      In March 2021, I accepted your proposal to replace our deck with tax, pergolas, railing and partitions, for $ 13,500, at **** ** ****** ******. I paid you on 9th March and 30th July a sum of $ 6,500 and $ 1,400, respectively through checks drawn on Wells Fargo Bank. Since then you expressed difficulties in getting the material until late September 2021, medical issues in the family in October and November of 2021, and in January 2022. As a gentleman, I accepted all of your statements on the face value, and consequent delay in completing the work. Most recently, you stated the material will be delivered in late March 2022. However, that delivery did not occur. I have tried to contact you on several occasions and left hundreds of voice mail messages on your phone. Less than one percent of my several hundred messages were returned. The delay including the lack of attention has caused considerable anguish, and hazard. Under the circumstances, I will appreciate your submitting the latest plan to prosecute and complete the work on or before August 26, 2022 with completion no later than September 30, 2022. In the event of your failure to comply with the afore said schedule, you will compel me to terminate the contract for non performance including abandonment, and to take appropriate and necessary actions seeking compensatory and punitive damages for non performance, failure to deliver the material, and creating hazardous conditions at the site at your risk and consequences. Again, as a gentleman, I am willing to work with you, but your silence in responding to my message or making firm commitments to complete the work is unacceptable and unprofessional.

      When we hired Mark D***** and his firm in June, 2021, the company's reviews were great. We got two other bids and went with Technique because the bid was competitive and he had an idea how to work our new deck around our existing wisteria and lilac. The job required tearing out the entire old deck (not attached to the house). This was not a big job, so we assumed we were not a high priority, but we still coughed up close to $5000 up front, then had to pay a little more when he realized he had mismeasured and we needed a few more feet of railing and Trex. The construction team showed up late in the summer to tear out the old deck, and we assumed that the new deck would be installed shortly after. Well, it's almost 14 months later and what we have is an infrastructure that's been sitting there so long the paint they used on the wood is now peeling in places and Trex that's been laid on half the infrastructure, leaving a hole we can't step across safely to enjoy what deck we have. The stairs were framed but not finished, so we can't even walk our deck furniture up onto the deck. We kept thinking "they can't take any longer" so left the furniture out, and it suffered damage over the winter. We're getting treated the same as many other people are pointing out (look on Home Advisor, who connected us with these guys). Pretty much the last insult was that (bear in mind the contract asked for half up front, then partial pay of the balance as the work progressed, which is pretty standard) was Mark asking for the entire balance a few months ago because "prices have gone up so much since I made the bid, I need you to pay now just so I can afford to buy the materials." We have at this time no evidence that he took our money without planning to complete our project. Attached are photos of deck as is 14 months after contract made.

      On June 27, 2021 my wife and I signed a contract with Mark D***** to complete a deck for us and paid a deposit for 7140. Initially we were told that our project would start at the end of July and be completed by no longer than the end of Aug. After several months of contacting Mark and his team finally showed up and for the most part framing was finally completed on Oct 14 except that he had not measured the desired length of the deck, so we had to negotiate an upgrade, we paid 1944 for the framing along with 1250 for the upgrade. Several voice mails and text messages began along with additional excuses as to why he or his team couldn't come out. His crew showed up every now and then and did the minimum throughout this time. On Wednesday Feb 9 he called asking what time I went to work so I could pay in advanced for the trex. Mark said, “If you write me a check, I can have my son **** pick up the trex and get it started, it will be done by Friday”, 02/11. I reminded Mark about the contract we had and how it stated that I would make payments after each of the three stages were completed to which he responded, “I know, it’s just going to take longer”. Unfortunately, we gave him the check and he didn’t deliver. We decided to put a hold on the check and told him he would get paid when he finishes. He got angry and threaten us with legal action. I offered him to pay his supplier directly for the materials so he could just pick them up and install them, pay him immediately in cash for the difference after the installation but he did not reply. I have so far paid 10300 dls, it’s been over 8 months, the deck only has a third of the trex installed and I have no idea if he’s ever going to show up to finish at least the trex part.

