      ***********************/Texas Simple Solutions was represented as a seller of *********************** & contracted with me to deliver & arrange installation of 15 ******* series **** windows & 1 set of custom French patio doors. The total selling price for both was $11989. *********************** received $5000 deposit toward both the price of the patio doors & as a partial down on the windows, with a promise of delivery of the *************** in 3-4 weeks. The doors arrived on the 25th of February from ******* Lumber. I found out later that the doors were purchased from ******* millworks, not *******. by ******* installers left the door against the side of my ********** was later knocked over by high winds, scratching the glass & breaking some of my pottery. March 3 the doors were installed after repeated delays with instructions to hire my own ********* to seal & finish the trim outside & inside, & that ***** would send someone to fix an area of concrete by the door where ****************** could collect. ***** failed to keep in contact about the concrete work, went back & forth with me about it, didn't send send anyone till March 24. On March 29 I told ***** that ******* had no order for my ********************* lead time on window orders was generally only 2-3 weeks. It had been nearly 2 months since I had given *********************** $5000 down to fulfill the contract. He admitted he had never ordered the windows. I told him not to order them, just to refund my money. He got angry & started attacking me as his worst customer in 40 years" & said he didn't want to do business with me. The call ended with no promise of my money being refunded. Additionally, after the concrete dried, the doors were unopenable on one side due to misapplied cement having dried underneath the doors. Also the old patio ************ from installation were never hauled away as promised. I requested a full refund of my $5000 as I now have to get a new door installed & I never received any windows as promised.

      My name is ************************* President of Texas Simple Solutions,

      Customer ********* has been nearly impossible to please. Numerous texting & calls for several weeks. She ordered ! retro fit French Door and !5 replacement windows.

      The door came in sooner than windows, so we installed the  door..  She called and cancelled the window order which was more than fine by us, very difficult to please, always complaining.

      This did increase the price on ! single french door, because with windows she received discount. Now the door price went to list price. of ****. plus 175. cost for measuring . .15 windows 2 story home. Her refund will be ******* from ******* deposit. In my 20 years of doing business *************************** became my worst customer. and in the long run this order and installation  ended up for 1 door for all of this.

      I am rejecting this response because:

      With the exception of his name and business name, the remainder of the response by *********************** is, to put it politely, factually incorrect. I have plenty of records and photos to back up what I say. 
      ************** presented himself as a seller of Wincore windows and doors. I have the brochures he gave me.
      I signed a contract for the delivery and installation of 1 (not "!" as ************** wrote) "Custom French door, Low ** *********** Outswinging, w/grids" and 15 (not "!5" as ************** wrote) single hung (3 obscure) windows, Southern Region Glass Package", with "Clean up job site/Haul away old windows" "Lifetime warranty"
      The door and its installation (including any measuring and all other particulars of installation) was listed as $2454 total, with no mention of any stated or hidden discounts or upcharges, nor any agreement to such on my part, for the door and/or any extra work needed to successfully complete installation. Neither did I agree to any arbitrary future upcharges on the door or installation by ***************
      The windows and their installation were listed at $9535 total, again with no mention of any stated or hidden discounts or upcharges, nor any agreement to such on my part, for the windows and/or any extra work needed to complete installation. Neither did I agree to any arbitrary future upcharges on the windows or installation by ***************
      At no point did ************** say this door and these windows would not be ordered from *******. 
      The total price on the contract was $11,989. I paid ************** $5000 down - using my Mastercard, not a home loan - on the installation of the door and windows. More than half of that amount exceeded the price listed on our contract for the installed custom door. 
      ************** stated at contract signing that the doors and windows would be delivered and installed within 3-4 weeks. He says in his response that "The door came sooner than the windows" but leaves out the part about how he never ordered the windows but pocketed the difference on the contract price of the door and simply claimed to have forgotten (for 2 months) to order the windows when I found out from *********************, the ******* territory sales manager, that ***** had never ordered the windows or the door from *******.
      Additionally, ************** makes no mention of the fact that he did not order the door from *******, but from a local ******* Lumber business, and he paid only $1299.00 for the door, plus a $50 delivery charge and $111.33 tax, for a total of $1460.83. I have a copy of that invoice emailed to me by ***********************, Assistant Manager at ******* Building Supply.
      Additionally, ************** says that I am "nearly impossible to please. Numerous texting and calls for several weeks", "very difficult to please, always complaining" "worst customer". He neglects to mention his repeated failures to communicate with me about when workers would be coming to my home, his lack of response when the new door delivered by ******* was left leaned up against the doorway of my old patio door on the patio and fell over in a windstorm thereby scratching the glass and scuffing the door, how the door installation left the product and framing damaged and marked with no sealing of the exterior trim, how I had to wait weeks between the door installation and when he sent a worker to do some concrete fill in a trough left in the patio near the back door when the new door was installed and how that worker ************ under the edges of the new door and cemented it shut rendering it useless, and his failure to have the old door and debris from installation hauled from my property. ***** also doesn't mention that he is never on site with his workers, leaves them to deal with situations without oversight, blames them to his customers instead of taking responsibility as the contractor, raises his voice and verbally abuses his customer (me) when he is in the wrong, and keeps money that he has not earned. 
      On April 19 he sent me a handwritten list of revised and new charges - unapproved by me - for the door and measuring, none of which were included in the original contract, as well as a check marked "Refund" for $1575. I have informed him that I do not agree to these charges, that I will not be cashing that check, and that I continue to demand a full refund since I have not received the working door that I contracted for.
      ************** seems to deliberately disregard Texas property code 162 that makes him a trustee, not a beneficiary of the funds that I paid him on a contract exceeding $5000 - my contract totaled $11,989, of which he received a $5000 deposit - which should have been deposited in a construction account - toward obtaining the doors and windows with the rest to be paid at completion of installing everything. He doesn't get to arbitrarily decide to change the terms of the contract or to keep money when he delivers a damaged and shoddily installed door.

