      On June 26, 2024, we received notice regarding a complaint filed against Foursight Capital (Foursight) through the Consumer financial ****************** Foursight is committed to providing the best possible customer service, so we have investigated the complaint and made the following determination.

      On October 27, 2018, *************************** signed a contract to borrow funds from Foursight Capital for the purchase of a 2015 *** 650i from ***** Motors, in *********, ********  The terms agreed to on this contract were 75 monthly payments of $694.75 at an annual percentage rate (APR) of 9.99%.  

      The Fair Debt Collection Practices Act (FDCPA) specifically identifies ************************* as third parties that *** be communicated with about a debt.  Foursight takes our responsibility as a data furnisher seriously and is diligent about reporting data that is accurate and complete.  Any payment that is received beyond 30 days of the account due date is considered a delinquent payment and is report to the credit bureaus as such.
      We have investigated and have concluded that the information being reported to the major credit bureaus is an accurate representation of the performance on this account.

      As a customer of ********************** LLC, my experience has been nothing short of frustrating and disappointing. This review aims to shed light on the company's questionable practices and inadequate customer service.One of the most concerning aspects of dealing with FOURSIGHT CAPITAL LLC is their use of foreign call centers. This not only creates a language barrier but also adds to the confusion and frustration when trying to resolve issues. Communication becomes cumbersome and ineffective, leading to misunderstandings and unresolved concerns.Furthermore, my experience with FOURSIGHT CAPITAL LLC was marred by unexpected financial burdens. Upon registering my car from a Chevrolet dealership, I was shocked to discover over $3,000 in taxes due to late documents. Despite my attempts to explain the situation, FOURSIGHT CAPITAL LLC remained adamant about the payment, resorting to incessant calls every day until the amount was settled.What's more appalling is their inflexible payment policies. As someone who gets paid on the 3rd of each month, I found it challenging to meet their payment deadlines. Missing even a single payment or making a late payment due to personal financial constraints resulted in dire consequences. FOURSIGHT CAPITAL LLC would threaten to terminate my contract, putting my car at risk of repossession.Their insistence on charging a fee of $10 to change payment dates is ludicrous, especially considering the potential payment issues it could cause later on. It's evident that FOURSIGHT CAPITAL LLC prioritizes profit over customer satisfaction, making it increasingly difficult for individuals like myself to manage their finances responsibly.To add insult to injury, a deferred payment that was supposed to be processed in November of 2023 was delayed until December, despite numerous attempts to rectify the issue with multiple representatives. This mismanagement further exacerbated my financial woes and left me scrambling to catch up on payments.In light of these experiences, it's baffling how FOURSIGHT CAPITAL LLC fails to acknowledge the economic hardships faced by the majority of Americans due to inflation. Instead of working with customers to find viable solutions, they employ aggressive tactics that only serve to worsen the situation.In conclusion, my interactions with FOURSIGHT CAPITAL LLC have been nothing short of a nightmare. Their unfair practices, poor customer service, and lack of empathy towards customers' financial struggles make them a company to be wary of. I urge others to exercise caution when considering doing business with FOURSIGHT CAPITAL LLC, as their actions demonstrate a blatant disregard for customer well-being.

      On February 16, 2024, we received notice regarding a complaint filed against Foursight Capital (Foursight) through Better Business Bureau. Foursight is committed to providing the best possible customer service, so we have investigated the complaint and made the following determination.

      On November 28, 2022, ******* ******* signed a contract to borrow funds from Foursight Capital for the purchase of a 2017 Dodge Journey from ***************** in *********, ********.  The terms agreed to on this contract were 72 monthly payments of $412.66 at an annual percentage rate (APR) of 17.00%.  

