    On Sunday August 13, 2023 I picked up ******** (dog) from Hope Rescue Ranch Inc after paying $200 on Thursday, August 10, 2023 as an adoption donation. Jolene indicated on multiple occasions that ******** was heart worm negative and had a clean bill of health. As any responsible new pet owner would, I took ******** to ****** ***** Animal Hospital on Monday, August 14, 2023 and they conducted blood testing among other veterinarian care. On Tuesday August 15, 2023, ********** blood results came back as positive for heart worm, in direct contradiction to what Jolene stated multiple times. I wanted to keep ********, so I requested that the rescue cover the costs for the heart worm treatment and my reasonable request was denied. I had no choice but to return ******** on 8/15/23 per our previous agreement that if he had any serious health problems that she would receive him back. After accepting ******** back, Jolene preceded to send me extremely vulgar and demeaning text messages. In addition, after revisiting the application and the agreement Jolene states is binding and is the reason why she will not refund my adoption fee and veterinarian bills, I came to realize that I was given a foster agreement and not an adoption agreement, which I did not even sign and stated in an email that I would not sign due to it being to foster, not adopt. This was not a valid adoption contract. Jolene also informed me that while this dog was under her rescue’s care, that he was not given heart worm preventatives and his last records provided to me stated he had not had any records since December of 2022. Preventative care is any decent rescue’s responsibility during the foster period, up until adoption. Since I did not have the financial ability to keep ******** after finding HRR medical claims to be false, I am requesting a return of the adoption fee ($200) and veterinary costs ($84. Originally $235.83 but I am being refunded for the Simparica I did not use) that I have incurred. Jolene Hays did not provide adequate care for ******** at her Hope Rescue Ranch and demonstrated fraud as indicated in her deceptive interactions with me as well as negligence towards ******** before selling him to myself, as she explicitly stated she did not utilize heart worm or flea and tick medication since she took in ******** at the beginning of this year. She stated 5 different times that ******** was heart worm negative and had a clean bill of health before I paid and picked him up, only to message me Tuesday, August 15, 2023 after receiving the positive heartworm blood test from the veterinarian that she did not know that he was positive for heart worms. In every message previously, Jolene definitively and clearly stated that he was heart worm negative. I then received an email from Jolene after I reached out to her again asking for my adoption fee back and medical bills to be reimbursed stating that she did not know he was positive and that she had a “good faith negative hw test”. Again, this contradicted everything she had previously told me about his medical record and also demonstrated deceitfulness by not disclosing the fact that she did not actually know for sure that he was heart worm negative before receiving my payment and allowing the dog to be adopted.