      7/21/22 ********************* came to my home after a call from me interested in screens for my home. ***** arrived at my home and began trying to sell me windows since I have an old home. I told him I wanted black screens for my home. He said he could do that also. We spoke about the darkness percentages. I called my daughter, *********************************, to get her input. She asked to speak to *****, he told her that the process was for him to count and measure the windows, it would take about 2 weeks for the manufacturer to make the screens, then they would come install the screens on my home. My daughter told him to wait on the windows, however if I wanted the screens, it was fine with her. ***** then went outside to count and measure the windows. He came in after about an hour or so and gave me the total. I ended up paying the full amount of $2,430 so I would not have a bill hanging over my head. ***** gave me a copy of the paid invoice and he left. About 2 weeks later, *********************** arrived at my home and stated that he was there to recount and remeasure the windows. I allowed him to, he stated to me upon finishing that he had gotten a different number of windows than his son and he would correct the amount. He then left.On August 17, ***** and *********************** came to install the screens. They worked diligently outside and left. ***** left a message on my answering machine stating that they were done, however, they had missed two windows and needed to make those screens and would bring those back in a couple of weeks to install.My daughter came over that evening to check the screens with me. We were very disappointed to see that 90% of the screens were measured incorrectly and did not fit properly. Only 3 windows were completed correctly.************** yelled very unprofessionally for 30 minutes that we were nitpicky and our house was old. He finally came and remeasured and promised new screens and never came back, leaving two windows bare without screens at all.

      From the start of this project, ******************************** has been very kind, sweet, and understanding with the whole process of this service provided. Yes, initially there were some slight issues with the sizes of screens, but again, ******************************** understood and allowed us to correct the error. As of this composition, all screens are installed and complete, but one. I informed ******************************** today that an error in production caused the screen to be too large for opening and how we are expediting the correction to complete this last screen. Per phone conversation, ******************************** said she understands and is very thankful.

      I am rejecting this response because:  As several screens were repaired and fit to size, the arched windows that needed arched screens are not arched, they are still straight at the top with access to the glass of the window showing on top.  Several other windows are still not fitting correctly.  I wish not to engage with ************** as he has been extremely unprofessional with my daughter on the phone.  Due to me being elderly and alone on that day, I told him thank you and wanted him to leave.  When my daughter and son in law came over later and we were able to walk the house and actually assess the screens, there are still several that do not seem to have been changed to fit correctly.  Our yardman was given 10 screens to get rid of and we had more than 10 screens that needed to be sized.  If ************** is interested in standing by his websites' "Satisfaction Guaranteed" advertisement, I think he should sit down with my daughter and I and listen to us as to what WE feel needs to be fixed.  When he came out in August, he had my daughter write down measurements to windows HE thought needed resizing.  This is not making the customer satisfied, it is making HIM satisfied.  As there are less screens needing sizing this time, there are still several that are not fitting correctly.  As he said before to my daughter, we are just being "nitpicky".  We just want our $2400 screens to fit our windows properly.  Doesn't seem like much to ask.  Next time he comes to my home, I would like it to be when my daughter can be here so I am not afraid to speak to him.

      July 2021 contract signed for renovations of our home. windows, siding, paint interior, masterbath & 2nd bath remodel, shelves built in hobby room, all new flooring, remodel kitchen & replace front and back doors. contract signed for $69498. As of today, 4/13/22 the completed jobs are windows, siding and shelves. ****** has received $55000 from us via periodic draws he asked for. He recently delivered flooring but said he only bought **** sq foot. when questioned he said "don't worry about it. It's done in phases." He also said he only bought 1 slab of granite even tho 2 will be needed. The crew was here working the following 3 days installing the floor. I got home Wed night 3/30/22 and noticed his sign was gone from our yard. I texted and asked if anyone would be working tomorrow. he said no. then he asked for another draw. I indicated my discomfort with this and asked to sit down with him and discuss where we are and where we are going with the project and for me to understand the money better then a draw could be made.He responded with "I will withdraw from the project." I asked why he thought this was unreasonable and he responded "I'm out." No response to a cert.letter or follow up email requesting a refund. In Jan, one of his crew he hired also stole my wedding ring and a police report was made yet ****** never offered to make it right. I have the guy on camera in my room when he had no reason to be there and he denied he was in my room. no expectations from BBB about my ring, just FYI. According to the contract he has completed approx 30k-35k worth of work and we are asking for $20,000 refund. floors torn up, bathroom counter incomplete, lights and ceiling fans not secure to ceilings, paint splatter everywhere, kitchen not started. demolition in master bath started. trim throughout house not painted, doors not replaced. Solid and positive relationship up until March 30th when he abandoned the contract.

      On 4 December 2021 ************************** knocked on my door and gave a estimate for window replacement, he gave a quote on 6 windows. I gave him $999.00 down on an order for $3999.00 for the 6 windows. He told me that they would be installed on or about 15 January 2022. I started calling him at ************ approximately on the 16 December 2022 and have left messages and texts with no response from him. I would like to see this situation rectified as soon as possible. Any company in good standing should of called and explained if a situation had come up. Whether it is covid or any other situation. I would love to have my 6 windows as well as get the remaining windows done.If nothing else I would want my deposit of $999.00 to be able to get another company to do the work!Please help me!***************************** 850 661-2576 ******************************, Texas *****
