      I took a loan with Ovation years ago when my father passed and property was placed in my name. I was unaware of unpaid taxes and I used Ovation Lending to help with that. Everything was going well up until March 2024 when I delivered a citation from ***** ********* who is the attorney that Ovation Lending uses stating foreclosure on my property for unpaid amount. Yes I did get off track early 2023 however I contacted Ovation and was able to setup payment arrangement for current and past due balance and they agreed on $245 per month via auto pay which started in November of 2023. I have all email receipt where payments were processed each month. So I reached out to Ovation to see what was going on and every person spoke with in April/May of 2024 told account was fine and they were still deducting my monthly payment of $245 on the 15th of each month. But early May get a call from Ovation saying they can no longer process my ach and that I need to speak ******************************* with ***** ********* regarding my account. I called several times no one ever answered and it states to email so I have emails from ******** during this time frame to figure out what is happening and at the beginning all she would say is she has contact Ovation to see why they filed it and Ovation is telling me they didn't file anything. So there was a lot of both companies putting the blame on each other and me not getting a answer. So long story short I asked Ovation for a statement so I could see my balance and they told me they could not send me a statement which no could explain to me why I couldn't get a statement. I found a statement from June of 2022 an the principal balance is still the same on the current payoff statement that ***** ********* sent me. They have added additional attorney fees but yet can't tell me why. So I feel something fraudulent is going on regarding the balance because if the past due was an issue why would they setup autopay and I have done this in the past.

      We appreciate you bringing recent events regarding your account to our attention.  It allowed us to research more thoroughly to get to the root of the issue.  In short, the citation you received from ***** ********* was sent in error. 

      We also appreciate you taking the time to discuss your account and the series of events with one of our managers.  After he aligned with you, the following steps were taken regarding your account:

      1.  As you paid $492.80 in legal charges tied to the citation from your account, we are refunding you that amount.
      2.  Due to our mistake, we are also sending you a refund for 10 late fees for a total of $65.70.
      3.  We then reapplied your most recent payment, which paid you through July.  Your next payment due date is 8/15/2024.
      4.  As of 6/6/2024, your payoff balance is $7,611.80, of which $7,586.68 is principal and $25.12 is accrued interest.

      In addition, the lawsuit has been dismissed. Your account is in good standing with us.

      In regards to information about your account, we now show you as opted in for email communication.  As such, you will receive monthly E-statements.  In addition,as of 6/1/2024, we rolled out a new customer portal, which allows customers to access account balances, make payments, and more!  If you have not yet enrolled in that service,please find details regarding enrollment here:

      I paid ****** dollars for my back taxes am still ending up with a back tax bill of ****** for the country. This company is fraud an needs to be look into. Ovation Service LLC business work ethic is horrible.

      Dear **************,

      We were able to review your account.  Here is a timeline of events to assist in understanding your loan balance:

      1.  In February 2015, your account originated with a starting loan balance of $45,525.81.
      2.  Since origination, your account has not been paid on time consistently.
      3.  Over the years, this resulted in us having to send legal notices as follows:  December 2015, February 2016, April 2016, October 2016, January 2017, and May 2019.  Legal notices result in legal fees being assessed to your account per your loan documents.
      4.  Separate from your account with us, the taxing entities filed a lawsuit against you in July 2019 due to non-payment of delinquent property taxes.  To protect our interest, we had to intervene into that lawsuit, resulting in additional legal fees.  The taxing entity set the lawsuit for trial in August 2023.
      5.  In June 2021, we entered into a payment plan with you.  At the time, you were past due as of January 2020. 
      6.  As of August 2023, you defaulted on your payment plan with us.  The last payment we received was in April 2023.  We have not received any payments from you since April 2023 and your account remains past due as of May 2023.

      Failure to pay your account according to your loan documents and failure to pay your subsequent taxes owed resulted in additional interest, late fees, and legal fees being assessed to your account, resulting in the balance currently owed.

      In addition,when your account originated, it was set up with escrow services.  The intent was that portions of your monthly payment would be held in escrow with the purpose of paying subsequent taxes as they became due.  Unfortunately, inconsistent payment of your account resulted in no available funds to pay those subsequent taxes.  Lack of funds then resulted in escrow services being cancelled.  This explanation should provide context as to why you state you have a back tax bill of 25,000.

      Ovation Services is a PREDATORY LENDER that has "forced insurance" on my property. Severe weather a few years had created multiple leaks in my roof. I notified Ovation Services and the **************** but the insurance agent informed me that they were going to pay ovation Services and NOT FIX THE LEAKING ROOF. Now, The water damage is so excessive throughout the house it has developed TOXIC MOLD, damaged sheetrock, paint,hardwood flooring and damaged my HVAC system. I notified **********************@ Ovation Services (Attorney) from day 1 but haven't received any help in remediation of this HEALTH CONCERN. Also, I have tried to seal the roof myself but it didn't work.

