Like others have mentioned, our bank account has a hold on it, including our college sons bank account. Why? We dont know b/c theres no one answering the phone that can give us answers. No communication with anyone from this establishment in regards to a bad debt owed. Its my understanding that in *****, a debt collecting attorney cant unilaterally freeze our bank account w/o following due legal process. Is it no longer necessary for the following steps to take place before putting a hold on a hard working familys bank account without any knowledge of what its exactly for? 1. Filing a Lawsuit: The creditor or their attorney must first file a lawsuit against you in court to recover the debt. We havent seen this. 2. ******* of ******** We must be formally served with the lawsuitlike receiving a copy of the complaint & a summons to appear in courtusually done by a process server or a law enforcement officer. This didnt occur. 3.Court Hearing: We have the right to respond to a ***************** our case in court. If we do not respond or appear in court, the creditors may obtain a default judgment against us. We have no knowledge of this happening because the previous two never happened. 4.Judgment: If the court rules in favor of the creditor, they will obtain a judgment against us. Of course, this never happened. 5. Post-Judgment Remedies: Only after obtaining a judgment can the creditor take steps to collect the debt. A court approval is required. What court approval? We never received anything! 6.Notification: We should receive notification of the judgment and any post-judgment collection actions, such as bank account freezes. We received nothing!This debt collecting attorney has frozen my ************ including our sons (who is a college student that only works part time) bank account w/o us being aware of a lawsuit. Failure in performing this legal process sounds like a grounds to contest this lawyers actions w/ the involvement of our attorney.
