      October 2021 my husband and I signed a contract with ****** on a paper that read, "*********** Kitchen and bath". Now he says my contract is with Texas Green Remodeling, and that a *************** he dealt with, apparently *********** Kitchen and bath went bankrupt after we paid them for our tile. Demolition was done and plumbing, including pipes, but not completed. November 2023, ****** referred to the photo of the drain they did, and after much argument and texting, I realized he was right that my guy removed a blue part above the subfloor while I was out of town. My guy put boards beneath the subfloor, which I had removed, exposing the same hole/space ******'s plumber left. October 2023, he said he was happy to come over and look and fix the problem. But he didn't. Then he told me the tile company went out of business and I couldn't have tile I chose, but had to go over to a different vendor to pick again. I asked for an electronic version because I can't drive that far now. He didn't send it. Then he sent nasty text messages to me, to which I responded in kind--he was a thief. I called him, he raised his *********** first, and I responded. He blamed me saying I am all over the place, hard to deal with, and I'm not your child or your husband. My husband is working out of state, I had said when he asked my husband to get me over there. I don't have children, so his comment is doubly inappropriate. ********************** didn't approve his plumber's PVC piping, which was not up to code. I had to have a plumber correct it with the copper because PVC didn't adhere well to copper. I didn't ask him to pay for it. Initially, the guy I had fixed the drywall his company ripped off, and painted it, no charge to him. I asked for reimbursement of pre-paid work he hasn't done since he doesn't want to deal with me, and tile I can't get due to their bankruptcy. He won't refund money. The down-payment was $4,890, tile added more way over that.

      We signed a contract  2 years ago with ***** and we did start to demo her shower only  she then told us to stop because she wanted her insurance to look at it because she feared she had black mold several months passed by we asked I'd we could continue to no answer  or she would say she was still dealing with her insurance and some other people at the beginning of her contract she had picked out her tile which was ordered which is why we started the demo. Months came and went with no response from **********; and about a year ago she called saying we removed her floor Tile and caused damage to her outside floor which we proceeded to send her a picture showing we hadn't touched her outside floor after several back and forths  she stopped communication,  then several months later she accused us of removing sheetrock which again we never did  and she acknowledged it wasn't us it was another company that ran off on her that had caused all these problems  we at the time stated we had to deliver the tile from the tile company  and again no return calls from her we reached out one final time and nothing . Again we didn't here from her again until recently by this time the tile company Interceramic had gone out of business.  We explained this to ***** and asked her to stop by another vendor to make a selection and again went silent until later she asked for a catalog which we sent( digital) she proceeded on her own to hire a plumber and work with all different kind of people without ever letting us know if we were her contractor  we have tried to speak to ***** several times and she starts screaming and yelling for no apparent reason  and I did mention to her she was very difficult to deal with and that I was not her child or husband to be screaming like a crazy person. We have a great reputation and for her to accuse us of being thieves is slanderous.  We tried also explaining that the shower pan is made as the installation is in progress but she won't hear any of it.

      I am rejecting this response because* This is not true. I have the text messages and emails between the company head, ****** and ****** and ***********************. The drywall was of course affected by the removal and demolition you did. You said your plumber didn't need a permit, but I called *************** Code Enforcement, who came over and said that is not true.  They did not approve your plumber's pipe at the shower head, and when I showed them the correction, only then did they certify the work. I didn't charge you for bringing it up to code. I did not have all kinds of people working on it, there was a hole I saw your plumber cut to put on the cap.  Although I was out of town a short while, I stayed in touch with you.  When I got back, you said you were booked.  I sent the below email stating that you didn't give me a date, although you were booked now, when can you install the shower. In the second email pasted below, ****** agreed to itemize the the work for me to send to my insurance company.  The mold was in the shower bottom pan, which is why you demolished it from a small leak, you knew that.  All my insurance's remediation team did was put fans to dry the subfloor, nothing else. You did not send any electronic version of tile, and you said it was not my fault that your company supplier went bankrupt. The point is, I paid for tile, and that is the tile I want. You could have delivered it while I was out of town because I told you my neighbor had a key. You mention one phone call where you raised your *********** first, and you were disrespectful. You have not even come over as I invited you several times in 2023. In a text message dated April 16, 2022, ****** texted, "I just changed phones last night and lost some of my messages who is this."  I answered, and texted asking to install the shower and give the estimate on the glass." He texted, "Oh hi ***** can you send me your email." August 16, 2022, he texted, "hi ***** were 4 weeks backed up I can reach out to you in 3 weeks."  He never reached back out before I moved to SC, and I moved back just to get the shower done, and he has promised, but never did it. I texted him again in 2023, and again he texted, "Who is this?"  He not only forgot the job, but forgot who I was, and I had to remind him.  I am pasting my emails from January 2022 and October 21, 2022 after speaking with ******. I have uploaded a photo of the current demolished shower, showing I didn't have any tile installed, and have been communicating with ******, asking him to finish for two (2) years.  Let's get to the point, and please stop criticizing me unfairly.  Will you or will you not give me my money back for the tile that you did not provide.  It was marble, and I want only that tile, and you made no effort to order or deliver it.  Will you or will you not give me back my money for work you have not done.  You have only done numbers 1 and 5 on your itemization.

