The clients requested a bid directly vs the home builder because up to this point they had exhausted the time line with change orders and indecision with the previous designer and homebuilder that the home builder informed them they would have to find their own cabinet maker as there was no time left to use his. During the bid the client took off 8 linear feet of the kitchen from the builder plans in order to hit his budget and be able to add a game room bar without telling his wife.He was still over budget so we gave him a $7440 builder discount as if he was a builder. They signed contracts with payment terms of 50% deposit ( their home builder paid) and 50% on day 1 of installation. They were informed of the process of installation. It took them 2.5 months to agree on the designs and they were both were presented with 3D renders and 2d elevations of the project and signed off. We were scheduled to began installation exactly 5 weeks and 4 days from design sign off. The day before installation the client told me he did not have the money. He asked if he could give me a check for the 11k of the 30k owed and put the rest on a payment arrangement of 30 days no interest.. I explained that was not what we agreed and he would need to pay according to the terms especially since he was given a large discount that was contingent on him paying by terms. He agreed but said he needed several days to liquidate assets. He contacted me 3 days later and said he had a check but was short $2700 that the builder would be giving me the following day. We agreed to install. The second day of installation we were stopped by the wife and she wanted to know where the rest of her kitchen was. We referred her to the design sign offs and explained her husband had removed it to add a bar and hit budget. She was furious. She accused us of deception. We stopped installation to address the issue. Ultimately it was proven we did nothing other than what they had asked. I agreed to add in the 8ft at cost to the kitchen which required us to rebuild 22 Lft because we used continuous face frames. I also reminded them we did not receive the balance as agreed and there account was in jeopardy of losing discounts. His comment was they havent paid you yet. Over the next 60 days we were stopped during installation 7 times for the home not being ready for cabinets. Ultimately we had a meeting with the builder and they informed me the home would still not be technically ready for cabinets for another 2-3 weeks. We started receiving threats and demands from the clients as they had exhausted their loan timeline and had been notified of it. We worked closely with the builder going forward with an established schedule. Just after Christmas we were contacted by law enforcement saying that the client had filed a theft report for abandonment. We showed the regular communication with the builder, the installation schedule we had made with the builder and proof the builder had shared it with the client. The case was closed and listed as an information report. We have made numerous attempts to reschedule installation and to address any repair issues. The client will not respond and the builder has released the project. There were many other concessions we afforded these clients, too many to list.
We created a claim for the client with our insurance but they would not cooperate leaving us with no other option
