I went into business with ******* regarding the installation of my HVAC unit. I advised him of my financial situation as I dealt with a shady subcontractor who installed a defective unit prior and would not respond to repairing the unit. ******* then suggested that I get my coil replaced along with getting a new unit although my defective unit still has warranty coverage through the manufacturer. Per text messages and my understanding my total cost for that would be around $3500 in which I have paid him $3000 already. ******* then completes the installation of the new unit and coil and provided photos of the completed job back on 8/18/23. However, what I did not understand is that he took my old unit that I did not give permission for him to keep. I thank him and was very satisfied with the completed job. I asked him what is my balance owed. Some weeks go by and then he states that I owe him $1700 more dollars. I admit that I was rather appalled as that cost was never disclosed. To my understanding, I was under the impression that my balance would $500 per discussion. He then states that he would not have done the job for the $3500 and states that labor is owed for the installation of the coil. I expressed my disagreement of the cost although I agree that a balance is indeed owed. On 10/2/23 upon returning from vacation, ******* proceeds to come to my home unannounced and steal my AC unit. He deliberately waited until my husband and I left our residence. I verified this per our neighbors and my son that it took place. He knew where my security cameras were set up in order for him to be as discrete as possible. I contacted my local authorities as they stated they would not show up as it would be a civil matter. My local police department called ******* and verified that he stole my unit. This is per conversation with the officer. I do have an incident number to cite that. Please understand that ******* now has both of my units and the $3000 I paid so far currently.

      Business response

      10/26/2023

      Dear BBB,
This email is in response to Ms ***** complaint ( ********). First let me state that I tried communicating with ***** on some many occasions and she would never return text or calls. Ive to date not spoken to this customer in weeks. She has called the police and contacted the BBB but not SMCC  the company she owns the balance with and I believe thats because she not planning and never was planning to make right with the balance owned. I dont understand why this costumers has failed to call me after Ive been as patient with her about this business from day one. If she would communicate, wouldve communicated, or very try to communicate we would not be here at this point today but since we are let me clear the record about our business.
I was referred to ***** by a General contractor that was doing work at her home ( to which she hasnt completed paying him either on work he done that she was not satisfied with) but the guy was concern and called me and ask me if I was willing to look at her condenser unit cause the ** she believe had taken a part out the unit and wouldnt return her call or text. It was Aug 15,2023 and we was in the middle of some of the highest temp days in the DFW area. We was 100 degree days in a row. So I told him to have her call me. She did we agree on a Service Fee of ***** and a time/day for me to come look at the unit. I did that and told her all her components were there but the compressor was grounded ( due to the other ** guy have to small a copper line on the suction line where he connected the condenser he installed. I went to ******* to check warranty and they didnt have the replacement compressor there and didnt have a ETA on the compressor. I then called her and explained the information to *****. I have her a number of options I recommend.
1 Wait on the replacement compressor and I replace it but I couldnt warranty anything but the work I did. ******* or around that
2 Replace the condenser and get a 10 manufactured warranty and then pay someone to still replace the compressor and sell it. (*******) est I still had to fix the copper line that was 3/4 and it should be 7/8 according to the Manufacturer specifications.. In which she would still either pay me or someone to do the warranty compressor. Which I still couldnt guarantee that the system didnt have other issues **** coil wise that caused a failure also
3 Replace condenser / **** coil cause it was an up flow system and the coil could be replaced without the furnace and that way we know its all good. And she could replace the furnace later down the line.
She ask for a price on the **** coil and I got it for her and even got it discounted by ***** dollars on the Coil. I ****** told her the cost and she said it was more then she wanted to spend but she would need to do something cause her husband was recovering for a surgery or something and she didnt have hot water either. So no air or hot water I had compassion in my heart and told her I would take her old unit replace the compressor and if I could sell It ( Give her the money for me selling it and I make the money on installing her unit to the customer so she could make some of her money back. I also called my plumber about her hot water issue and he came over and replaced her hot heater at a discount for her which she was happy. So I got her hot water, and replacement her condenser unit/ with **** coil and corrected the copper line issue.
I let her know I was done send pictures of the completed job and ask if she was meeting me to paid me. She stated she was working and would meet me later I agreed. We meant she said she only had ******* and would pay me the balance the following Thursday as her bank ( ************* had a hold of ******* dollars. She knew the amount I told her before I started the job ******* which again is a fair market price and a great deal for a 3.5 ton 15 Seer system condenser/ coil.
She was very satisfied with my install and the house was cooling. I called to check with her abcs text also the next day which was a Saturday and she sent a text back freezing and comfortable thank you so much.
The Thursday came and she didnt call to meet or send the balance. Another week passed in which I went out of town and didnt call her. Upon my return I called her she didnt answer, when she did finally respond to a text it was about the warranty and proof of purchase she wanted. I then ask her about the balance and she said she would pay by the end of the week ( her bank was messing with the cash app it zelle) but she would pay me. Two weeks passed again with no communication from *****. She then responded with her last response to date in which she said again she would pay me my money. Two or Three ***** passed again I sent two or three text asking for a time and day for final payment and closing of our business deal. The install was completed 8/18/2023 and after attempting to collect the final payment of ******* for 7 weeks my last text sent September 26, 2023 I informed ***** if I didnt receive the payment by the end of the week I would be forced to move to the next step. She never responded to my text not called me to say anything. I removed my property ( which I purchased for lack of payment) Oct 2, ****************************************************** for it. She call the police NOT ME and told them I stole her unit. I explain to them the issue they said ok and told her to call me its a civil matter. ***** still has not called me. Now I am will to install it back but she will pay me the ******* she already owned me and also an additional 500 to reconnect and service it. So ******* is the price to reinstall that until and it would need to be collected before the install as I dont trust her and she has shown and proven to be untrustworthy with her promises, words, commitments, and business. I am attaching our text message proving she is being dishonest yet again on our business or what she knew vs not knew. Again sorry for her displeasure as my aim was/is has always been 100% customer satisfaction.. I can not allow customers to steal or misuse my kindness which I showed ***** in this deal and business.
