I requested the stated information on May 8th and KBHS has still not provided it tome, even after several follow up calls and emails over the last week. KBHS Jessic aSellers also admitted to me over the phone that since I did not qualify for the primary home loan, as this property is my primary residence, that KBHS wanted me to make fraudulent statements for applying for a secondary home loan (investment loan)option. This is clearly in violation of federal laws as it is reverse occupancy fraud. They stated that because there was another path forward, they would not provide me with a denial letter so that I could receive builder credits and move forward with another lender. Their path forward would have me willingly accept a rate 1.6% above the market rate at the time the initial application was sent forward to underwriting. I am also submitting complaints to the **** and the VA. KBHS is in clear violation of the Equal Credit Opportunity Act by not providing me with the requested documents in a timely manner, and they have stated that they will not release them to me without a subpoena. My original application was a VA home loan for a primary residence and I was unable to provide documentation that I could work remotely from my job in ***** (moving to *******). This is a clear denial of the application that states I am applying for a primary residence - never an investment property. Thank you for your time.
