      On June 11, 2024, this company contacted me saying that My account had been identified for legal review as an insinuation that they were going to do legal action regarding an outstanding debt. Which is against FDCPA guidelines to threaten legal action against a debtor The employee also partially stated the mini ******** which negates anything said after that, this is my second time speaking with the company the first time I advised them to cease, and this is communication to my phone number which has been violated. The company cannot insinuate, intimidate or threaten legal action without being an attorney I advised the representative that I would like for the company to send my information for legal review or legal action since they intend to do so and I would work directly with an attorney. I have spoken with the First party who is legally owed too. The company is also based out of ***** but spoofing phone numbers from different parts of ************** because Ive had several numbers from the same company call and theyre not using the same phone number but when you dial the number back, its not a direct number to an individual Which spoofing is illegal and against the *** act, the company is only allowed to contact me by mail. I will also be reporting this to the state ************************ as well as the ***

      In review of your complaint, RGS contacted you regarding the debt that was placed in collections by ************* Financial. Due to the status of the account per ************* Financial, RGS was instructed to read a specific script to all consumers concerning the next steps in their process if payment has not been made. RGS did not threaten legal action against you, RGS is servicing the account on behalf of ************* Financial. The script that was read to you was written by ************* Financial.

      In your complaint you stated that RGS is spoofing phone numbers. RGS owns every phone number that is used when contacting any consumer. The phone numbers are owned by RGS not the employees, therefore the number routes back to the company as a whole and not a specific representative.


       If you have any questions regarding the scripting that was read or written please contact the original creditor.

      I am rejecting this response because:  the customer clearly stated that it was identified for legal review. If you your record all of your calls, then you would have heard what he said. I specifically stated to send it to the attorney or the legal representation that has identified it for legal review. I also spoke with the original creditor immediately after the phone call and they advised that is not their practice and I have right to only deal with them Per FDCPA it is illegal to insinuate, perpetuate or threaten legal action and for your representative to say that I am animated is also offensive and against FDCPA guidelines. I recommend you listen to that call again and listen to and its violation. I am Financial Crimes Investigator and I have the ability to determine when it is spoofed or an actual number that is assigned to the company. So again since it was identified for legal review which is an insinuation of legal action please send it to the Attorney or legal representation that is working on behalf of RGS.

      I was contacted by a person claiming to be a debt collector that asked repeatedly for personal information, name, address, phone number, SS#. My response was to ask what the debt was supposedly for and they refused to answer threatening me and demanding personal information. I had calmy explained that it was reasonable to ask what they were trying to collect for as I couldn't know if they were legitimate until they did. They refused and threatened more.Based on that, no doubt this is a fraudulent ID theft ring. They have an address in ********** which is likely fake but you should pursue them any way as they were aggressive . They didn't get me to to do anything but I worry for foreign born people and older people being taken in by it.the website is likely fake too, but it is myrgs.com and the number that I was called from was ************.the address listed is RGS Financial *********************************************************

They claim to be collecting on behalf of Castle Dental - ************ ***** in the original amount of $391.20 but offering to accept $273.84..I have not used Castle Dental in over 15 years and did not leave a debt when I did leave. I see RGS has performed a credit inquiry on my credit report.

      I have started to pay into my accounts for charge-offs, as agreed by the *** agents over the phone. These payments have gone down, but on my account online with them, nothing is showing. Where is my money going to? It is going off my account. My side of the agreed-upon arrangement is being fulfilled. I have sent several "support tickets" to ***, no response at all. I am NOT GOING TO KEEP PAYING until this is resolved. I am not paying into some imaginary fund for someone at ***. People who are in financial distress should not be preyed upon like this. My calls with the agent was recorded so my evidence is here. And to not even get a response from them at all? That is simply a we don't care about you at all, just keep paying attitude. And they wonder why people dont want to deal with them at all and they have a ton of complaints on here. I am instructing my bank to stop these payments until *** can get their act together and explain to me where my money is going to. **** is in their court now.

In review of your account, we would like to provide you with the following facts regarding the statements made in the complaint. We have two Wings Financial ************ accounts in our office. I will provide you with the breakdown of facts per account.

      Loan Account ********** the account was opened on August 27, 2020. The account was assigned to collections on March 20, 2023, with a balance of $4,136.66. Our office made several attempts to contact you via phone and text messages from March 2023 until we received a call from you on January 4, 2024. You advised that would like to set up a payment plan of $150 per month on 28th of the month beginning in January 2024. Later that day, you contacted our office again and advised you made a mistake and wanted to change the payment amount. You agreed to pay $150 on January 28th and then $300 per month going forward.

      On January 28, the payment that was scheduled came back declined because the account provided gave a return code: 454 Closed Account. Our office received another phone call from you on January 29, 2024, in which you advised you would like to set up a payment of $150 and call in moving forward to make payments.

      On March 8, 2024, our office received another call in which you agreed to set up another payment plan for $150 per month beginning on 3/9/24 and for the 5th of the month moving forward beginning in April.

      Credit Card Account **************** the card was opened on August 1, 2018. The account was assigned to collections on March 20, 2023, with a balance of $4,992.85. Same as the other account, we spoke with you to discuss payment arrangement on January 4, 2024. You initially set up the same arrangement as the other account with the January 28th payment declining as well for the same reason. You currently have a payment plan of $150 per month set up.

