On July 29, 2022, First American Payment Systems and two of its sales affiliates, one being Eliot Management Group (Eliot) agreed to an order with the Federal Trade Commission (FTC). The complaint alleged these businesses engaged in a number of harmful practices against merchants including; deceiving businesses about pricing and savings with hidden terms; imposing surprise fees when small businesses try to cancel; using an online enrollment system that obscures key contract terms; and hitting small businesses with zombie charges after they withdraw consent accounts.
Under the Settlement the defendants have agreed to stop misleading customers, stop unauthorized bank withdrawals, make cancellation easier, stop charging existing customers early termination fees and to provide $4.9 million to refund affected businesses. Eliot Management Group denies all allegations made by the FTC, and there have been no findings or legal conclusions that Eliot violated any law. Eliot agreed to enter into a settlement with the FTC to resolve the matter quickly and focus its energy on servicing its merchants and providing customer support.
