In brief, we have been working ****** ****, CEO of Ashmin Consulting. She was a family acquaintance who advertised and promoted herself as someone who would be able to provide turnkey services for our businesses. In looking through our records, we never entered into a formal contract, but both parties acknowledged recently that we were working on a verbal contract. Payments that have been made to her were: $3500 initial deposit and $1750 additional payment. Earlier last week, we met with her via **** to terminate services and request a refund of $1750. She was agreeable to return that payment and hand over any sensitive documents pertaining to our businesses this past Saturday (9/17, for which she claimed she had “a bin full” either in truth or inflate the level of work she was actually providing). However, leading up to Saturday, we discovered that she had done even less than she had lead on and so we proceeded with asking for an additional $1750 refund (in summary, a $3500 refund, allowing her to keep $1750 of the initial deposit) at which point case she stopped communicating with us, stood us up on Saturday, and is now claiming that she has no data or information to turn over to us. We wrote an email to her outlining the steps we would take if she didn’t respond and we are now at the point where we would like any and all assistance to (1) recover at least the $1750 she already agreed to initially return but ideally $3500 (2) to get her to turn over our documents to us or either get in writing from her that she does not have physical record of our SSN (or my employees) or other personal information that she could solicit. Things are further complicated by the fact that Ms. **** disclosed sensitive information to us about her previous clients that would be in direct violation of her NDA with them and so we are concerned that she will do the same with our information to any potential clients of hers. We are currently seeking legal counsel as well.
