The Final Default Judgment and Permanent Injunction orders EB Worldwide LLC DBA Senior Grad Trips and George Barragan, individually, and their officers, agents, servants, employees, attorneys, and any other persons in active concert or participation with them who receive actual notice of the final judgment and permanent injunction be permanently enjoined from engaging in representing that goods or services have characteristics or benefits which they do not have by claiming that their trips have been or been or will be fully booked and prepared when they have not or will not. Advertising goods or services with intent not to sell them as advertised by advertising trips that include transportation, lodging, or amenities that are not fully reserved upon purchase, representing that an agreement confers rights which it does not have by claiming that their agreement provides reservations and guarantees which are not provided. Failing to disclose any conditions that must be fulfilled before a consumers' trip is fully booked. Advertising or selling any good or service without clearly and conspicuously disclosing all the material terms of that good or service prior to accepting any form of payment for that good or service; and failing to provide refunds to consumers who have paid for trips booked through EB Worldwide, LLC that were canceled or not fulfilled.
The Defendants were further ordered to pay in the sum of $80,000 for civil penalties, $122,080 for restitution and, $36,835 to the State of Texas for attorneys' fees.
