On November 1, 2023 I hired a contractor to create a new sign for by business because TxDot demolished my existing monument sign with expansion of the road. The contractor hired ****** ********************* with Modern Z, LLC to do the sign. Myself and the tenant in my building paid the contractor $1750 each, which was half the cost each for an 8 foot metal sign that was powder coated. He stood in front of me on November 1, 2023 and told me the sign would be installed on November 22, 2023. They did not show up that day. Since that time, the contractor refunded my money, but ********************* reached out and said that I could pay him directly and he would have the sign completed by first week in January. He did not show up on January 3, ************************************************** February, as he had not even started the sign. He refused to give a refund and he did not show up with the sign for months. Friday April 12, 2024 he reached out saying the sign was complete. My tenant and myself agreed to meet his today, April 17, 2024 for installation. He arrived 30 minutes late. The sign was the wrong color and he did not have a permit from the city. Also, he can not get a permit because he does not have any insurance. I have paid him $1750 and he refuses to refund my money. He can not install the sign because he does not have a permit and he can not get a permit without insurance. I have waited almost 6 months for a sign that was supposed to take 3 weeks to make. He is volatile and has an explosive personality. After looking him up on public records search in *************, I realized he has a history of this behavior. There are other law suits associated with his business. I will attach the digital mock up and what he showed up with. Even if I was willing to accept the sign as it is, he is not insured and can not get a permit to hang it. He portrayed himself to be a legitimate business, but he is not.Customer response

Finally, after over 6 months the signs were installed Wednesday May 8th. The sign is the wrong color. It did not fit in between the pillars. It took 6 months when I was originally told 4-5 days and then 3 weeks. The contractor and subcontractor had no idea about permitting requirements. At the end of the day he responds about like he did to this complaint, not at all. The sign is up at this point. I would have preferred a refund, but he did not have the money to refund me or finish the project in a timely manner. I would consider this resolved, although I hope others can see they type of work he does. Thank you.Business response

The customer provided me terrible files to begin with. They took weeks to clean up for cutting steel.
The customer was rude and disgruntled from the very beginning.
the customer made racist comments regarding my General Contractor.
the customer obstructed my project with another customer, separate contract.
the customer defamed my character and business on Facebook.
The customer called the local police regarding a civil matter.
There was never a 3-4 day promise or schedule. That is virtually impossible. This was a multistage fabrication and powder coating project.
The customer threatened to *** multiple times. Closed the project, demanded refund which I offered. I have all correspondence, screenshots with customer.
After stopping the project, the customer waited one week then insisted the project continue. Thus increasing any delays.
The customer would not accept the project upon delivery, then a few days late decided to accept it.
I have video of delivery.
Customer provided a location layout, and a color layout to match her business card. That is the color scheme I used.

customer did not pay the balance upon installation and completion of the project.
My attorney is recommending I file a lien to recover the balance.
The other who was compromised by her also did not pay their full balance.
Both customers received a very nice project and did not pay balances.
