We had a remodel that was completed in November 2020. Starting in June 2021 we have been trying to get them back in to fix some major issues with the tile work, window install, door install, and electrical issues including GFCIs that keep tripping and scorch marks on the wall around a plug in the garage that was replaced without our knowledge after some sort of heat damage. The contractor is refusing to honor his 1-year warranty and fix the problems. We have had other contractors come to look at the work and verify that the work is not done to install specifications or code. We have 50+ chipped tiles in the kitchen, master bath floor, master bath shower, and guest bath floor. The tiles are up 1/4 out of level to each other. The kitchen floor has holes in the grout and the grout is starting to pull away from the tiles in some areas. The new window they installed is close to 1/2" out of level across 2 feet and is already sprung. The new double doors they installed do not close and seal completely and they dead bolt strike plate is missing. The new toilet in the master bedroom was installed with incorrect parts, and they used two wax rings which according to the plumbers I have contacted is out of code. This is just the list of the items that we want fixed and does not encompass the entire list of failures on the contractors part.Business response

We started the project in July I believe and completed the project on 11/4/2020. The last day of work and the final walk through . There were no issues at that time .
We accepted final payment on or before 11/12/2020 . This is when it was recorded in bank account . The entire cost of the remodel was paid for along with extras they asked for .
The first complaint came form the client on 6/24/21 , approximately 7-1/2 months from full completion and walk through .
I visited the home on 7/9/21 and was shown a few areas of concern. I accepted responsibility for approximately 6 tiles to be repaired and the shower pan to be re done . The door and the window needed minor adjustments . And there were a couple of other handyman items that needed to be touched up .
The client was notified on 8/9/21 that the tile to repair the floor arrived and we were trying to get to the repairs asap.
I explained to them that we were extremely backed up and they discussed with me that they would hire another contractor to do the repairs and I would pay for them as long as we could agree . See below in email .
In the meantime , 8/10/2021 They sent an email of the issues and , I asked for some time to process them as we already had a discussion at their home on 7/9/21 .
They then sent an email on 8/20/2021 saying that its been over a week with no reply to them . I followed up immediately and said I am working on it and it has actually been 6 working days .
I then reviewed the file and offered them ******* for the repairs and they declined the offer .
They in turn said they would find another contractor ( as stated above ) on 8/24/2021 and it will cost me .
On 10/26/2021 they contacted me via email and said they could not find any contractors to do the repairs . They were all very busy .
I replied that I had to go in for emergency eye surgery that same day and I would be out for approx. 1 week .
On 11/2/2021 they replied , We have not heard form you . I explained to them again that it has been over 2 months since you said you were looking for other contractors. I also explained it was the start of the holiday rush and we were extremely backed up .
I then spoke with my attorney and discussed the Residential construction liability act ( RCLA ) and I offered them in a letter drafted by my attorney that I would give them ******** for the repairs and that is very fair .
This letter was sent on 11/15/2021 . They have 25 days to reply which would land on or about 12/25/21 . These are working days I believe . See the attached letter .
The amount of chips in tiles they state is false . When I viewed the project originally there only a few chips and that was still 7-1/2 months after completion .
I have tried many avenues and had the discussion with them that it would be best not for us to complete the repairs do to animosity , hence them wanting to find other contractors .
I then received this complaint from the BBB . I feel it is a direct attack to dis credit David Wood ***** dba Patriot construction . I have an $******** check in their file , waiting on a response from the client .
I feel that they may never be satisfied and it will continue to be a never ending problem .
I believe this is my first complaint in over 35 years of doing business . When we make a mistake , we always take care of them or discuss a monetary offer . I follow the Texas residential construction codes , but sometime that is unreasonable for some clients .
We have multiple reviews , and have endless referrals .
I appreciate your time and I hope you have consideration on removing this complaint from my file .
