      I contacted We Buy All Houses San Antonio late September. We met with ****, then with *****************. Initially, we signed a contract on October 5, 2023 for a quick sale of my home for $133,000. Apparently, there were potential "investors." Everything was "delayed" so we had to extend the contract to close on October 16, 2023. In the meantime, We Buy All Houses were posting pictures of my home on ******** and *********** They had no investor yet. My daughter would contact *** and she was promising a quick sale. They requested another extension for closing and we extended a second time. But then they asked for a third extension and that's when I said no more. I did NOT sign the extension and *** claimed somewhere in the contract she had a "right" to charge a fee. So, my daughter asked what was the fee and said it was a $10,000. Even though our contract ended on November 9, 2023, she still claimed to have "equitable rights" on my house. On November 17, 2023 (8 days after our contract was no longer active) she placed a lien on my house. I contacted a real estate agent and sold the property and had to pay $6000 to ***************** as a fee. I felt cornered to pay the fee because she would not release the lien. She had no right to place a lien on a home when we no longer were under contract. I would like my $6000 refunded.

      My name is ***************** with We Buy ALL Houses San Antonio.  My husband ******************* met with the sellers at 9542 ******** in San Antonio, TX and picked up the signed contract on October 3,2023.  I haven't met with the sellers to this day.  ************************** daughter **** was the first person I spoke to concerning the property. I have not even spoken to ********************** yet.  We asked if we could leave a lockbox at the property and asked if the seller could leave the house keys in the lockbox so we could complete our inspections.  While going this process of lining up the funds and inspections our contractors noticed there was a problem with the foundation.  This was going to cost more than we expected.  Then ****** brother ****** contacted both my son ******* and I and asked us not to contact **** anymore because he was taking over to help his Mom get the property sold.  We explained how the price needed to come down some because of these extra repairs.  He told me that he would talk it over with the family and get back to me.  ****** contacted me the next day and approved the price adjustment and asked me to send him the amendment.  During this whole process we would line up inspections, go to the property, and the house keys were gone.  We would contact ****** about bringing them back so we could finish inspections but this took many many days so we were not able to stay on schedule.  I followed up with ******** at the title company for an update on clearing title, but title was never clear.  While all this was going on we found out that the seller was talking to a realtor about listing the property.  I tried calling **** and ****** about the property so we could finish with our inspections but was blocked.  Because we have equitable interest in a property when a contract is signed, I followed up with our attorney.  He advised me to put a memorandum on the property to secure our equitable interest since the title was never clear so I did. I contacted the title company once again on 11-7-23 but title was not clear.  **** reached out to me and asked what our fee was on the property.  I told her that the company lost 10k because of what happened.  **** asked me if I could give her a discount off the fee.  We agreed on 6k so she received a discount of 4k.  After receiving this dispute I researched the history to 9542 ******** and noticed that after ********************** listed the property with the realtor on 12-21-23 that she removed the listing again on 1-26-24 and ended up selling the property to another cash home buying company called ******************************** LLC on 12-15-23.  We sincerely apologize how everything worked out on this deal but feel like we have been very fair considering the time it took us to get to this point.  Thank you, *****************

      Date of transaction 12/08/2021 signed a contract to sell my mother's house. However, photos of **************** were taken and posted on ********* zillow and trivia. The contract does not state that they can post pictures to sell the house before closing or even put signs up on the property. I was never asked if they could put signs up or post the photos. *** did call and ask that they would need to amend the contract so that they could have a little more time to close. The original close date was 01/22/2022 and now the date has moved to 02/15/2022. As to why a company that claims they pay for cash on homes would need so much time to close I am not sure. I contacted the title company and their response was that it was due to the holidays. Before contacting these people to sell my home I informed them that I had done a title search and an affidavit of heirship so that it would speed up the process. They have removed the inside photos on zillow and trivia but they left the inside photos on ******** and some of those photos have pictures of the family including my deceased mother. I am emotionally and physically exhausted with all that has happened. We talked to *** on Saturday and he assured us that the photos would be removed from ******** but still have yet to see that. I want photos removed. It is unethical as to how *** has handled herself. She represented herself as a realtor and said that they buy houses and sell houses. I had no idea she was also an investor and only after being contacted by family members and other buyers did I not find out she had our house and for sale signs posted on the internet.