      Attached is the Deed of Trust that outlines insurance requirement and allows for Ovation to use the insurance proceeds to reduce the outstanding note.
      Next is an email thread involving the borrower that explains the outcome of the claim.
      Also attached are the coverage letters from the insurance company outlining that the damage to the roof is from poor maintenance.
      The screws in the metal roof had backed out and the borrower had caulked the areas to prevent water from entering the home.
      The adjusters photos show no penetrations in the metal roof.
      Neglect and poor maintenance is not a covered peril under our insurance policy.
      The total claim was $1,955.05, with a $1,446.00 deductible, and an additional $227.68 withheld in depreciation.
      This left a final balance of $281.37.
      The claim proceeds were applied on 5/12/2020 to the outstanding as no payment had been made to the loan since 2015.

      Also, per the finance code, we have the authority to place collateral protection insurance. The *** is not considered homeowners insurance for the benefit of the owner, but for the protection of the loan amount.

      I am rejecting this response because: Ovation Services "Failed" to repair the storm damaged roof/walls/foundation with the insurance claim money paid to them and have created a HEALTH HAZZARD to me and my family.

      Ovation Services have also refused every effort to modify the loan.

      Ovation Lending services is a predatory lender for the amount of EXCESSIVE FEES in their unfair lending practices.

      Can Ovation Lending services please upload the original loan contract amount and the current PAYOFF amount???? FOR EVERYONE TO SEE!!!

We have spoke to ************ since she has filed this complaint and believe we both consider this matter to be resolved. Our team had a call w/ ************ and her daughter and walked them through the changes and the communications that went out prior to the changes to the customer's account. The client is welcomed to call us back if they feel the issue needs additional attention.

      I am trying to refinance my ********* from Ovation. I'm working with another company and have authorized them to receive a payoff. Ovation has broken the 7 day rule where they must provide this payoff to them. To be clear this is the 2nd request. Ovation sent them an email stating i was not moving forward. I resigned a new one and had it sent to Ovation again. This should not start the clock over. even then they should have had my payoff ready to go on that day. this has been going on since 24 Sep 2021. emails were sent to their existing and active ****************************************** with confirmed receipt on their end as well. Because Ovation is not following the rules and ignoring my authorized requests, I will most likely will incure charges, penalties and possible attorney fees added to my loan which could now disqualify me from getting help. Please help me resolve this and let them be on notice that everyone will see these complaints. I want credit from the original requ

      This particular client has two loans with Ovation that are severely delinquent. Both loans are involved in the late stages of the foreclosure process. The request was received by a third party on the 24th of September. When we receive payoffs for loans that are involved in foreclosure it requires a very detailed process to make sure all fees are correct and up to date. Unfortunately the individual who handles these requests was out with COVID. We do apologize for the delay. The third party did receive the payoff as of October 11th.

      Ovation Services is trying to take my house. They did pay 2 years of my house taxes which totals less than 9 thousand dollars. I have always made my payments but do to covid I no longer have income for the past 3 months. So I fell behind. I went to ovations to see if they can work with me during this pandemic and they said no . And that my house is in foreclosure. They added over 25percent in legal fees . They said I owe more than 20 thousand dollars . And won't give me the exact amount in order for me to get a loan from my back with a better interest rate. So without that payoff amount . I can not do anything. And they keep adding extra fees while I wait for them to email me that amount . They are predators

      The borrower originated the loan with Ovation in February 2019 to pay back property taxes for 2017-2018 and cure a foreclosure suit filed by Bexar County in the amount of $7,939.23. Additionally, the loan with Ovation included a payoff of a former tax loan with a competitor in the amount of $11,288.39 bringing the initial loan balance with Ovation to $20,191.08 inclusive of $963.46 in origination fees. The first payment was due in July of 2019 and timely payments were only made the first two months before becoming a sporadic payer and by October 2019 was 60 days delinquent. In November 2019, the borrower cured the delinquency and became ahead in payments and maintained a current status through March 2020 before becoming a sporadic payer and reaching a 60 day delinquency for the second time.

      In June of 2020 the borrower again made a payment to pay past due amounts and paid a month ahead. After making the August 2020 payment on time, the borrower fell four months delinquent until January 2021 when a large payment was made for the past due balance and one month ahead. Repeating this process, the borrower stayed current through March 2021 at which time no further payments were made on the loan until it was paid in full in September 2021. Our records on the account show that the borrower contacted Ovation on August 31, 2021 requesting a payoff only to claim the following day that they were unaware of ever having a loan with Ovation. At that time, Ovation provided the borrower with a copy of the signed contract and followed up with an emailed payoff the following day. Over the following 2-weeks, Ovation spoke with the borrower two more time confirming receipt of the payoff and addressing the borrowers questions. During the life of the loan, the client incurred $2,692.71 in legal/foreclosure fees (13%) relative to the 25% referenced in the complaint. This is not inclusive of late charges or force placed insurance which could have been provided by the borrower. Each time the client became delinquent, Ovation made several attempts to contact the client for payment with no answer. It was only when the client would become severely delinquent that they would contact Ovation to bring the account current. At the time the loan was finally paid in full, the loan was 6-months delinquent and citations had been served to notify the borrower of the foreclosure suit.