      The contract ****************** entered with Foursight is a simple interest contract.  With a simple interest contract, interest accrues daily on the outstanding principal balance of the loan.  Daily interest charges are calculated using the APR and the remaining outstanding principal balance.  Accrued interest is paid first, then any remaining balance is applied to outstanding fees and principal. Mr. ******** monthly payment is due on the 28th of each month.  He has a 10-day leeway each month that allows an additional 10 days for him to make a payment without a late fee. Foursight offers one due date change over the life of a loan.  Because this is a contract modification, there is a $10.00 fee associated with this change.  ****************** has requested a due date change twice but has not logged into our website using his secure credentials to complete the contract modification.  This is still available to him by calling us at ************ during our normal business hours.
      Foursight also offers a holiday deferment program, which modifies the original contract terms and moves one payment to the end of the loan.  This program is available to all eligible customers during the holiday season and was automatically activated online for ****************** on November 1, 2023.  He processed his holiday deferment on December 9, 2023, using his secure credentials.
      Foursight has been contacting ****************** since February of 2023 regarding the registration of his vehicle.  In ********, a resident is required to complete registration with the State or County within 30 days of the date of purchase.  Any fees or taxes are assessed directly to the customer by the State or County and must be paid at the time of registration.  We are still working with ****************** to obtain his registration for his vehicle.  

      Our success is based on customer satisfaction with our products and services, so we take the issues presented by ****************** seriously and have made every effort to provide a prompt and equitable response.    We believe this matter is resolved but invite ****************** to contact us at ************ during our normal business hours if he wishes to discuss these concerns further.

      traded in truck that had the loan for another truck at rayskillman auto group. *********** sent payoff check per loan payoff report obtained from foursights user login portal also called in to speak with rep to confirm. A month after payoff recieved a call my account was past due called in they stated they were sorry and didnt cash the check they recieved yet costing my the aquired daily interest in wich i went ahead and paid in full. Then feb 1st got another call saying my payment was again past due and they still have not closed the account. trying to charge me again for the vehicle and keeps calling harrasing.

      On September 7, 2023 ******************************* signed a contract to borrow funds from Foursight for the financing of a 2014 Jeep Wrangler.  The terms agreed to on this contract were 72 monthly payments of $600.53, at an annual percentage rate (APR) of 14.54%. 

      Foursight received a check on January 18, **** from *********************** with instructions to release the title to the collateral to them upon receipt.  Unfortunately, the check did not cover the payoff balance due on January 18, ****.  It is our policy not to accept payoff checks with instructions to release title that do not satisfy the loan balance in full.  Foursight continued to make contact with both the ******************** and *********************** regarding this short payoff and payments due according to the terms of the contract.

      ******************** payoff was completed on February 2, **** and payoff was backdated to January 18, **** to avoid additional interest accrual.  No additional fees or credit marks applied to his account. 

      We want ******************** to know we thoroughly researched these concerns. Our success is based on customer satisfaction with our products and services so we take the issues presented in this complaint seriously and make every effort to provide a prompt and equitable response.       I am rejecting this response because: a lot of details are left out to include the first attempt on payoff in December which they also stated check did not cover the payoff. Which in return we did a payment that day on the phone so the issue would be corrected. After that payment was done I was emailed a reciept and told the title would be released. Then found out in January they tried to get more money even after stating I had a reciept and an email saying it was already satisfied even though I came out of pocket personally they got *********** for more money. 

      So I am rejecting it due to these facts which can be proved and the company didnt even attempt to return my money but instead claimed to *********** they never got it and got them for more.

      On September 7, 2023 ******************************* signed a contract to borrow funds from Foursight for the financing of a 2014 Jeep Wrangler. The terms agreed to on this contract were 72 monthly payments of $600.53, at an annual percentage rate (APR) of *****%.
      We appreciate the additional information that ******************** has provided and will provide additional detail regarding his loan payoff.

      Foursight received a check on January 18, **** from *********************** with instructions to release the title to the collateral to them upon receipt.  Unfortunately, the check did not cover the payoff balance due on January 18, ****.  It is our policy not to accept payoff checks with instructions to release title that do not satisfy the loan balance in full. We reached out to *********************** as well as ******************** on January 18th to notify them both of the short payment.  ******************** responded the same afternoon and spoke with an agent who advised him of the situation.  ******************* paid the short balance of $27.05 promptly, that payment was sufficient to close his account.  Due to an internal miscommunication, the short payoff check was not applied on January 18, ****.  We apologize for the inconvenience that this has caused and the additional steps that ******************** has had to take to resolve his account.  When this issue was discovered,Mr. ********* payoff check was applied and backdated to the date of receipt,closing his loan with no payment delinquency or additional interest accrual.
      ******************** is correct that *********************** did send the short payoff check that was requested of them on January 18th.  This check was not cashed and was mailed back to them as there was no additional balance due.