      In your complaint you indicate that you sent several support tickets. RGS does not have a ticketing system, so we are unaware of what tickets you are referring to. We check to see if our office received an email from you regarding your account and we do not have record as well. If you can provide us with evidence of these communications, we will be glad to research and provide a response.

      Please be advised that your account is assigned to a collection agency and not being handled by the original creditor. Our website is designed for consumers to set up and negotiate payment arrangements. We are not obliged to keep a transaction history online. If would like to request a payment history of your account from time to time, you are more than welcome to email us at ******************************

      We would like to make you aware that per the agreement you signed with Wings Financial, you have two interest bearing accounts. On the account ending in 8984, you are being charged *****% interest. On the account ending in 5058, you are being charged *****% interest.  Making small payments of $150 per month will have little effect in the decrease of the balance.

      We have attached to this response a current transactional history of the payments received as of today, March 21, 2024, on both accounts.

      Our client, ************ ***** placed an account in our office on February 06, 2020, for $1,406.80 for an outstanding balance due for dental work performed at BrightNow! Dental located at *******************************************************************.
      The balance was not taken care of when it was with the dental office and/or your insurance company did not cover the cost of the services rendered. The balance was charged off and sent to RGS Financial for collections.
      In review of the call recordings associated with your account, you acknowledge that you were aware of the debt and RGS Financial was handling the account. Our office also mailed you copies of the billing statements relating to the charges from the dental office.
      On December 27, 2022, our office spoke with you at the phone number ************ (this number matches the phone number you provided in the BBB complaint). You advised that you were going to check your records regarding the balance and call back. We never receive a return phone call.
      On March 16, 2023, our office spoke with you again and you advised that you would talk to ************ regarding the balance and call back. Again, we did not receive any callback. That was the last time our office spoke with you regarding the balance.

      In your complaint, you indicated that you requested the original contract. Please keep in mind that you did not sign a contract with a dental office for services. Everything is handled through your insurance.

I asked Bright Smile several time to investigate the matter but all was done was to send to a third part collection agency. I do not own the collection agency nor their client bright smile LLC. Both calls took place on 11/21/2023. There were no other requests for validation of debt documentation received from you.
      RGS Financial, LLC. is not a debt buying collection agency. The account was assigned to our office on May 31, 2023, with an outstanding balance of $466.00. The account was opened on September 19, 2022. 
      In review of the call recordings, you indicated that it was against the law for your account to be sent to a collection agency. Are you able to provide the exact law and/or verbiage where it states this? You also indicate on the calls that this account was opened fraudulently. Do you have any evidence like a police report or FTC affidavit showing you are a victim of fraud? 
      We have closed the account in our office and referred it back to the original creditor for further assistance. Please be advised that RGS did not report this account to any of the three credit reporting agencies.

      According to 15USC1681 here is the exact law that is being broken! (a)Accuracy and fairness of credit reporting The Congress makes the following findings:
      (1)
      The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system.
      (2)
      An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers.
      (3)
      Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers.
      (4)
      There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy.
      (b)Reasonable procedures

      I am rejecting this response because:   Pursuant to the two previous request of which law has been broken, I sufficiently submitted two precise laws that you broke.  Ascertaining 3rd party personal information and the calling my personal cell phone to collect with the wrong party is AGAINST THE LAW!  You are to now refund my for my time and submit to me a fine of $1,000.00.  This is what was exactly explained to your representative over the phone when you illegally attempted to  ascertain more information.  Due to the laws put in place, your activity was illegal and I demand retribution.  If you do not send my the requested $1,000.00, remove my "so Called" trade line from my credit report, I will seek further legal action way above the previously requested actions.  

      You have 30 days to remove yourself from my credit report and pay out a $1,000.00 dollar fine or further action will transpire.

      You may request my actual information through designated phone call, where my legal advice will also attend, and advise me on further actions.

      After further review and communication with the credit reporting agencies, it appears that this was a timing issue. RGS Financial reports to the credit bureau once a month. We completed our September credit reporting on September 1st, and I closed all accounts in our office on September 6th (date reflected on the letter). Since the requests to have the accounts removed from the credit reporting file after our monthly submission deadline, it was not included. I have spoken with our Credit Reporting team that the deletion request will be included in the October credit reporting file that will be submitted to all three credit reporting agencies on October 2nd. I will personally monitor to ensure that the deletion request will be included. 

      We apologize for any inconvenience as this was a timing issue. We can ensure that the tradeline deletion will corrected at the beginning of October.

      I recently received a collection letter from RGS Financial which I had no clue about. I tried to contact them several times but nobody answers the phone. It is so annoying to receive the collection bill for something that I don't event owe and had nobody to communicate.

      I received a credit alert stating there was a derogatory mark placed on my report from RGS Financial. This is very alarming as I have NEVER received any notices, statements, or any communication from the company regarding any type of past due balance. As a debt collection collection agency, the company must provide written notice to the consumer regarding the debt as an attempt to connect payment PRIOR to placing the collection account on the credit report. THIS WAS NOT DONE and I am demanding it be removed from my account IMMEDIATELY! If this account is indeed legitimate, I wish to speak with the original creditor for resolution. As of today, 12/17/2022, RGS has never communicated with me so I am unaware of who they are and the agency they're representing.