      My name is *****************************.  My husband **** and I run and operate We Buy ALL Houses San Antonio.  *********************** contacted me in December 2021.  She told me she needed to sell her Mother's house fast!  I had one of our business partners take a look at it because we were out of town at the time.  ***************** continued to contact me several times explaining her urgency to sell.  During the next several weeks Mr. and ***************** had other home buying companies take a look also to get the highest offer.  I contacted *********************** and asked her how things were going.  She told me they were showing other buyers the property but getting really low offers.  My husband and I went to ************** the following weekend so I contacted ***** and asked her if we could see the house.  She was very nice and friendly and said yes.  We went to take a look at the property and we also got to meet and speak with her husband who was also very nice.  He had also told us that other buyers had seen the property but were coming in with low offers.  We asked him what price he was looking for and he told us that they would sell the property to us for 55k. They also informed us that there were other heirs and they all were in agreement to sell the house to us.  I then proceeded to email a purchase contract to *****, she signed it and I opened Escrow to start working towards clearing title. 

      When I first spoke with *****, I explained to her that I was a realtor but not working as one in this transaction.  Since she contacted our home buying company that buys houses fast!  She understood.  I also asked ***** when I was at the house in the kitchen if it was okay to take pictures of the property and she said yes.  She never expressed a concern about me taking pics of any kind at the time or else I would have never taken any.  But it is really important to understand that if we don't have pictures of the property there is really no way to get any interest in it either.  It is also very important to understand that whether you have a realtor list your house on the *** or contact a cash home buyer they are both going to need pictures of the property.  The only way to buy or sell a property is going to include pictures.  Our job is that of a marketer.  That's all we do.  Whether we choose to buy, sell, rent, owner finance is really based on what we as a home buying company decide is best of our company at the time.  There is a lot that goes into moving a house fast!  My job was to get this deal done.  That's all.  I didn't mean for ***** or her family to get upset.

      Mr. and ***************** expressed their concern to me this last weekend and I completely understood.  I had the pics that were on the Internet completely removed.  As of yesterday I removed the last two.  I have apologized to Mr. and ***************** and have expressed it many times.  My prayer is to get passed this and be able to get this property sold for them as soon as possible.  ********** *** and ******************* @We Buy ALL Houses San Antonio

      I am rejecting this response because: The statement made by *************** is incorrect. We agreed to sell the house to the ***** because they offered 55k to us and said they had the cash to pay for it. From the beginning she represented herself as a realtor and assured us that they had cash to buy and as soon as the title company received all paperwork they  would close and we would get our cash. Never did she mention we are going to put the house on the market and once we sell the house will we then give the family the 55k. Also she asked if she could take pictures for herself  to keep a file. She never said she would be posting them on the internet or ******** and had she said so I never would have allowed her to post. There was no need for pictures to be posted since Mr. and *************** were buying the property for cash from us. If you notice on the attached photos she is selling our property as her property representing herself as the owner. All the while we are still waiting for her to close. We contacted the title company last week and they could not give us a clear explanation as to why they took so long to do a title search. I had already explained to Mr. and *************** that we had a title search and affidavit completed at our expense so there would be no need to slow down the process. They were fully aware of this. If you notice on *************** statement she says she is marketing the house for us and our contract does not state she would be acting as an agent but rather a Buyer. No where in the contract I signed gives *************** permission to post pictures of the house, inside or out in order to induce a sale.   ***** right of Publicity in the Property Code applies, "a property right in the use of the individual's name, voice, signature, photograph, or likeness after the death of the individual." "the right to publicity prevents the unauthorized commercial use of an individual's name likeness, or other recognizable aspects of one's persona." Pictures of my deceased mother, myself and my brother were included in the internet postings as well as my mother's room. We trusted them to complete a simple sale of the house with no issues in a short period of time as I was promised. Please take notice of her last statement about marketing the house for us. Due to the photos of my deceased mother, her bedroom, me and my brother all the siblings took offense and felt they acted in an unethical manner in their actions. Therefore they no longer want to deal with the business.

      To whom it may concern:  My name is *****************************.  I sent ***** Maddour a text on January 17th and asked if we both could work on coming up with an agreement to get this deal closed.  I also told her and her husband that we had two of our partners that needed to see the house and if we could see the property so that we could get everything done that was needed and close fast like her and her husband wanted.  I also offered to cancel the contract incase we couldn't close fast for her.  We don't want that.  We want to buy the house.  But just incase they do.  We haven't heard anything about them requesting anything else.  I also sent ***** Maddour a text confirming that all pics of her property had been removed from the Internet.  I also asked her if there was anything else I could help her with and she texted back No Ma'am.