      Our success is based on customer satisfaction with our products and services, so we take the issues presented by ******************** seriously and have made every effort to provide a prompt and equitable response.  Foursight has high internal standards of customer service and understand that we did not meet those standards for ********************. On February 11, 2017, ************************* signed a contract to borrow funds from Foursight for the purchase of a 2017 ****** Altima from *******************.  The terms agreed to on this contract were 75 monthly payments of $458.11 at an annual percentage rate (APR)of *****%. On January 3rd, ****, Foursight received payoff for Mr.******** remaining loan balance from *******************.  The check that was dated December 29, 2023, was received and posted to his account the same day.  Mr. ******* credit was not impacted for any activity that took place on his account after his loan obligation was satisfied, however, any payment that was made beyond 30 days after his contractual due date prior to payoff was reported to the major credit bureaus.  Foursight takes our responsibility as a data furnisher seriously and is diligent about reporting data that is accurate and complete.  We have investigated and have concluded that the information reported to the major credit bureaus is an accurate representation of the performance on this account.       The vehicle is mine. Purchased in August. THERE HAVE BEEN NO INQUIRIES ON THE VEHICLE FOR FINANCING OR REFINANCING. Foursight are stating an inquiry was made by a company called Autopay in November and this is impossible. They have submitted a fraudulent inquiry on my credit report. They are the furnishers of the inquiry onto my report so they are the ones that have to remove it. It's fraudulent. Didn't exist. Never did. Never will. Foursight keep trying to say they are not the ones who put the credit inquiry on my report even though the fraudulent credit inquiry shows FOURSIGHT. They also state they don't process credit (so why is their name on my credit report?!) ''We don't process credit. Dealers or third parties do. Autopay is a refinancing company. You are welcome to contact them or to do a credit dispute through the credit bureaus. ''You cannot have direct contact with our credit department, and for disputes they will reply within 30 days.'' ''Autopay is an auto loan group that works with other lenders to finance loans, they sent the application in for you, and you received an inquiry from us. You will need to reach out to Autopay, you can find them online, and they can give you more information about it. We have provided you with a dispute response in regards to an application they submitted for you. You will need to contact them for more information about the credit application.'' They then refuse to deal with me via email or phone- ''Our credit dispute/inquiry response are sent via mail in 30 days. The request is sent to our credit department, and they investigate and send out the letters. We cannot discuss it further over the phone or via email. You received a letter responding to the credit inquiry. The letter states to contact Autopay since they are the ones who submitted the application under our name. Contact them.'' What does they submitted it under our name even mean?! Anyway, there has been no submission by me on a vehicle I already own. No financing or refinancing was made. This is clearly fraud and they are refusing to remove the credit inquiry that is on my report under THEIR name.

      We have researched the credit inquiry and found that AutoPay submitted an application for credit to Foursight Capital LLC, on November 7th, 2023, requesting consideration to fund an auto loan for the purchase of a 2023 **** Truck Bronco Sport for **************************  Foursight declined the application.  
      If ************************* believes this application to have been the result of ID theft, we will be able to further investigate the matter, if provided additional information. To facilitate this process, we will forward the necessary information and forms to the given address.

      I am rejecting this response because: the company could now have got my details to process an inquiry as these were never provided to anyone other than the **** dealership in August and they only ran it through capital one, no other lenders and this was in August. I still have received zero response from a supervisor as I have requested 12 times.

      Foursight Capital LLC is kicking back payments in order to charge fraudulent NSF, late fees, Assessment - Returned Payment Fees, Convenience Fee, and Assessment - Convenience Fee. This has been told by many others. I have payment protection from my bank. My bank account is protected from NSF!!! Someone should do something about this fraudulent company. Don't believe what they respond with, that is fraudulent as well.

