      I hired "Danilo Lawn Care" to plant trees, shrubs and flowers at our house in Sugar Land, TX. The owner Danilo ******* (DM) and I agreed in writing on what was to be planted, price and WARRANTY. DM & his workers completed the planting & installed new lighting on 3/23/23, when DM was fully paid for that portion of the work. DM also repaired some issues with irrigation system, sold us a new sprinkler control box and DM HIMSELF PROGRAMMED THE WATERING SCHEDULE. The irrigation system was not fixed properly, so I had to hire another company to fix the problems as DM said he was too busy. The dispute is that DM provided us a 3-month warranty on some plants & a 6-mo. warranty on others, which HE NOW REFUSES TO HONOR. Also, he is very evasive and unresponsive. On 4/10, I texted DM a photo of some plants looking bad, he said it was nothing important. In June and early July, I alerted DM through phone and text msgs that some plants were dying, writing "...Started looking bad even before this heat wave". And writing on July 4th: "We have been watering every day. Hopefully those plants are not dead (referring to backyard) and come back". Sent DM another photo with note: "I hope that these are not dead". DM ignored those notes but sent me another invoice on Aug. 1. I asked a question about the invoice which DM also ignored. We met at the house in early Sept. (DM came only because I gave him $$). DM saw the many dead plants and trees and told us he'd honor his warranty, but we'd have to wait for cooler weather. After ignoring several weeks of my phone calls and texts, DM texted me 11/18 that he was not responsible because we didn't take care of the garden during drought. We had the sprinklers on all summer, even increasing the timing DM set, while at home or on vacation (our kids monitored). While we acknowledge the drought this year, THE WARRANTY WAS UNCONDITIONAL. For a fair resolution, DM should replace at least 50% of the dead shrubs and trees, or we will seek legal remedy.
