On 01/27/2022 the business entered into a settlement agreement with The Division of Consumer Protection of the Department of Commerce of the State of Utah. The settlement alleges that the respondent collected from insurance companies $61,934.13 in excess of the price limits set forth by the PCDEA. Claims related to the $61,934.13 are collectively referred to hereafter as the “Alleged Violations.” Under terms of the settlement, the business agreed to a fine of $6,193.41, which, upon execution of this agreement, the respondent shall pay to the Division via certified funds made payable to the Utah Division of Consumer Protection. For each insurer that made overpayments, the respondent agrees to write off the corresponding amount for each insurer. For any insurers that are owed money as part of the overpayment that does not have any accounts receivables due and owing to the respondent, the respondent will promptly make a payment to the insurer for the respective amount due and owing as part of the overpayment. The respondent agrees to provide proof of the refunds to the Division within 60 days from the execution date of the agreement. For any services provided by the respondent during the emergency period, the respondent agrees that as of the execution date of this agreement, it will not collect, attempt to collect or charge insurance companies beyond the maximum charges. The respondent agrees to comply with all statutes enforced by the Division as contained in Utah Code § 13-2-1, including the PCDEA. The agreement was for settlement purposes only and should not be considered as an admission of guilt or finding of a violation of the law.