      On November 17, 2023, we received notice regarding a complaint filed against Foursight Capital (Foursight) through the Better Business Bureau. Foursight is committed to providing the best possible customer service, so we have investigated the complaint and made the following determination.

      On September 17, 2021, *********************** signed a contract to borrow funds from Foursight for the purchase of a 2016 Chevrolet Cruze from ****************** in ****, ******.  The terms agreed to on this contract were 75 monthly payments of $293.20 at an annual percentage rate (APR) of 12.00%. 

      **************** and her co-borrower contacted Foursight on August 30, 2023 and advised they would be setting up a bill pay with their personal bank.  We accept bill-pay payments, however, we are unable to manage how each bank sets up and submits customer payments through this method.  Most banks pull funds as instructed by the customer during a set up process, then issue a check and mail it to our payment processing center where we receive the payment within **** days on average. 
      Foursight was contacted by **************** on October 6, 2023,she advised us that her bank returned her bill-pay stating that the payment was set up with an incorrect payee.  Foursight has no record of a check being received around this time from **************** and is unable to assist with her ******************* pay return process.  Foursight accepts payments through various methods for the convenience of our customers including options such as check or money order, Money Gram and ************* and debit card or ACH payments submitted through our secure website. 

      Foursight does not charge fees other than what is outlined in the contract.  Late fees are assessed after a 10-day leeway at the lesser of 8% of the unpaid amount, or $15.00, according to the terms of the contract. Returned payment fees of $25.00 are only assessed when a payment is not honored by the customers bank.  Convenience fees are charged only when a customer requests that we process a payment for them instead of using one of our various free payment services previously mentioned.

      After having contacted this company on 7/17/23 I was directly told by an associate what I would do against my will. So I explained what amount I would be sending. *** reached several annoying emails since that payment and spoken to Malo. Shes some supervisor that stated to me when we first spoke (and I did advise her that I would put rude practices and bad customer service on TikTok. When I contacted them today, I was speaking with an associate for 27mins when she placed me on hold and appeared Malo. She (I say she because I couldnt tell if it was a man or woman) stated that on my account, if I called in, I was to be directly transferred to a supervisor. So I explained to Malo that I was on hold because I asked a question about interest. She was supposed to be answering this question and now you appear. He asked was he being recorded. I asked him/her was I being recorded and it said yes. So I asked for their supervisor and I was told it was *********************** and she was going to call me back at the number he read off to me which was correct. I have yet to receive this call. So I contacted the company 3 more times and the call was automatically disconnected.

      On September 20, 2023, we received notice regarding a complaint filed against Foursight Capital (Foursight) through the Better Business Bureau. Foursight is committed to providing the best possible customer service, so we have investigated the complaint and made the following determination.

      On July 27, 2022, *********************** signed a contract to borrow funds from ***************** for the refinance of his 2013 Audi Q7.  ***************** assigned this contract to Theorem on July 27, 2022, and Foursight Capital has been named as the loan servicer.  The terms agreed to on this contract were 72 monthly payments of $502.43 at an annual percentage rate (APR) of 20.81%.  

      Foursight Capital was notified by ********************** on May 24, 2023, that the collateral was involved in an accident and had been deemed a total loss.  We received an insurance settlement in the amount of $16,540.90 on June 5, 2023, as well as a GAP claim payment of $1,677.21 on August 9, 2023.  We applied both checks to the principal balance of Mr. ****** loan, however, the amount received was not sufficient to satisfy his loan obligation in full.  According to the terms of the contract, ************** is responsible for the remaining balance of the loan including fees and collection costs.  
      Our agents had been in contact with ************** regarding the balance on his account, when ************** advised that he was recording the conversation, our agent advised that we do not consent to recordings.  Foursight Capital is held responsible to secure our customers private information, all recordings are encrypted and stored on a secure server.  Foursight does not consent to recordings made by a customer that we are unable to secure or authenticate.  The call with ************** was terminated and a request for a supervisor call back was submitted to our leadership team.   

