We began trying to buy a home from **** late October. We repeatedly sent documentation payment information via email, text message and phone calls to ************ chosen titling company and lender. **** said if we want to buy the home we need to get $5000 upfront to start the process and that money would go towards the down payment towards the house once the process was complete. We sent about $1k additionally to a titling company, and a loan processor business at **** homes request. I myself how to reach out to these entities because **** never kept us up to date. I reached out to **** home and told them that we are concerned with the lack of communication and the repeated request for our personal information that we have sent on multiple occasions. Sharing read/delivered receipts. Numerous times we were told we were going to receive our documents or calls and deadline after deadline were missed. Closing was supposed to be on November 17th. We took time away from work, gave notice on the home that we are living in & as of today they have not delivered on any promises. We have occurred additional cost having to pay our landlord over $2800 to continue to stay in the home. After reaching out to **** homes telling them we no longer feel comfortable with their business practices. **** insisted on keeping our $5K down payment, their response was because it wasnt their fault. The process has been delayed. The money was deposited into the account of **** Homes. We have gave over $6K for nothing. We have retained all the incomplete information, unanswered emails, texts and lack of communication from all parties including proof sent **** deposited the money to themselves. The home was not taken off the market, is still posted on ************* page.We gave them 3 business days to return our money. **** stopped responding.I believe this is a scamming tactic and **** homes gives people false guarantees of purchasing a home, requiring $5k down to start the process and retain.

We understand your **ncern about the ******* deposit and suggest you review the **ntract to understand the purpose of the ******* deposit and what happens in the case the buyer defaults on the agreement in paragraph #**. We are willing to work with you on the terms to ************ deal if you are open to it.

      Thank you

I am rejecting this response because:**** homes and ***** are refusing to refund money that was promised to be refunded. We asked multiple times prior to him taking our money if it was refundable if we were unable to proceed. We

needed the home to have my dying father move in with me. Please explain what service was provided specifically by **** homes that warrants them keeping $5000! Absolutely nothing. Attached  are only a few messages, emails, requests for information, timelines, questions. I have over 23 emails requesting updates and numerous requests of any news. We got excuses, of vacation, out sick, unable to find email, supposed errors that required paperwork changes and signatures on paperwork already signed. ******* is also not a licensed real estate agent and is falsely representing himself. We have attempted to locate his license on TREC with no success. His license is not found or displayed and him and **** homes are using multiple FB pages with false representations. These are scamming tactics. They are already advertising agin to scam their next victim. They want to say we backed out of a deal we begged and emailed and text to complete. My father is dying with stage 4 cancer *** need to be  moving into our home. **** homes and ***** knew we needed our home no later than 12/1. We paid over $3800  additionally to keep a roof over his and our heads because he was unable to make 2 moves hoping the home would be closed by 11/17, then 11/26 then again on 12/3, and deadline after deadline was not met.
This has been a nightmare and the fact that they think they feel good about the business they provide makes me disappointed in ****************** as
a human being knowing my fathers situation and taking from us.

      Regards,

      *********************

We have multiple emails and texts with open line of communication with ***************, ** as the seller could only wait and pressure the **** and attorneys to speed up the process but at the end we are not the party finalizing the transaction as we are only the sellers in this transaction. We did our part to provide the title co, **** and closing attorneys all the information required for a quick transaction. The ******* deposit is a non refundable deposit, their were no issues with the property or transaction itself and we did our best to work with ************** to accommodate her needs even go as far as to offer her to move into the home prior to closing and she rejected our offer. At this point this file has been closed on our end and there is nothing at we can do.

      Thank you
