On July 18, 2021, Mr. W**** received a 1/2 deposit payment of $2000.00 for replumbing under my mothers pier and beam house. She resides in the home, bedridden and on hospice. I was NOT told that deposits are non-refundable and it is NOT written on the invoice receipt. There is NOT a written and signed contract for the job. Mr. W**** called me later that week and informed me that there was mold under the house due to drainage issues with the HVAC system. He said he was unable to continue with the job until I made his worksite "safe" and I needed to get someone to fix the HVAC drainage and get a mold remediation company out to take care of the mold before he could continue with the job. Mr. W**** did NOT go under the house prior to providing an estimate for service and receiving deposit, otherwise he would have seen the mold, thus changing the terms of the verbal contract AFTER receiving payment. A plumber fixed the HVAC drainage and felt the mold present did not warrant remediation. He also gave an estimate to re-pipe since Mr. W**** had stated that he would not continue the job until the mold was remediated. Mr. W**** initially refused to refund the deposit, stating that it was "wrong to do what I did" and that I was putting "that poor old woman's" health in danger. Also stated that it was common knowledge that deposits are non-refundable. On 7/24/21, Mr. W**** texted that he would refund the deposit "inside of 30 days". On 8/31/21, I sent a reminder text and he responded that he would make sure a check was mailed. 9/14/21, no refund. Mr. W**** set up a payment schedule HIMSELF of $500 in 4 installments with dates. He refunded $500 on 10/25 and is now refusing to refund the remainder AFTER texting on 11/5 asking if the prior method of payment was OK. On 11/13, he texted he was NOT refunding the remainder and sent a fraudulent backdated invoice for the remaining 1500.00. This WILL go to court if not paid by 1/31/2022.