      Again we reached out to ***** several times to pick up her tile she didnt . 2nd if there was a problem with the one water line she never contacted us to say hey the ********************** is saying this is wrong and gave us a opportunity to fix it and she was asked again 2 years later to provide something saying we were wrong she still hasn't. 3rd we have never refused to do her job so if anyone is in breach of contract it is her , her communication with us has been spotty at best. 4th she has accused us of stealing from her and has been slanderous and untruthful in her reviews of us, I ask for her to produce a text or email where it says we that we refuse to do her job ? In conclusion she wants to cancel a job 2 years later not3 days but 2 years later after she lost her tile and we started the demo and started our process again 2 years ago when she made us stop and accused us from everything from tearing things we didn't touch to calling us because she thought we were her taxi driver it makes no sense that with over 20 years of excellent reviews only her is the only one we would say nope were not gonna finish

      I am rejecting this response because: As I said before, this is not true.  I will share your own text and emails with you.  I also never ever said that I didn't want you to finish the job.  I provided evidence that you contacted me by email and text message that you were backed up.  Recently, I invited you to come over, discuss, and look at everything, you said ** and never came.  I am again inviting you to come and finish this job properly.  You said you wanted to put concrete on the subfloor, that cannot be done and still maintain the integrity of my home insurance coverage.  I can explain why when you come.  I am free on the 15th of December, the 16th of December, the 17th of December, the 20th of December, the 21st of December, the 22nd of December, the 23rd of December, the 24th of December, the 26th of December, January 1st, January, 2nd.  No, I never said you couldn't finish the job.  I said because you keep criticizing me and not being truthful that to stop and resolve the issue by giving me my money back or finishing the job.  I want that kind of tile, so here is the resolution, I get my money from the tile, and I can buy marble like that Mexican **************** was your supplier that went bankrupt. I  had nothing to do with that.  You never ever made plans to deliver that tile because you said it had not come in and then it went bankrupt.  Now you are accusing me of breach of contract.  I am asking you to come today if you cannot come any other days I named, to discuss the subfloor.  I did not complain against you, I just had ***************, approve a correction.  I am not asking you for money for that, so your mentioning that is just a sidebar. *** and I signed the contract.  The money is from my insurance company, and that means that if I don't get the job done or get the money back you cause me to tell them what happened.  So, again, I get to the point, as you are obfuscating--Will you or will you not give me my money back?  And now that you changed your mind and said you want to do the job, will you or will you not come on one of those days offered, and even today, to discuss the problem with the hole in the subfloor, how to fill the gap and fix the issue so no water gets through the gap in any future?  I don't have a camera to snap shot that email or text message, and my word doesn't work, but you said you were backed up and never gave me a date.  I challenge you to please stop obfuscating and give me a date you can finish.  I asked you to come with a portfolio book like you did before, sit down with me so I can see samples.  If they don't have marble, can I buy marble somewhere else?  Are you coming today?  Are you coming December 15tgh, name a day we can agree upon, because now that you say you will finish and please stop saying I am in breach of a contract.  Just come over then and finish the job.  I called you told you come over, you never came come, today!

      We have responded to this several times at this point  it is not going anywhere  2 years ago we started a job she made us stop and for two years we hear nothing from them we tried to get her to pick up the tile with no success she exhausted the money she put as a down payment,  she has gone on a campaign on trying to slander us for things of her own making not a rational person you can have a conversation with
