When attempting to lease from here we were sent a text from the business number with terms. We applied, paying $100 (which we were told was refundable if not approved). We were approved, but then went to sign the contract and were told what we were sent over text (Oct 5th) was no longer valid and he (****) stated they were not "obligated to honor it since the employee no longer worked there." That's fine, but now our application fees should be refunded, since we applied with false information given by THEIR agent, from THEIR business number over text, 2 weeks ago. They refuse to refund our application fee. We just want the $100 refunded.

This has already been explained to **************** and this is the FIRST notice I have received from the BBB.

The  TEXT shes referring was received on Oct 18 and was an EXAMPLE stating how to calculate rent to income ratio to see if she qualifies for our program.  See attached text she sent.  As stated in the attached text, it clearly states., FOR EXAMPLE on the 3rd and 4th line.

On Oct 16th, It was explained to her that her rent for the 2019 - 3/2 home with new appliances was going to be $850/mo and a $35/person application fee AND if she wanted to reserve the home while they were being approved they could put a non refundable $100 deposit down so another interested party wouldnt jump in front of them.

They were approved, but then she sent the text (see attached) to site manager demanding that the she was misquoted the rent price using that text as her evidence .  Once again the text she provided is from a Qualifying Criteria sheet we give to all our prospects and once again is FOR EXAMPLE so the prospect can see if they meet our qualifications before applying.

This information should be sufficient to close your file

      Best regards,

I am rejecting this response because:
Let's address the word **** has chosen to highlight, as he said, EXAMPLE. "Example" was used when it came to dollar amounts. The text CLEARLY states "a minimum deposit is FIRST MONTHS RENT" BEFORE the use of the word "Example" when referring to dollar amounts. therefore, since our rent was 975, the deposit should also have been $975. NOT $2000 and then another 975 less than 2 weeks later.
We were told the (now I'm going to highlight MY chosen important word) APPLICATION FEE was $100, refundable if we were not approved. Photo of receipt, signed by *************************, attached. We were NEVER told it was a Deposit and the receipt clearly states APPLICATION FEE. So we applied under the information given by whomever was handling ****** business phone number. And were not told otherwise until we came to sign the contract. Again, we are simply requesting the APPLICATION FEE, paid under false information, refunded.

      Regards,
