The company took personal information from a transaction on **** and used it to sign me up, without my permission, to their mailing list and is now continuously spamming me.Business response

First of all to the BBB your two letters arrived together in the mail. One dated June 1 and one dated June 15. Just for your information.
It would be nice to know this particular customers email address so that I could remove him/her from the email list. I'm sure there was something at checkout that allowed this email to get on our list. Like you see many times..."would you like to join our email list" check box. It could have been easily missed by the customer.
We spam no one. Emails from our company are sent out once a week and very rarely possibly twice. That is not considered spam. We are a very small company with four employees. Only one person here sends out emails to customers. We do not spam people on purpose. Spam is when you are constantly receiving emails...more than once daily. I promise this company will never do that.
Also...in every email we do send there is a push button for customer to remove their email from out list.
We are very sorry that communication through email has bothered this customer and will do whatever we can to resolve. Just need the particular address to make sure this happens.

I am rejecting this response because: There is no box on ****** transactions to allow communications outside of ***** In fact, this is specifically prohibited by **** and that policy can be seen here: ***********************************************************************************************
Multiple calls to **** confirmed this with their personnel.
Next, the emails were sent through ****** email servers by using the email address similar to the following: ************************************* (the part of the address before the @ has been changed to protect my privacy). This too is against ****** policies which can be seen here: ****************************************************************************************************************************************************************************************************.
As far as an unsubscribe link, it should not be my job to undo something this business did. They use Constant Contact and according to ****** W,
Senior Compliance Specialist, Legal Support of Constant Contact, the emails sent were against their policies too because the emails were "sent through a third party as the "Sent by"and "Unsubscribe" portions of the footer are empty" which would have prohibited me from using the unsubscribe feature anyway.Constant Contact can verify this information by contacting *********************************** and referencing ref:_00D708xak._5003n2gAz7t:ref
Lastly, in regards to what is, and what is not, spam. My definition of spam, which is the ONLY definition that matters when it is in MY inbox, is any email that I did not specifically ask for, or initiate (by opting in). Under that definition, the emails were not only against multiple **** policies, against multiple Constant Contact policies, but was also spam.