      The total was less than ******.
      I made on time payments for more than a year sometimes for way more than the monthly payment due. How did less than $****** turn into over $24,000 owed. Shouldn't my balance of at least gone done some ? That makes no sense. A Neverending loan. Ovation can just tack on made up charges so the balance never goes down at all , only up. What Is that. They need to be investigated

      What ****************** has failed to understand is that she had becomedelinquent multiple times throughout the life of the line. Each time thishappened, interest had accrued and at times, additional legal fees depending onthe severity of her delinquency. Due to not receiving payment from March of2021 until the loan was paid in full in September 2021, she had accrued a largeamount of legal/foreclosure fees and interest.  When she made payments to catch up, they wereonly for her regular payments missed and not to cover additional interest andfees. Over the life of her loan, she accrued approximately $2500 in legal feesand $1500 in interest. Please note that we are regulated by the Office of theConsumer Credit Commissioner of the ************** (OCCC). Formal complaintscan be made on their website.

      Ovation has been very difficult to work with from the beginning. Rude on the phone and not helpful at all to resolve issues. Currently, I have paid the loan in full. The balance sent on the statement from them shows a negative balance, meaning they owe me money. They refuse to close the account and on the statement that shows they owe me money, they claim a late fee if I don't "pay" what they owe **** called and someone who claimed to be a supervisor could not see that this is a negative balance and would only read the top line which was the balance before the last payment was made. Since being made, the payment portal gave me the message "account paid in full" however, the "supervisor" claims that the amount I paid is the amount I owe.. Why so incompetent?

      ****************** has previously filed a complaint with the ******************************************, a state regulatory agency relating to this same issue. ******************** has responded formally to that complaint and the previous complaint filed by ****************** in 2020, where no findings were or have been made against ********************. 

      ******************** has addressed and responded to ********************** questions previously and she does not accept the previous explanation. ******************** has explained that her statement reflects a credit towards her regular monthly payment amount, because the current balance is less than her actual payment amount. Additionally, ********************** account online in no way reflects that it is "paid in full" and only shows a credit of $69.33 as evidenced by the attached statements and ****************** can call *************************, Director of Accounting & Finance and Chief Compliance ******** ******************** Financial Services, **********************************************************, ************** directly if she continues to have questions regarding this matter.

      I am rejecting this response because: The first point stated in the letter from Ovation says I previously submitted a complaint about this issue. That is false. I did submit another complaint prior to this one. They have been egregiously in error many times in the past. The first complaint was because they began foreclosure process on my home last year at the start of the pandemic only because I called them and let them know that I lost my job due to Covid. I was following advice given to all Americans about how to proactively deal with what was going on. 

      This complaint is an entirely different complaint. They currently owe me ***** and my account is paid in full. When I made the last payment possible through the payment portal, as usual, I was shown a balance of ***** and some cents. I paid that and then a red lettered message flashed across the page with the message, "Account Paid in Full."

      They do not seem to be able to add an subtract accurately. The balance is negative and shown in parenthesis, which symbolizes a negative number. It is negative because I overpaid and they owe me money that they are refusing to pay.

      They are also refusing to release my lien on my house because they think I need to pay something. Yet, there is no **** to pay anything. The only thing that shows is the negative balance of *****.

Your account has an outstanding balance which accrues interest daily and until that balance is paid in full, Ovation will not release any liens secured by your property.

      I am rejecting this response because: My account showed the message in red letters to me when I made the last payment in June. It said "Account Paid in Full."  In addition, if the only item showing on my account is a negative balance, or a credit, then that is the balance on the account. It is paid in full and I am owed a payment back for having overpaid. Records show that FMGS released part of the lien on my house in April 2021. Still there is a remaining hold up. How can she say a negative balance as the only thing showing does not mean the account is paid in full? There is nothing for me to pay, because the account is paid in full.

      This person could not possibly be an educated Accountant.

      My family went to Ovation Financial for assistants in paying for the taxes to property owned previously by my parents. My brother lost his job due to his health issues and fell behind on the payments. Ovation apparently had a hearing to foreclose on the property but never sent notice to my family about the hearing. When I called to ask for the proof of notice Ovation stated in an email to me that they did not send actual letters that they did courtesy knocks at my sister's house. Which is not a legal way to notify someone of a hearing or foreclosure. Now we are seeking to hire an attorney to help obtain the house back from they buyer who now wants 95K for property he obtained through an illegal foreclosure.

      Thank you for forwarding this. I tried to sign on and change the email associated with Ovation Services, Ovation Lending and was not able to do anything.  

      Nonetheless, I have searched for information relating to the account **************** is referring to in her complaint below and since she is not a borrower of Ovation Services directly, I am not finding anything that would allow me to look into her allegations. 

      If you could have **************** provide her parents name or property address, I should be able to locate an account and research what happened. However, with the information she provided below, I am not finding anything and I am just unable to respond one way or another at this point in time.