      Foursight is currently unable to contact ************** as requested due to a cease-and-desist request submitted in writing on July 19, 2023.  He requested that all communication be directed to his attorney, ******************************  We contacted ***************************** on September 20, 2023, upon request for a call back, ******************** advised she would reach out to her client for more information.

Charges carried on and could have been with held.       They are charging me a NSF fee but the money is there. I don&#**;t know if they don&#**;t want to listen or don&#**;t care. They are saying it is my fault. The payment has never hit my account. I gave them the balance from 20th forward and the money has always been there. I made the payment with an agent named ****** on July 21 and the confirmation number is *******. I would like this NSF charge reversed.

      On August 23, 2023, we received notice regarding a complaint filed against Foursight Capital (Foursight) through the Better Business Bureau. Foursight is committed to providing the best possible customer service, so we have investigated the complaint and made the following determination.

      On June 7, 2022, ********************************* signed a contract to borrow funds from Foursight for the financing of a 2018 **** Fiesta.  The terms agreed to on this contract were 72 monthly payments of $289.23 at an annual percentage rate (APR) of 11.99%.

      ******************** contacted Foursight on July 21, 2023, to make her monthly payment. This payment was returned to us by Ms. ********* bank, unpaid, on July 26th, 2023.  Foursight was provided with a reason code of Invalid Account Number by Ms. ********* bank.  This error can occur when banking information has changed or was entered incorrectly. Once Foursight was notified, fees were assessed for a returned payment according to the terms of the contract signed with Foursight Capital.  

      On July 26, 2023, ******************** was contacted by Foursight to advise of her returned payment and the fees assessed to her account.  Upon review of the inbound call with ******************** on July 21, 2023, we were able to confirm that the information provided by ******************** was the information submitted to her bank.  We were provided with corrected information on July 28, 2023, and this payment was successful.  The account is current and in good standing.

      Foursight has waived the fees associated with Ms. ********* returned payment as a courtesy. We believe this issue has been resolved, however, if ******************** would like to discuss her concerns further we invite her to contact us for assistance at ************ during our normal business hours.

      Been trying to get them to change my due date but, they refuse to. Meanwhile they continually charge me late fees. Why should I pay late fees when they refuse to work with me and change my due date?! I told them I have multiple bills due on the 1st of every month but, none of these companies including Foursight want to change my due date to help me out. Over $1500 in bills due on the 1st every month for me but, I only make $700 per paycheck how am I supposed to pay $1500 in bills on a $700 paycheck?! I told Foursight about this and they don't care they just want to charge me excessive fees.

      On August 14, 2023, we received notice regarding a complaint filed against Foursight Capital (Foursight) through the Better Business Bureau. Foursight is committed to providing the best possible customer service, so we have investigated the complaint and made the following determination.

      On March 19, 2021, *************************** signed a contract to borrow funds from ***************** for the refinance of his 2014 Ram **** Crew Cab.  ***************** assigned this contract to Pagaya on March 19, 2021, and Foursight Capital has been named as the loan servicer.  The terms agreed to on this contract were 72 monthly payments of $504.51 at an annual percentage rate (APR) of 12.00%.  

      ************** contacted Foursight on July 13, 2023, and requested to change the due date of his monthly payment to the 15th of each month.  Foursight approved **************** due date change request and activated his contract modification agreement online.  ************** had 5 days to log into our website using his secure credentials and accept the terms of this modification as well as pay the $10.00 fee.  Because ************** did not complete these steps, his due date has remained the original contract due date of the 3rd day of each month.

      We have reactivated **************** contract modification request to move his due date to the 15th of each month and advise that ************** complete his request within the five days allotted to prevent him from having to submit this request again.

      As a courtesy we have waived the late fee that accrued on **************** account due to his July 2023 payment not being submitted prior to the end of his 15-day grace ************* The balance of $50.00 that remains is **************** responsibility according to the terms of his contract.

