I returned a vehicle and received the check for the down payment because I was mistreated during a stressful sale and over payment of a vehicle. Ewing ******** left the vehice registered in my name and I received a toll bill after the vehicle was returned. I have contacted them too many times and they will not pay the bill. I have received the third notice and a late fee has been added. I am very afraid they will come after me if the bill is not paid soon.Initial Complaint

At the end of August I took my ******** into the body shop to get a small dent in the bumper fixed from being rear ended. It was supposed to take a couple of days. Come to 4 weeks later on 9/19/2023 the advisor called and said it was done and to come pick it up. Absolutely said nothing else. When I get there they refuse to give me the car saying there is money due that I have received. I have never received any money and they refuse to give me the car or help with insurance. I contact the insurance and they pay the remaining balance. Im one again called by *************************** to come pick up the car. Today I went in to pick it up and the refused to give it to me again saying there was a balance. After screaming and threatening to call the police they finally gave me my car I have asked for the owners information and they refuse to give it to me. I want to complain about bad business practices. Something that was supposed to cost $1000 cost $5000Initial Complaint

On February 19, 2022 I got contacted by a salesmen at Ewing Subaru of Plano via an inquiry I did about a 2015 F-150 they had for sale. He worked through the details and I went and signed for the truck. I was told the vehicle came with a 2 year warranty without knowing the warranty added to the cost in the amount of over $8000. When I left the lot I noticed the truck had squeaky brakes. I told the salesman about that. I was told it came with two key fobs. Both of which were broken and it would cost me $200 to get a new one. I ended up purchasing one myself and did not go through them for the key fob. They decided to change the brakes and it still squeaked. I noticed a noise coming from the truck and I told the salesman about that. I sent him a video and he said he didn't hear it so that was the end of that. Recently as of the beginning of this week 03/28/2022 I noticed a very bad loud sound coming from the truck and it was idling terribly. I told him about that and nothing has been done. The lender told me to ask to void the contract or do what I could to get out from under the vehicle. The dealer told me I could not get out of the contract and that I could possibly get another vehicle off the lot they had to "replace" it. The truck I thought I was purchasing is what I wanted. Not just whatever I could get off their lot. I put $4000 down for the truck and I'd honestly just want to settle with my money back and be done with the dealership. I feel like they knew the vehicle had all the problems but masked them however they could. They also added that warranty without my knowledge that it cost money let alone $8000 because they knew I'd be spending money to fix all the issues of the truck. Tonight- 03/30/2022 I was driving home from work and the truck broke down on the side of the road. That it the last straw for me. It's not safe for me nor my family. They have ruined me to the point where I don't know how I'll recover from this.Business response

Business Response /* (1000, 5, 2022/04/12) */ As stated, Mr. **** purchased a 2015 Ford F-150 from us on 2/19/2022. When going through the business office, Mr. **** elected to purchase an extended service contract for $3,000 and Gap insurance for $500. I'm not sure where the figure of $8,000 came from, but I am sure that nothing was ever "included" in the purchase. All of the initial paperwork was on the vehicle only and his final paperwork included the additional coverage he selected. Additional coverages that are available on a selected vehicle are presented to all customers for them to make a final decision. Although we never intend for vehicles to have issues, we can not predict when issues will arise. This particular vehicle had over 102k miles a the time of purchase and passed all of the necessary inspections prior to being listed for sale. Unfortunately higher mileage vehicles do come with more risk. Regardless, we have attempted to help Mr. **** any time he had a concern. He had an issue with his brakes, which passed state inspection to sell, but we went ahead and replaced them to try and help. The last issue notated with the engine noise and idling issue was also addressed and offered to help. However refunding his money and unwinding the transaction at this point is not possible. We did offer to trade him out of the vehicle, and honor the same trade in value he paid for the vehicle, but he would have to purchase another vehicle in order to do that. The second option is to try and repair the vehicle with the extended service contract he purchased. Either way, we have tried to work with Mr. ****, but unwinding the transaction and refunding his money is not an option. If he would like to pursue either of the options listed above, he can reach out to Jose Chapa, who he has already been in contact with, to help facilitate the next steps. I do not accept their offer because their offer is not what they had stated to me. I was also told that I would be refunded a partial amount of my down payment after they used the other part of it to pay for tax tittle and registration. I was told by Jose chapa that they would refund me what's left of my down payment and we would cancel the deal. I have already spoke to the lender and they are aware and on board with everything. It appears to me that the dealership isn't including every option they had given me. I have been trying to reach out to them to come and retrieve the truck like they had previously stated they were going to. I have not received a call back or a response of any kind. I want to them to come get the truck, cancel the deal, and I get half of my down payment back so I can be done with the dealership. That's what they had told me could be done and I'd like them to honor that. Business Response /* (4000, 9, 2022/04/15) */ As stated in the prior correspondence, the only two options that involve Ewing Subaru are to trade the vehicle in for something else, or for us to help facilitate a repair under the vehicle service contract. Unwinding the transaction is not an option at this point. Taxes have been paid and the vehicle has been registered, along with the deal being funded through his lender since the beginning of March. If Mr. **** would like to pursue either options, please have him reach out to us, if not, may we please close this matter?
