      I purchased a vehicle on 02/09/2021 paying up front on the vehicle 46,500d ollars to have updates on car .over and over he promised my vehicle still after 3 years I haven't received it I have the title. I asked them several times to just refund my money but he said the car is almost done. Now he won't answer my phone or texts

      We have spoken to ******* and have agreed together that he will have his car finished within 30 days as he has requested. We had a shortage on labor which put us behind on his build. We have also added a few items (Valued at more than $5000) to the build to make it up to ******* in an effort to make up for the delay.

      1st off, I am clearly an idiot for getting involved with SBMG. This all started when my brother put down a deposit on a custom build with SBMG in early 2021, with the promise the vehicle would be complete by Oct 2022. His excitement slowly turned to concern when after a year he was getting little to no information and no vehicle progress, to the point that he requested that I get involved and maybe he was not being patient enough. I quickly learned that he was incredibly unresponsive, to the point that my wife and I flew to UT to see what was going on. What we found was a super nice guy and a busy shop with super cool cars. He really gave a good feeling, and sort of made us understand what was taking so long in the process. To us, who do not fully understand the process, it sort of made sense. He proceeded to dazzle me and showed me a possible build he would sell to me for a super great price. So on June 21, i sent 10K down payment based on his text on June 17, which i will include, stating he needed the money by Monday June 20, in order to hold the motor and transmission that he got a smoking deal on. Continuing on with 2022 nothing happend on my brothers truck, no movement. So we went back to see what was going on. At his shop, again, little to no movement on completing the vehicle, at this poing my brother was almost 18 mos in and had paid over 70k to SBMG. Again, he dazzled us with BS, and I found myself giving him another Payment for 10k. Between then and now, still nothing. I hired a mechanic to go to his shop to see what is going on, since i needed someone with expertise to see what was going on. They wrote a report dated 3/7/2023 which i will also include. Specifically with my K10 truck, nothing at all was done, and the engine and transmission which he need the money for last June in order to get the engine and transmission, Shaun told the inspector that he has procured no parts at all for the vehicle. He has missled for almost 2 years. I want all my $ back

      Our business actually entered into a refund agreement with **** on March 3, 2023 to have a full $20K refund complete by the end of April 2023. It was agreed that an initial $5K would be refunded as quickly as possible with the balance in full before the end of April 2023. A $5K refund was issued on March 17, 2023 and the full balance of $15K on April 28, 2023.

       

      We understand there are always two sides to every story. Here is what we recall. When **** ******* first came to our business with his wife on May 20, 2022 it was indeed to check on the 1971 Blazer build for his brother ****. They were concerned for how long the restoration was taking. We showed **** and his wife ****’s 1971 Blazer. We also showed them our shop, the process in which we restore these classic vehicles, and several actual vehicles we were restoring at the time. After showing them, **** inquired about an orange 1965 K10 we had on our lot. After some discussion, **** expressed a great interest in having us restore the 1965 K10 similarly to his brother’s Blazer. **** asked if it was okay to make smaller deposits every 2-3 months as they were using a large amount of their other funds on something else in the near future. I let him know that was fine, but that restoration work would only commence on his 1965 K10 once the deposits reached 50% of the build price(Text Screenshot Explaining this Attached). This is our standard build restoration process. On June 17th 2022 I did let him know I could get a good deal on some of the powertrain items (motor & transmission) for his build if he were to decide to pull the trigger within a few days. We sent him a build quote for $65,000, and he sent $10,000 initial deposit on June 20 2022. We did purchase said items and placed them in our inventory. On October 27, 2022 **** came out to visit with his brother. We showed them where ****’s Blazer was in the process and even showed **** where his motor was in a crate along with other parts we had purchased (Attached Images of Parts Prior to 2nd Visit Dated July 2022). We did not intend to dazzle or deceive during their visit. We simply showed them first hand where things were in the process. We shared that we had been experiencing delays outside of our control and that is why our current builds were taking longer than expected. Things like labor shortage, supply chain issues, and weather and space constraints at our current location, etc. **** and **** were satisfied enough to continue and even proposed once their builds were finished, we engage in further business / builds. Without requesting such, two days later **** gave us an additional deposit check of $10,000 in person towards his 1965 K10. This made the amount received $20,000 out of $65,000. 

       

      On March 2, 2023 **** sent me a text requesting a full refund of $20,000. I called **** and we discussed the situation over the phone. I reminded him that work on the 1965 K10 wasn’t to commence until we received 50% deposit. He said that he was backing out because of how slow his brother ****’s Blazer was taking. On March 7th a vehicle inspection company showed up to do an inspection on both ****’s Blazer and ****’s K10. I personally showed them each vehicle and when the inspector asked me about the work on the 1965 K10, I explained that work had not commenced and the 50% deposit had not been fully paid. They asked about any other parts for the K10 and I simply said we had not started work on it yet. Even though we had purchased the engine block and other parts several months earlier, those items were still in our inventory. After the On Site inspection **** and I had some further discussions and we agreed that we would oblige his request of the refund. It was agreed that we would send him $5000 as soon as possible (2 weeks roughly) and the balance before the end of April 2023. We made the initial $5000 deposit via PayPal on March 17th. There was some delay with how PayPal processed the payment and it did take a few days to clear, but this was outside of both of our control. Even though the payment was sent and pulled from our bank account on March 17th(Image Attached), the $5000 finally cleared ****’s account on March 30, 2023. We agreed to talk on Monday April 3rd. We discussed that the remaining $15,000 would be paid on or before the end of April. On April 4th **** sent me a text message asking that this all be taken care of “this month” and asked me “so what will you be doing and when?” I replied, “The plan is to get you paid this month.” I could not give an exact date as we were in the process of gathering additional funds for the refund, but but I felt my text conveyed to him it would be done on or before April 30, 2023.

       

      On April 17, 2023 we received a letter from Better Business Bureau dated April 5, 2023 regarding a complaint from ****. It should be noted we received the letter after the requested respond date had already expired. We were bewildered by this as we had already had many conversations about the refund and were demonstrating good faith and actions to such having already sent $5K to him. There was no mention in the complaint where SBMG & **** had both agreed to the refund process and that **** had already received $5K of the $20K. I called **** to get clarification why the complaint was filed *after* we had already agreed to a refund process and had already complied with the first part by refunding the initial $5K. I expressed concern that this was an unnecessary move and it would affect our BBB business profile unnecessarily by having a complaint filed long after we had agreed to a resolution that was being fulfilled currently. I don’t recall exactly what his reasoning was, but it mostly had to do with I did not give him an exact date in April 2023 that the remaining $15K was to be sent. I tried to explain that I could not have given him an exact date as we were in the process of acquiring the funds, and that my reply of “The plan is to get you paid this month.” (April 2023) should have been sufficient and that by the fact we had already processed the first $5K, he should have had no reason to expect any different for the $15K balance on or before the end of April 2023. We talked in circles for a bit, but at the end of that conversation **** agreed that while we would most likely not be able to have the complaint removed from our BBB profile, he agreed to request that the narrative/commentary of his complaint be removed.

       

      On Friday April 28, 2023 we deposited the balance of $15,000 into **** *******’s Chase Bank account completing our agreement initially discussed on March 7th 2023. (Attached images).
