    On July 6, 2023, BBB requested that Lune substantiate, modify, or discontinue advertising claims which were made on various pages on their website https://www.luneusa.com/ 


    Objective Superlative Claims:

    The business claims “the #1 trusted nerve cream,” “trusted by specialists around the world and consistently rated as the #1 solution,” and other similar claims. According to BBB’s Code of Advertising, “superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like ‘#1 in new car sales in the city,’ can be proved or disproved.”


    Claimed Results:

    The business claims to “soothe painful, tingling, burning nerves,” “we are here to help you break free from the limitations of neuropathy pain & nerve discomfort,” “dilates blood vessels to promote circulation,” and other similar claims. According to BBB’s Code of Advertising, “claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data.”


    “Made in USA” Claims:

    The business claims the following: “all Lune supplements and creams are proudly made in the USA,” “made in the USA” and other similar claims. According to BBB’s Code of Advertising, “‘made in USA,’ and similar terms used to describe the origin of a product must be truthful and substantiated. In general, all or virtually all of the product must be made in the USA. Qualified ‘Made in USA’ claims can be made under certain circumstances and with appropriate disclosures.”


    Superiority Claims – Comparatives – Disparagement Claims:

    The business claims the following: “unlike most product on the market, Nerve Balm helps get to the root of the issue and promotes healthier nerves overall,” “there are no other similar products on the market,” and other similar claims. According to BBB’s Code of Advertising, “deceptively or falsely disparaging advertising of a competitor’s products or services must not be used.  Comparisons should fairly reflect all aspects of the products or services equally.”


    Testimonials and Endorsements: 

    The business has the following claims: “I have diabetes and this truly helps with the horrible burning in my feeet.” “The doctor told me nothing could be done for the shooting neuropathy pain in my feet, but these capusules helped tremedousl,” and other similar claims. According to the BBB Code of Advertising, “advertisers should ensure that testimonials and endorsement are not misleading and represent the current opinion of the endorser. A consumer endorser’s experience should reflect what users generally achieve, unless there is a clear and conspicuous disclosure of what the expected results will be.   Advertisers should not include claims in testimonials that they themselves cannot make and support.”



    Basic Principles of the Code:

    The business claims “if your nerves ache, burn, sting, tingle... then they are crying for help,” “don't just numb the pain, fix it! damaged nerves may worsen with time if not addressed, that's why it is important to choose a solution that isn't simply covering up symptoms,” and other similar claims. The BBB’s Code of Advertising also states that, “the primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any claims or offers made before publication or broadcast and, upon request, present such substantiation promptly to the advertising medium or the Better Business Bureau.”


    As of August 28, 2023, the business hasn’t fulfilled BBB’s requests to substantiate, modify, or discontinue these claims.
