My focus is on RED Poodles and since my husband has been disabled since November 2022 with Chronic Vertebrae Osteomyelitis and Sepsis I am downsizing as I have to care for him.

*************************** of ******* Toy poodles contacted me about **** and asked if I would sell her with full Rights, I agreed and gave her the pet price I had advertised on my site, normally my full AKC is $1000 extra and person vetted. I knew of but did not know her personally but seemed like a reasonable person. She did ask me how many litters **** had and if **** had been tested for Brucellosis and I told her all my dogs are tested prior to being put with my current dogs, my kennel as my veterinarian states is Brucellosis free since all my dogs are tested prior to being with my dogs. Those were her 3 basic questions and my answers. No False statements by me were made to her.

I learned thru a review from a customer that she replied to (see attached) that she admits her backyard is not completely fenced in and her neighbor's dogs enter her yard as well as wildlife. Her yard IS NOT secure and DOES NOT keep strays, neighbor's dogs, wildlife etc. out of her property which can carry *********** and result in her dogs coming in contact thru feces, urine etc from these animals.

She states in her own health contract that dogs purchased from her must be taken to vet within 5 days or health guarantee is void,(my health contract states 2 days must be taken to vet or contract void) she did not bother to take **** to the vet until after, she bred her to confirm her pregnancy about 4 weeks on October 24th after she purchased her from me end of September 2022. I cannot be held responsible for her decision of not properly vetting ****, health guarantee is void according to my health contract and even ***************************** health contract see attached. All I know is that she had 3 healthy litters of puppies here at my home, what happened after *************************** picked her up end of September till now, I don't know.

I am very sadden that **** was euthanized, which I just learned thru this complaint I regret letting ****** have her and I will never sell a dog to a breeder again. **** would be alive today if not having gone to ******. No refund is due.

I will be attaching all the items I have mentioned in this letter.

(The consumer indicated he/she DID NOT accept the response from the business.)
The info that she is submitting is totally not true. I don't know why ***************** is even mentioning things like my contract or yard which is not pertinent to ****'s health.
Here are the true facts about the dog I am referencing in my complaint. I bought **** on 9/10/22 as indicated on the *** paperwork. She told me that **** was
negatively tested for brucellosis BUT she didn't tell me that it was in 2019!!! The test ***************** had done was strictly a screening test which can produce negative results if a dog has just recently been exposed. According to our vet's office, Decatur Vet, a female can produce live puppies as this disease can hide in cells. Our contract is for puppies NOT adults. What she is reporting about our yard is completely false as well. We have 2.5 acres that isn't totally fenced and that is the response for a buyer that bought a puppy from us. We have 2 adjoining fenced yards at our home that is for our inside dogs go outside. **** was never away from that yard or taken any place but our home. NO OTHER OGS are allowed in our fenced area, and buyers aren't allowed to bring their dogs to our home. What I was referring to in the review she is referencing is that we do not take our puppies outside prior to a buyer picking them up from us. I was mentioning that rabbits and squirrels can come thru the chainlink fence. We do not allow our breeding dogs to wander outside their fenced yard so they aren't exposed to anything from the outside perimeter of our property. ***************** doesn't have her facts correct. Our health contract is for PUPPIES and it doesn't apply to any animal we purchase. **** was 6.5 wks. into a pregnancy when she lost her puppies due to her being positive to brucellosis. All of my breeding stock has been cleared for Brucellosis and like I said
before, **** was the only one that I bought from an outside breeder. When I was considering the purchase of ****, she told me that she wanted to sell/place her because of she did not want to be licensed by the state. She needed 1 less dog for the state's requirement. Now she has another reason, due tof her husband's disability. So why does she still have her license number on her website??? I included ****'s euthanasia report when I emailed the results to her on 2/16/23 so I don't know why she would say she didn't know about that. Euthanasia is recommended as it cannot be cured and must be eradicated in a breeding program. I am saddened by this fact as well as the possibility of losing some of our poodles. I'm not asking for the costs of the testing or the price of replenishing any we will lose. I'm just asking for the purchase price to be refunded before any other options are considered.

Her yard issue was as she states, in a customer review explaining her fence was not around her entire yard.

Fact All my dogs prior to being put with any other dog has been tested and I like ******************* have raised and kept back pups and just have an occasional one from outside.

Fact She asked me if **** was tested, I said yes, and I attached the document in my first response. I have never asked that question from any breeder I bought from I just automatically take to vet for exam and have tested and get results.

Fact I told her I was downsizing, but license is not just for how many adult females it states AND, OR 20 OR MORE PUPPIES SOLD OR GIVEN AWAY IN A YEAR. I may not be under 20 pups this year so keeping it for now. My husband since November has become seriously ill and unable to work and is in constant pain.

Fact **** had 3 litters of nice healthy pups here, and at this point it is "Simply I said, She said" Since **** was not taken to the vet when she was purchased by ******************* in September.

My stress level with everything going on with my husband including another surgery upcoming end of this March is overwhelming and in order to resolve this with no further action and to relieve myself of one more thing I will refund the purchase price.

I would like her reply acknowledging that this will end this matter. I would need her address to mail a check or I could Zelle her but need her information in order to do so.

Await reply with information and acknowledgment of end resolution.

(The consumer indicated he/she ACCEPTED the response from the business.)
She can send it to our home address which is
      ***************************** *****, ** 76078
HOWEVER, IT NEEDS TO BE A CASHIER'S CHECK OR **** MONEY ORDER because I had to pay in cash for the said dog. She would not accept a check and I should not have to take a check from her either. She should have our address on file since that is a requirement with AKC for the disposition of said animal.