      On June 16, 2021 we signed a contract with Mark D***** to complete a deck for us and paid a deposit for $4,221. Initially we were told that our project would start at the end of July, after several months of contacting Mark, his team finally showed up to tear our old deck out on September 28, 2021. From there it became increasingly difficult to get Mark to respond to both voice mail and text messages. Framing was finally completed on October 25, 2021, and an additional $1, 155 was paid along with $330 for additional awning supplies he purchased. I notified Mark on October 29th asking how difficult it would be to drop our deck lower and he said it wouldn't be too hard and explained what it would take. Several voice mails and text messages began along with additional excuses as to why he or his team couldn't come out, or that something medical was going on with him or his wife, or that he was waiting on supplies. On November 15th, I sent a text message to Mark letting him know that I had filed a formal complaint with Home Advisor who provided him as a referal. Mark's response was that we were done and good luck getting our deck completed. Mark owes us the rest of our deposit for work not completed, the total sum being $2,961. Two additional texts were sent to Mark requesting the money be returned to us. As of today, I haven't received the money or heard when we can expect to see it back. To get Mark to complete any part of our project I had to ask if we should just get our money back and go elsewhere and then he or someone from his team would show up, do the bare amount of work possible and leave. It should be noted that I heard from Mark on several occasions that "no one messes with him, and that he doesn't put up with anything from anyone." I felt intimidated by him and felt that he used his medical conditions and those of his wife to gain sympathy for their situation so we felt connected to him. He is deceitful and dishonest.

      On March 29, 2021 my husband and I signed a contract with Mark D***** to have our deck replaced. Attached is a copy of that contract. He told us then that they would begin project in May. We gave him a check for $10,400 as a deposit to lock in the price. Mark told us at that time it would take a few weeks to complete the project once the project was started. We have kept a log of contacts, which is also attached. Framing was almost complete on September 22,when Mark asked for an additional $1,900.00. The following day the footing were poured. No work has been done since them. After attempted contacts with little results we wrote and email to Mark of which a copy is attached expressing again our concerns. Today Mark called my husband to say he will be here on Saturday to bring and install the posts for the deck. We hope you can assist us by putting pressure on Mark to complete this project.

      Mark D***** responded to me from Angie's list on June 28, 2021. So he gave a bid in the backyard landscaping on June 30,2021, He came to my house in July 1, 2021 asked for the 50% of $23,637.00 down to lock the price of the materials. I asked when is the job to start because of our HOA deadline he said the job starts on the 3rd week of July, he's no show. So we contacted in Aug. 9 & there's no response. Came Aug. 16, still nothing. So on Aug. 18th we asked to refund us the $11,818.00 which was the down payment. He sent his crew on Aug. 19th & partially graded our backyard. They said they're coming back the following Monday.They did not come. So on the August 31 I asked when are they coming back? The foreman Luigi said these week for mulch and soil. So I asked how about the drain system? He said it's done, but he lied & it's not installed. On Sept. 18th, requesting refund after the texting back & forth with Mark, instead he refused and told us to get an attorney.

      MY FATHER **** ******* (93) and I HAD MARK COME TO THE HOUSE AND GIVE A BID TO REDUE OUR FRONT YARD. THIS WAS ABOUT THE 2ND WEEK OF MAY WE HIRED HIM SIGNED A CONTRACT AND HE TOLD US WE HAD TO PAY HIM 1/2 UP FRONT TO SECURE A SCHEDULED TIME. WE PAID HIM $5755 ON 6/7 HE TOLD US IT WOULD BE MID JULY BEFORE HE COULD GET TO US. HE HAS PUT US OFF SO LONG THAT I HAD TO LEAVE UTAH. I WAS THE PERSON THAT MY FATHER TRUSTED TO DESIGN AND CARRY OUT THE COMPLETION OF THE JOB. I PUT MY LIFE ON HOLD ALL OF JULY (I LIVE IN AZ) TO STAY IN UTAH TO WATCH AND OVERSEE THIS DESIGN. I FINALLY HAD TO LEAVE AND GO TO PORTLAND AUGUST 18TH. HE TALKED TO ME ON THE 16TH AND SAID HE'D COME BY TO TALK TO ME AND EASE MY MIND BEFORE I LEFT, BUT FAILED TO SHOW. I TOLD HIM THAT WE NEEDED OUR $ BACK SINCE I WAS NOT GOING TO BE THERE AND HE DIDNT KNOW MY VISION. HE WILL NOT RETURN MY CALLS AND MY 93 YEAR OLD FATHER NEEDS HIS DEPOSIT BACK. HE IS DISHONEST AND A HORRIBLE HUMAN WITHOUT A CONSCIENCE
