      CASE DESCRIPTION: RE: XXXXX Patnoe Dr. The listing agent (John J*****) with Fathom Realty duped the seller (Dan P******) into taking a contract that didn't cover the entire balance of all the liens on the property including mechanics liens just to rush the process of getting his commission after being told many times to cancel the listing because of too many low offers. Additionally this agent's incompetence created more delays to this transaction by moving the contract from the original title company to a different title company and then had to return it to the original title company after his failed attempt and then raising his commission without the consent of the seller. This wild activity caused additional fees out-of-pocket for the seller, buyer and the contractor who is still owed over $35,000.00.

R****** Texas Broker Contact Phone:****-231-**** Contact Email: [email protected] Fathom Realty and our Listing Agent were hired to represent the Seller/Owner in this transaction. Our fiduciary duty was to him and him alone. We have our client's permission to quote him in this response. "My (Fathom) agent did a great job protecting my position and working in my best interests. I would fully recommend him to anyone needing professional real estate services." This complaint was filed by a non-owner who had an 'arrangement' with the Seller. That arrangement is strictly between them. Our duties were to the Seller, and based on his successful experience with this transaction: we performed beyond his expectations. And for the record the complaint mentions: 'raising his commission without permission of the seller'. This was in fact an auto-filled slot on an 'Estimate of Costs' form provided by the title company. It was not requested by or filled in by our Agent. As soon as the title company error was noticed it was corrected, well before the final documents were issued. This document gives me authorization on the disposition and activity of this property. I will pursue a suit against this company's E&O insurance. I told John he was bringing low offers in so cancel the listing and I'll sell it and pay you a fee. If Dan thinks he did a good job I'll resolve that issue with him. Business Response /* (4000, 11, 2022/03/22) */ Again: our fiduciary duty was to our client the homeowner; who was completely satisfied with our services and the results of the property sale. If the complainant had a legitimate lien or ownership stake in the property; the title company would have either paid him - or - they would have refused to close the sale. Title companies are strictly licensed and monitored by the state of Texas. The fact that they saw no irregularities or issues and closed this transaction, further endorses our position and the successful actions of our agent. This is not the forum for threats of legal action. But I can say if a suit is filed against us, we will immediately counter sue for 100% of our legal fees in this frivolous accusation.
