The estate of FK and ********************************* entered into an agreement with ****** Auctioneering to liquidate said estate. The items sold were of one estate but were separated out into two lots as per estate settlement. The auctioneer at no time indicated or otherwise implied that each separation would incur a 35% fee. The auction was held and the auctioneer was paid 56% of the estate plus his 12% buyer's fee. Each party in the estate was charged 35% as if they were having separate estate sales. It was the understanding that the total fee for the entire auction was to be only 35% not 35% for each group of items. The sale was on the same property at the same time on the same day.Business response

I entered in an agreement with two parties . One was with the estate of ********************************* and one with ***************************** of his personal property seperate from the estate and I was ask to seperate his property which I did with his direction as to who owned what. . To this day ***************************** has not contacted me personally about any complaint. I hand deliver his inventory and check to him in person. Nothing was ever mentioned about a complaint from him personally. ***** was told there was 35% commission per item from both parties with a $ **** minimum charge which ever was greater. I did call the estate excutor and they agreed to cover the minimum fee so I didn't charge each party a minimum, only the estate. It doesn't matter how many is on the same property one or 20. It still is 35%. per lot sold. I was lead to believe other items were to be sold as well which ***************************** withdrew from the sale which also my agreement states i receive a commission for with drawing any items.
***** was extreamly rude and cursed out one of my female employees which should have filed a law suite against him but ddn't. ***** offered to pay me for my work after he verbally threaten my employee and i told him to pay me if thats what he wanted to do. But I don't feel ***** could afford to pay me so he elected to have the sale.
***************************** had verbally cursed out his sister a few days before for which she apologized to me for his rudness and said now I knew what she was dealing with.
***** was living on the estate property inside the home which was agreed to be out before I started work on inventory. He remained inside the home and some weekends had grandchildren there that kept my employees from doing there job. Yes I do charge a 10% buyers premium not 12% which is a cost to the buyer not *****************************. Yes he was charged only 35% with no minimum.
***************************** has my phone number and email and his sister has emailed me but ***************************** has not once contacted me. So I suggest if he wants to complain he should start by contacting me personally.
