In April, construction started behind my house and my fence was damaged due to their work. I contacted my HOA to find out who I could contact to complain about the fence damage caused by the construction. I was advised to contact **** with SJ Louis Construction. He failed to show up after several calls made to him to request for him to come assess the fence damage. I asked my dad to reach out to him and see if he'd pick his call. He did pick up, and only after my dad threatened legal action, did **** show up at my house, with his boss ***. They looked at the fence and said they needed to look at drone footage of before the construction started to see if they indeed caused the damage and would contact me. I didn't hear back. After a few weeks I reached out to ***, who argued with me and said that he reviewed the drone footage and that they didn't cause the damage. He claimed my fence is old. I replaced the fence in Aug of 2017, it is not old and was perfectly fine till the construction started. I have photos of before and after the construction began which clearly show the damage. I asked *** for the drone footage and he refused to show me. If the drone footage he reviewed shows no damage, why did he refuse to show me? I heard of several neighbors on my block that have also complained about their fences and other damages done, and *** has been refusing to repair. This unethical, dishonest, joke of company, was hired to repair damages caused by the construction and they have refused. I have attached timestamped photos of the fence for your review. I just want the damaged part of the fence ( which is now leaning) fixed and back to where it was before the construction.Business response

With reference to BBB letter dated September 7, 2022 regarding the above, we have investigated the alleged claims for property damages due to construction work at or near ***********************************************************************. From the photos provided by the claimant, we see only regular wear and tear over time, such as warping.
Based on our investigations, at the time of our inspection, we found several areas of the fence with previous completed repairs, with a vegetation gap between the construction silt fence and the fence itself, and the silt fence still in place. This shows that the soil materials and construction equipment were contained, and never came in contact with the fence.Because there is no sufficient basis for the alleged claims, and **** Louis did not cause the alleged damages, we are respectfully denying the property damage claims.
If you are aware of any documentation or information that supports a different conclusion, we request that you please respond in writing providing any and all documentation in support of your position. Upon receipt, I will review the information and respond within 30 days.
Nothing in this letter should be construed as a waiver, modification, or release of any right, remedy, defense and/or claim that **** Louis may have under any contractual, bond, warranty, quasi-contractual, tort, equitable, statutory, or other theory, whether now or in the future. **** Louis expressly reserve all of rights, remedies, defenses and/or claims.

I am rejecting this response because: photos have timestamp and clearly show the fence damage AFTER construction had started. My fence was replaced completely in Aug of 2017 and was absolutely fine before they started the construction. The photos are proof. I've never had to make any repairs after the fence was replaced. This bogus and unscrupulous company claims to have drone footage of the fence before they started construction yet refuse to show me. And its because they know they damaged my fence or else they'd show me. They need to pay for the damage they caused. Or I will have to seek an attorney.

With reference to BBB letter dated September 27, 2022 regarding the above, it is noted that ************************ response to BBB does not provide any new documentation or information that supports a different conclusion than that stated in my letter dated September 26, 2022. All of ************************ allegations were investigated and its results are in my letter dated September 26, 2022. Although we have no duty to assist a claimant in proving up her claims if she so wishes, the condition of the fence at the time of our inspection can be seen in the enclosed photos taken of the backside of the fence from the construction right-of-way. Once again, because there is no sufficient basis for the alleged claims, and **** Louis did not cause the alleged damages, we are respectfully denying the property damage claims. If you are aware of any documentation or information that supports a different conclusion, we request that you please respond in writing providing any and all documentation in support of your position. Upon receipt, I will review the information and respond within 30 days. I am rejecting this response because: What new photos? I've already provided before and after photos with dates on them. Where is the supposed drone footage claiming that my fence was already damaged prior to them starting construction? I've provided my proof, where is their proof? Convenient that they aren't providing anything to support their decision.
