Parties entered into an agreement on August 2nd, 2022, to build an in-ground pool. Plaintiff paid $2,500 non-refundable deposit for design renderings. According to section “Project Payment” of said agreement, Plaintiff also paid 60% ($38,935) of the total project cost by check to defendant parent’s company (*** **** ******* ********** *** residing at the same business adress than Katy Backyard Solutions). 32 Days later Plaintiff asks for update by SMS twice (07:04am & 7:26pm). No answers September 18th (day 34) Plaintiff asks for update by SMS at 10:36am. No answers. September 19th (day 35) Plaintiff asks for update by SMS at 10:16am. No answers. Plaintiff contacts *** **** ******* *********** Registered Agent ******** ***** by SMS at 12:33pm for updates. No answers. September 20th (day 36) Defendant states by SMS at 8:29am that he decides to take himself away from the project as he does not feel this is a healthy contractor/customer relationship since “it seems as if you would like to have a project manager and contractor that would communicates daily, and multiple times a day with multiple customers that is not possible for me.” And follows with “I will hand this off to *** **** your signed contract contractor and have them assign you another project manager if they want to take the job. As of present you are no longer bonded, and I am no longer bonded to the contract of work since the scope has changed from the work that has been already completed and are free to move forward with another contractor.” Plaintiff responded at 9:12am “In order to move forward, what would be the best day for us to meet with you and discuss this?” Defendant stops all communication and keeps the money. Plaintiff sent a Demand letter on October 3rd requesting a refund of $36,935 from *** **** ******* ********** LLC. Defendant does not comply and takes down the company website.
