March 2024. ***** created a contract with a speechless stroke victum unable to understand or initial contract. Consequently, the next day I requested and received a filled out form cancelling contract 0331-41007598 stating credits i. The amount of $570 applied to refund. Today, I received a bill for ongoing monthly payments of $85.27. Consequently, after calling customer service at **************, I learned the contract hasn't been canceled. Finally, I went to Wasatch Lawn and spoke to ***** and gave him the account statement and a copy of the cancellation form. Since the canxellation occured within 3- business days - actually the following business day, I need an authoritative phone call to put pressure as BBB helped before when I had an issue.Business response

On March 16th we were asked to write a contract for property and services for the complainants friend. He selected the options and offered to pay with a credit card without her present. We required that we meet with the person the plans were being completed for so arranged to go to the care center to meet. With the friend present, we presented the plan to the person and did get agreement with both her and her friend.
A few days later the friend came to the office and asked us to cancel the contract. We agreed to help with the process and had him fill out the appropriate form. Since he was neither the purchaser nor the beneficiary we needed the approval of the person who purchased the plan. We visited the care center and met with the staff regarding the situation. They promised to speak with the purchaser and call us back. The staff member took over 10 days to get back with us but confirmed that the friend was the only family she had and far as they could determine.
A few days later the complainant brought in court document supporting our ability to work with him as her personal representative.. We processed the cancelation and refund to the beneficiary and it was given to the complainant three days later.
This issue was worked and resolved in the course of normal business and we followed all required steps to insure the correct payment went to the estate of the purchaser rather than a friend.
