      Joes painting was contracted to paint for us on June 20. We paid $2500 toward our deposit starting May 31, 2022. When paying the deposit we were informed that our deposit would be refunded as long as we didnt cancel the day of the job. On June 6, 2022 we informed *** that we wanted to cancel due to finding a painter with sooner availability. Our deposit was paid via Zelle. We requested that our deposit be returned via Zelle but was informed that it would be returned via check. We are currently awaiting a refund.

      Good Morning, 

      Below are the facts of the story:

      1. On 5/29 ******* contracted with Joes Painting for interior painting at her home.  The total amount was $13,600. She was informed that we normally ask for 1/3 up front, but we only needed $4000.  She sent $1500 one day, then informed me the remainder would have to be paid $500 per day due to Zelle limits.  She made two more payment of $500, which means she had paid a total of $2500.  We scheduled her to begin **** 20. 

      2. On **** 6 she informed me that the house was ready early, and that she would like to cancel the job because she found a company that could start sooner.  I informed her that we could start the next day - **** 7.  Ive inserted a screenshot of me offering to start the next day. 

       

      3. She said she would talk to her husband and let me know if we could begin **** 7. 

      4. She then called me to tell me that her husband had already paid the other company half down.  I found it odd that she was unable to send me approximately 1/3 ($4000) without it being spread over several days, yet they were able to pay 1/2 to the other company immediately. 

      5. What I believe happened is they found a company that would do the work for a lesser amount, but she didnt want to be honest and just tell me.  

      6. I told her I could either refund the $2500 in installments, as I received the money, or I could mail her a check. 

      7. I wrote the check for $2500 on **** 10 (Friday), placed it in my mailbox that evening, and the check was picked up by **** on Saturday, **** 11. 

      8. She asked me yesterday (**** 15) where the check was. I informed her it left my mailbox on Saturday, and would probably be at her house today (**** 16), as I dont control the mail system. 

      9. Her check has been mailed.  The entire $2500 has been refunded.

      I had a contract with this company to paint the ceilings and do 5 very small areas to touch up They were mostly around 3 inches and a window sill.. They touched up the whole walls everywhere. Now it looks terrible. There are splotches and streaks everywhere. They said they weren't responsible for it because I asked for the very small spots. They also contracted to paint my bathroom vanity, They didn't touch it, As for the small places I showed them, only one of them was fixed. They subcontracted it out so they could go on vacation The boss of the subcontractors only came before the painting. No one checked their work. ********* wasn't even willing to look at it before she decided we were responsible for all their messand if it was to be fixed then we had to pay for it, We had already gave them over three grand. I am now having to pay another painter to make it look presentable to sale.

      On Tuesday, November 9th, we went to gather information for a quote for ***** and *******************************. ******************************* showed me what she would like painted. She mentioned that they would like their walls and ceilings touched up, as they wanted to list their house soon and do enough to get their house on the market. I advised her that when you touch up walls and or ceilings, regardess if paint is same color, the outcome would not match due to many factors with the walls, etc. She chose to just have us quote her ceilings to save money since they were the areas that needed the most attention. We emailed her a quote (that is attached) showing pricing for her interior ceilings, master bathroom cabinets and window will and a few things on the exterior portion of her house. Our crews arrived on Wednesday, December 8th to begin the work. Our crew ******************************, has been with our company for 6 years and is not subcontracted out. He contacted me to let me know that ******************** showed him a shelving unit that he had removed off the wall and asked ******* if he could fill in the holes with caulk and touch up the area, along with areas on the walls that needed touched up. This was not on the quote and ******************** had not been charged to do this. ******* again let him know that touch up paint would not match, and Mr. ********* response was " thats ok if it doesn't match, we are just trying to get the house on the market"  ******** then did the touch *** without charging the customers. Once the customers realized the paint in fact didnt match, we were contacted and shown pictures. We knew that the only resolution was to paint the entire walls, which we were willing to do. I let ******************** and their realtor know that I would come by Thursday Dec 16th so that we could determine how many walls would need to be touched up so that we could come to a fair price to get them taken care of since they both knew touch *** would not match. Their realtor contacted us and we let her know all the above information. She said she understood and agrees they should pay since they knew the outcome would not match, and would hope we would come to a fair price to have all the entire walls painted. She was told yes of course we would be fair and would make sure they would be taken care of. ********* December 16th, the day were scheduled to go back to the ********* to look over the walls, ******************** called us to let us know we did not need to come over as he was going to take care of it. He did not get us the opportunity to see what needed to be done to help resolve this. The master bath cabinets were not painted as ******* stated it was miscommunication on his part and he apologized for the confusion. Since the balance was paid in full, we were not aware the cabinets did not get painted. We are refunding $400 to *********************. Thank you for your time.
