Micheal W******* had pitched his landscaping work and sent a quote on May 28, 2022. I signed the quote for landscaping services including installation of artificial turf, concrete pads, metal edging, in-ground trampoline for a total amount of $38,635.00; a deposit of $19,317.50 (50% of the quoted job) was required to schedule and begin work to start on July 10, 2022. We gave him the check on June 3, 2022. From June 3, 2022 through December 2022 we dealt with Micheal W*******. He reassured us via text messages on more than 12 separate occasions that we were his “next job” or that we were “two weeks out”, basically stringing us along. Eventually winter set in and we were waiting on December 5, 2022 to have our job started. We did not hear back from Micheal W******* on Dec 12, 2022 onwards. There was no communication from Micheal W******* until my husband, **** ******* reached out via text message on March 28, 2023 as the snow in the yard was beginning to melt; there was no response. **** then tried to phone Micheal W******* on April 13, 2023 to find out the phone number was disconnected. **** then emailed Mr. W******* at **************************** to inquire about when our job would be scheduled. **** received an email response from Micheal W******* stating “I [Mr.W*******] currently live in Florida and have 0 intentions on returning” to start and finish our job. As of today, zero work has been started on our yard. Micheal W******* has expressed that he’s left the state of Utah with no intentions to return. He has no intention to start and complete our job pursuant to contract despite our sustained efforts to coordinate with Mr. W******* to get our job scheduled and started. Mr. W******* has not returned any portion of our $19,317.50 deposit. He remains elusive and unresponsive, he has taken down his website and company listing on Google and Facebook, changed his phone number (disconnected ###-###-#### which we called him on 4/13/2023).
