Predatory Lending -Auto Loan Circle ****************************** Sales had my vehicle repossessed for the allegation of no insurance and the vehicle being out of state. The dealership never notified me of default of contract for financing. I was not aware the vehicle had to stay in *****. Im a victim of domestic violence and had to relocate with my children to a different state to reside. I emailed the dealership on several occasions (copies of email communication can be provided upon request) to have them assist with providing the registration to the state I reside in now so I could be compliant with state laws for auto registration. The dealership would not communicate or follow up on my emails requests. A phone call from owner of the dealership was promised by the receptionist but was never done. I continued to follow up to try to get information on registration of the vehicle but was unable to get a response from the dealership/auto lender. The dealership is making accusations of a lapse in auto insurance but insurance never lapsed. A new policy started with a different carrier that was more affordable and then the old policy was canceled; not a day of coverage was lapsed. The new policy started and then the old policy was canceled. The insurance company was going to deliver proof of coverage to the lien holder; however if that was not received, I could have provided at any time, upon request. On the night of 6/26/24, the car was repossessed in ********! I was not aware of any contract violations and made every attempt to communicate with the Dealership/Lender. Based upon their explanation of why the vehicle was repossessed, there was no lapse in auto insurance coverage and the vehicle was being returned to ***** at the end of July 2024. No notice was given for any contract violations or time lines provided to remedy such violations. After realizing the vehicle had been repossessed, the Dealership denied my request a copy of the contract.

      Business response

      07/11/2024

In response to no insurance, we received notice from the insurance company stating canceled at customer request. In response to vehicle out of state, contract states that customer is responsible to notify dealer in writing before vehicle is taken out of state and customer is suppose to receive a written statement back from the dealer before vehicle can leave the state.Primary buyer contacted us several times about the vehicle being out of the state. In response to the domestic violence claim, this statement has nothing to do with this claim. This statement is an attempt to sway others. In response to the registration, the vehicle was not suppose to leave the state per contract. We do not finance out of state. In response to complying with the state, this is another attempt to sway others.Contract was explained and questions are welcomed from the buyer and co buyer. The buyer requested the vehicle be picked up from the co buyer. The buyer also stated the the co buyer had bought a new vehicle. In response to the emails ,our emails are only for the use of insurance purposes .We tell al our customers if there is a problem to contact us at the office. The buyer was also aware of the cancelation of insurance by the co buyer. It is the responsibility of the insured and insurance company to notify the dealer if there is any change. In response to breach of contract, the contract was provided to buyer and co buyer stating any reason for breach of contract. In response  to vehicle being returned,we have no way of knowing if the customer really intends on returning the vehicle. In response to notice and time lines, notice and time lines are provided in the contract to the customer at time of sale.Any questions the buyer and co buyer may have are invited to ask or call. In response to copy of contract, the contract was in the vehicle with her when she move to ******** .In closing buyer was aggressive  and demanding. In order to resolve the situation calmly the police were ask to come. The buyer then stated he would call an attorney at which point  all communication was ceased. If any question remain on this matter you are welcome to call and we will explain as much as we are allowed to.
