      Owner/Partner ****************** of Sky Interests said that he would take care of damage caused to the tires of my Tesla due to his poorly maintained property. I had complained about nails, razorblades, screws and other hazards being in the parking lot for months, constantly giving my Tesla flat tires. Was asked by ******* to provide an invoice for the tires so that he could take care of it. Once I provided the tires, ******* had his property manager respond with "I understand that you believe all of the damage was sustained at the property, but there is unfortunately no definitive way to confirm that. After listening to you and your concerns, we opted to release you from the lease early and return your security deposit in lieu of the challenges you had with the property."I was released from the lease due to the health and safety concerns with the building, it was not an agreement to settle on the damage to the tires on my Tesla. The floors were falling apart in the building, there were cockroaches constantly present, leaks in the ceiling, gas leaks, water leaks at the front door, trash constantly scattered across the parking lot, music being blasted, dogs inside units barking, homeless encampments, and the list goes on. I never signed any kind of agreement, they decided to make up their own terms of the agreement after I vacated the property.This property management company acts as slum-lords where they put no money into maintaining the property, do not uphold their contract, but charge full price and try to pin the blame on the renter.I want them to reimburse me for the damage caused to my tires.

      Over the past 10 years, Sky Interests, has entered into tenant/landlord agreements with more than ***** tenants, which has resulted in less than 3 filed complaints. Our tenant referral program and tenancy lengths reflect relationships contrary to ********************. 


      Although we have spoken to **************** several times regarding his concerns, in response to ******************** specific complaints against ****************** and Sky Interests Commercial Management:



      Statement from ****************: Owner/Partner ****************** of Sky Interests said that he would take care of damage caused to the tires of my Tesla due to his poorly maintained property. I had complained about nails, razorblades, screws and other hazards being in the parking lot for months, constantly giving my Tesla flat tires. Was asked by ******* to provide an invoice for the tires so that he could take care of it.

      Response from Sky Interests: After reviewing the recording of the only phone conversation between ****************** And **************** on January 17, 2024 at 1:47pm (this can be provided for review). **************** made a claim that the parking lot caused three flats within one week. ****************** asked for the receipts to gather all of the factual information for reconciliation. Those receipts were not submitted.  **************** vacated on January 31, 2024. On February 5th (same day tires were replaced), **************** sent over a receipt which showed that he replaced all four tires.
                 


      Statement from ***********: Once I provided the tires, ******* had his property manager respond with "I understand that you believe all of the damage was sustained at the property, but there is unfortunately no definitive way to confirm that.

      Response from Sky Interests: The conversation on January 17th regarding receipts for previous tire damage is contradictory to submitting a receipt for new tires on February 5th.



      Statement from ****************: After listening to you and your concerns, we opted to release you from the lease early and return your security deposit in lieu of the challenges you had with the property." I was released from the lease due to the health and safety concerns with the building, it was not an agreement to settle on the damage to the tires on my Tesla. 

      Response from Sky Interests: **************** is required to obtain a certificate of occupancy from the City of ******* that more than adequately addresses "health and safety concerns". 
      In addition, as stated in ****************** complaint, ******** agreed to let **************** leave the lease early. While this is not how we typically handle early lease terminations, Landlord agreed to refund the deposit, which exceeded the cost of the tires. Although, the tires were not the reason for the refund.



      Statement from ****************: The floors were falling apart in the building, there were cockroaches constantly present, leaks in the ceiling, gas leaks, water leaks at the front door, trash constantly scattered across the parking lot, music being blasted, dogs inside units barking, homeless encampments, and the list goes on. 

      Response from Sky Interests: **************** occupied this space for less than one year. ******** has record of work orders and communications between tenant and landlord. This includes timely actions taken by Sky Interests to fulfill the landlords responsibility to the tenant. This can be available.



      Statement from ***********: I never signed any kind of agreement, they decided to make up their own terms of the agreement after I vacated the property. 

      Response from Sky Interests: We don't understand this. It appeared to us that **************** wanted to vacate the lease space and terminate his lease shortly after he occupied the premises. Sky Interests has accommodated him in that respect. 



      Statement from ***********: This property management company acts as slum-lords where they put no money into maintaining the property, do not uphold their contract, but charge full price and try to pin the blame on the renter. I want them to reimburse me for the damage caused to my tires.

      Response from Sky Interests: This is an unfortunate position for both Sky Interests and ****************. We strive to create long-term tenant relationships and offer at or below market rates on our properties.

      I am rejecting this response because: 

      First of all, Sky ******** never had my permission to record our phone conversation, and since my fiance was present, that is illegal. Texas has a "reasonable expectation of privacy." law and Sky Interests did not have our permission to record our conversation.

      Secondly, a receipt was provided for some of the tire plugs and as well as photos of the nails in my tires, **** chose to never download the files. Screenshots of my phones geo-location data that shows nails and razor blades in the parking lot were also provided which can be confirmed via their security cameras and my security cameras at the time.

      I have had ZERO flats in 6 years from nails, until I moved to their property where I had 3 in a week. After looking around their parking lot, it was very apparent the source of all the issues, and dozens of photos and videos have been provided to them regarding the nails, screws and razor blades.

      Once I no longer was visiting the property, I opted to have my tires fixed, and I was told by Discount Tire that the two tires were too badly damaged to be professionally repaired, and that I had to replace all 4 tires, otherwise I would damage the drive systems on the Tesla Model Y that I own.

      They need to pay for the damage they caused to my tires, as simply refunding my deposit only covered the expenses my company had to endure to leave their constantly trashed property.

      I am rejecting this response because:   

      Sky Interests has not refunded the damaged caused to my tires. The tires, they stated, that we could not prove that the damage happened on their trashy lot, despite dozens of photos, videos and calls that all said the opposite.

      The city of ******* reached out a week after I vacated the property as let me know that it had never passed inspection, despite the fact that I had the inspections done 8 months prior and was told they were good. 

      Sky Interests has acted like slum lords, and I confirmed with several other tenants on site, who had similar issues of Sky ******** not repairing their units despite contacting them multiple times. Sky Interests conveniently make statements in their favor to avoid any responsibility and ignore all evidence submitted to them.The tires were replaced after I vacated the property, so I didn't ruin any new tires that had to be purchased. I even opted for cheaper tires that saved Sky Interests $400.

      I have attached several more images showing the nails, razorblades and other hazards that were constantly present in the parking lot, along with the phones data that shows the dates, times, and location from my GPS.

      I would like a copy of the phone call with **** sent to my email as well as a copy of the email where ****** states "She does not deny that there are nails in the parking lot" back in September when I had 3 flats from the parking lot.

      Sky ******** needs to refund the cost of my tires, since they avoided all other costs of actually maintaining the parking lot, which would've prevented the damage in the first place.