      We want ************** to know we thoroughly researched his concerns.       Foursight Capital repossessed my vehicle today 8/3/23 in the ***********. CT law states that a letter of intent to reposse be sent at least ******************************************************************************************************* certified mail. No letter of intent was sent. Company is saying that collection letters are the letter of intent, however they were not sent registered or certified. ** law further states that if no notice of intent is sent that the buyer has the right of redemption by paying the past due plus fees (non-accelerated) as well as the cost of repossession and storage. The company is telling me that I have to pay the balance in full (accelerated) or refinance with another company, in clear violation of ** state laws. I would like to remedy this situation by paying the non-accurated plus fees and repossession charges and redem my vehicle. The company originally stated that ** does not have a law that gives the debtor a post- repossession right to reinstate the vehicle. However that is in fact false because when I pressed 3 separate employees on this I was told in fact it is not a law preventing it but a company policy.

      On August 4, 2023, we received notice regarding a complaint filed against Foursight Capital (Foursight) through the Better Business Bureau. Foursight is committed to providing the best possible customer service, so we have investigated the complaint and made the following determination.

      On May 11, 2021, ************************* signed a contract to borrow funds from ***************** for the refinance of his 2019 Chrysler Pacifica.  ***************** assigned this contract to Pagaya on May 11, 2021, and Foursight Capital has been named as the loan servicer.  The terms agreed to on this contract were 72 monthly payments of $439.55 at an annual percentage rate (APR) of 10.00%.  

      Mr. ******** account went past due when his December 2022 payment was not made according to the terms of the contract.  Foursight mailed a certified letter on May 31st, 2023, notifying Mr. ****** that his account was in default, ****************** has confirmed that this letter was received.  In accordance with laws in ***********, Foursight provided the opportunity to cure the account default on or before June 12, 2023.  Foursight continued our attempts to assist ****************** in bringing his account current, however, the account remained delinquent.  Due to the serious account delinquency and failure of ****************** to keep arrangements and communicate with us, we exercised our rights to repossess the collateral and took possession of the vehicle on August 3rd, 2023.    

      ****************** contacted Foursight on August 3rd, 2023, and stated that he believed he had the right to retain his vehicle by paying the past due amount.  *********** does not have a law that gives the debtor a post-repossession right to reinstate the vehicle, however, state law does provide a debtor 15 days after repossession to satisfy the loan obligation in full to retain their vehicle.  Foursight is continuing to hold the vehicle sale and provide ****************** the opportunity to refinance and satisfy his obligation to Foursight.  After August 18th, 2023, the vehicle will be sold at auction to the highest bidder.  All auction proceeds will be applied to the outstanding balance of the account and ****************** will be responsible for the remaining balance, including all fees and collection costs, according to the terms of the contract.

      I am rejecting this response because:  I contacted Foursight Capital and made 2 payments totaling over $880 in May of 2023 and moved one payment to the back of the loan.  Shortly after this I contacted the company and arranged to pay weekly going forward. I made 2 of 4  of the agreed upon weekly payments in July of 2023. CT state law does provide for the debtor to reinstate the loan if there was not notice made of intent to repossess the vehicle, and notice needs to be made via registered or certified mail. Certified letter with intent to repossess was received 5/31.  However the company had 2 occasions to tell me that my attempts to cure the debt would not be satisfactory, both when making the double payment and the weekly payment arrangement were made. The time between notice of intent and the time of actual repossession was greater than 60 days. I believe that another letter of intent to repossess should have been sent prior to repossession, which was never sent. I received 4 letters after the original intent letter none of which stated any intent to repossess. It is my stance that this repossession and acceleration of the debt is in violation of state law and does in fact entitle this debtor the right of redemption.  The people I spoke with on the phone kept with this same your state does not have a law that would allow for the debtor redemption and resumption of the loan. When I pressed the account manager about weather this is a law or company policy the account manager conceded that it was in fact company policy and not state law preventing redemption of the vehicle. I was lied to multiple times during this process and I believe the company relies on the fact that they know by the time you secure representation and try and litigate the violations of state laws they will have already auctioned off your vehicle and had irreversible damage to your credit report.
