The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency.  If the matter is being appealed, it will be noted below.

On September 16, 2022, the business entered into an Agreed Judgment and Permanent Injunction with the State of Texas in the District Court of Bexar County, Texas, 407th Judicial District.  The Agreed Judgment and Permanent Injunction settle allegations that Education Solutions, LLC d/b/a My Education Solutions, LLC among other things, engaged in false, misleading, and deceptive acts and practices in violation of the Texas Deceptive Trade Practices Act.  

Education Solutions, LLC d/b/a My Education solutions, LLC (MES) and its officers, agents, servants, employees, attorneys, and any other persons in active concert or participation with them are permanently enjoined from engaging in acts or practices misrepresenting that MES' services will reduce the amounts of monthly student loan debt payments owed by a consumer by a specific amount or percentage, unless such representation can be substantiated with data, including but not limited to, past results of MES' clients and the terms under which this can be achieved are fully disclosed to the consumer, provided, that MES can inform a consumer that a reduction in a monthly student loan payment can occur if the consumer is approved by the Department of Education for a student loan forgiveness program; and the balance of student loan debt owed by consumers by a specific amount or percentage unless such representation can be substantiated with data, including but not limited to, past results of MES' clients and terms under which the results can be achieved are fully disclosed; provided that MES can inform a consumer that if they successfully complete a student loan forgiveness program in accordance with the terms set forth by the Department of Education, any balance remaining on their student loan will be eliminated.

MES is also permanently enjoined from engaging in acts or practices misrepresenting that MES is associated with the Department of Education or its authorized loan services; and affiliated with loan forgiveness or payment reduction programs provided or serviced by the Department of Education.  It is also ordered MES cannot misrepresent charging service and student loan payment fees to consumers without the prior written consent of consumers, fail to make payments on client's loan forgiveness program within the allowed time frame in accordance with the terms set forth by the Department of Education and or its authorized loan servicers  for the forgiveness program, provided that client made timely payments to MES. Representing that MES can improve consumers' credit scores if such is not the case. Failing to obtain prior written authorization from the client to substitute consumer's contact information with MES' contact information and applying for forbearance or deferment status on behalf of a consumer without prior authorization from the client regarding the change, except where the government servicer places the client in forbearance or deferment under circumstances as determined by the Department of Education, legislation, or other regulation applicable to the Department of Education or its authorized loan servicers.

It is ordered the State have a judgment against Education Solutions, LLC d/b/a My Education Solutions, LLC, totaling Forty-Five Thousand Dollars ($45,000) payable to the State of Texas.