       

      At this point we are still under a legal and binding contract.  We still plan on buying this property and need access to the property so that we can get this deal done!  I will continue to reach out to ***** to see when we can see the property again.  As soon as we can get access it won't take long after that for us to line up the money for funding.  We will work as fast as we can.  Please let us know if there is anything else we can do to help you.  ********** Liz ***************

      I am rejecting this response because: My family and I want to accept the offer to cancel the contract immediately in writing. We no longer wish to sell to the company. We accepted their offer back on December 9th and they have had plenty of time to close. We never made any agreement to have them sell the house for us. Again our understanding from the beginning of contacting the business was that we were selling to *** and her husband. It was never implied that they would sell the house for us or they would put the house on the market to sell. They had plenty of time to sell the house if that is what they intended on doing. They also had plenty of time to pay the escrow money and the contract should have included all the heirs name's.  All should have been done in a timely manner which was not done and therefore would appreciate that Team ***** cancel contract in writing as soon as possible by registered mail or contact our attorney. Once they do this we will drop all complaints against them.

      To whom it may concern in closing.  I have apologized for posting photos of the property as **************** stated after I, ************************* had apologized to **************** via telephone that it was ok to post the pics without the photos of the bedroom.  I, ***************** at that point decided to remove all photos and marketing.  We offered what the seller was asking for which was higher than all other offers.  I know it was going to be tough without marketing and again I do express my sincere apologies for not considering the photos that were on the bedroom wall.  We are going to full fill our obligation as stated in the contract.  As a home buying company we have the right to Arbitrage.  Which includes equitable title and equitable interest in the property. Please see Special Provisions in Chapter 11.  States we have the right to purchase the property under any entity we choose.  A buyer is in place even not being allowed to reenter the property.  The buyer at this time is not requiring an appraisal or survey, which requires entry to the property.  Although he had declined an appraisal or survey at this time.  If he so chooses to proceed with an appraisal or survey, seller will need to grant ****** to the property.  

      Team *****, LLC and/or assigns is stated in the contract under Section 1.  *********** Arbitrage - To buy one property and sell that property for a profit.  Three types are, wholesaling real estate, flipping houses, and master leasing.  Equitable Title - When a buyer of real property executes a purchase and sale agreement with a seller, the buyer acquires equitable title to the property.  This means the right to eventually obtain full legal ownership of the property, as long as they pay the purchase price.  Equitable Interest - In real estate a buyer receives equitable interest upon signing a purchase contract and paying an ******* money deposit.  And or Assigns - An assignment of purchase agreement and sale is when a buyer like us, Team *****, LLC and/or assigns sells a third party the right to assume the purchase contract.  

      In this situation the buyer is the assignor, and the third party is the assignee.  I do apologize for the heart ships expressed by *****************.  I wish the bedroom pics were never associated with the pics online as marketing.  I do understand that ***************** has had to answer to her siblings for the pics online.  I know that a face to face apology is more sincere than a letter and am willing to do so personally.  Seller and Buyer agreed to a sale price and we are going to full fill our obligation as a buyer that is stated in the contract.  When offering more than the competition on a sale price because it's what the seller needs.  Sometimes that particular property requires marketing.  Thank you, Team *****, LLC

      I am rejecting this response because: The issues and complaints are in this regard: photos w/family members including deceased mother were posted on internet, which *** failed to acknowledge and yes since have been removed however, damage has been done. Posting photos without permission on the internet accessible to the public and she exposed all 8 family members to unsolicited calls which caused unnecessary disruption to the family. *** falsely represented herself and her company. She claimed she had cash to pay the family. She failed to disclose that she is a real-estate agent on the contract she submitted. She also failed to inform us she would be representing herself as an investor and only when the house sold would we receive our money. Never did she make a closing offer after repeated request were made for her to close. She continues to handle herself in an unethical manner as she continues to harass the family while claiming to protect her equitable interests. Even at this very moment, we are receiving calls that *** is telling investors or partners that she has a lien on the home while no offer for mediation was ever made. It is evident that she has handled herself in an unethical manner with her way of conducting business. I have contacted the **** and I am in the process of filing the complaint as well as taking LEGAL actions in this matter.
