      I trust this message finds you well. My name is *** *****, and I am a homeowner within the Del Monte Townhouse community in Spanish Fork, Utah. I am reaching out to you regarding a recent dispute that has arisen concerning the operation of a daycare within my unit. During the purchase of my property, a provision was included in the real estate purchase agreement explicitly stating that I, as the buyer, am not bound by the conditions and restrictions of the Del Monte Homeowners Association (HOA). This provision was agreed upon to ensure my exemption from certain regulations imposed by the HOA. Despite this provision, I have received communication from the HOA President indicating that operating a daycare within my unit is prohibited according to the HOA regulations. This contradicts the terms outlined in the purchase agreement and raises concerns about the enforcement of our contractual agreements. As a homeowner, I am committed to upholding the terms of our agreement and respecting the rules and regulations governing the community. However, it is imperative to address this discrepancy and ensure that my rights as outlined in the purchase agreement are upheld. I kindly request your assistance in resolving this matter in a timely and equitable manner.       Thank you for reaching out to us regarding the recent dispute concerning the operation of a daycare within your property in the Del Monte Townhouse community. We appreciate your commitment to upholding the terms of our agreement and respecting the rules and regulations governing the community.
      As a homebuilder, Arive Homes provides community covenants and restrictions (CC&Rs) for their chosen neighborhoods to the homebuyer during the contract phase. It is the responsibility of the homebuyer to review these documents to ensure that they align with their needs and intentions for the property. Additionally, the exemption to the CC&Rs, which you mentioned in your communication, refers to a specific exemption per the contract, it pertains specifically to rentals, which we did secure and provide upon request.
      It's important to note that the ability to operate a daycare unit is not mentioned in the contract agreement between the homebuyer and the seller, and that the clause in the contract is specifically to the rental prohibitions and does not include the exemption from operating a business in any home unit.
      However, we understand your concerns and are willing to assist in any way we can. We recommend working directly with the community's HOA to address any questions or concerns regarding the operation of a daycare within your unit.       We purchased an Arive Home. We have had nothing but problem after problem with it. We've had 4 different Super Intendants and 3 different ***************. No one sticks around long enough to make things right or finish the work. We can't get Arive Homes to make anything right. Our "home warranty" expires in 7 days. I have a water coming in several windows. I have paint that is bubbling and filled with water. I have soggy dry wall. I have a door that is so warped it won't close. I have windows with frost inbetween the window panes. I have water damage around the doors and windows. I have a pipe in my walls that spewing water and a broken water shut off value. I have a basement filling with water. I have kids that can't take a shower for school or get a drink of water. I have a window ***** so damaged and warped they have literally ripped of the house. My upgraded stair railing is no longer even attached to the wall. My side walks are all either uneven, cracked in half, or broken. My front porch is completely cracked in 1/2. My front stairs are no longer attached to the home.Arive Homes is very excited that our warranty expires next week so they can tell us they no longer need to help us. Our newest superintendent said the owners will be on vacation for a while and can't be bothered.It would be logical to extend the warranty with this many issues all happening at once. Arive Homes has their money and could literally not care less.We over paid to get a dream home. What we got was a money pit and home that we can no longer occupy.

      The concrete driveway has a large crack through it, the surface has been brittle and has been cracking off since shortly after we moved in, and large chunks have cracked and displaced. The requests to repair were submitted well within the warranty period and theyre trying to draw it out and weasel their way out of it. The fact the poured on frozen ground, in a hurry, at the end of January/first of February has made the concrete shift, sink, and crack in large pieces. The cold weather did not let the concrete firm up properly, so the top is brittle and cracks off throughout the whole driveway.

      We purchased a new build with Arive Homes and closed 4/15/2022. We attempted many times to get a resolution and have become fed up with the lack of communication. It seems like they couldn't care any less. During the New Home Purchase (***) inspection we found 80+ items that needed to be addressed. We wish we could have pushed back the closing date to make sure these items were corrected but our already extended rate lock was expiring. Either way Arive's only concern was to obtain a certificate of occupancy. They stated that once C of O is obtained they will not delay closing for outstanding items. The contract states ************************************************************** our home now for over 6 months need some help getting our outstanding items and warranty items addressed before our warranty expires. The list of complaints we have seem endless. Arive has done a poor job communicating and rarely responds. When they do it either goes nowhere or moves at a snail's pace (6 months with little results). We are on our fourth superintendent which has created many problems in itself let alone their poor communication skills. Our designer and Sales agent both no longer work for the company so we have very little help in getting our needs communicated. We have asked who our new representatives are with no response to that as well. I don't understand why it is so difficult to just finish the job! This has frustrated us to the point of exhaustion. We don't know how to get in touch with someone in management that is involved in the decision making process to make things happen. We need some communication!There are so many more things but the text does not allow, these are 3 of the big ones:1. Front door needs to be installed and the issues addressed 2. Countertop and sink issues need to be addressed.3. Light fixture credit needs to be refunded We need an actual MEETING with someone in upper management to work out our problems and for our concerns to be HEARD.

      Apologies, one of our construction supervisors has been working with you for the past few weeks, correcting all items according to code and industry standards.  He is only able to correct items that are code or building standards.  His final step will be to do the drywall and paint touch ups.  Apologies, we will not be reimbursing or giving credit to change the size or your island from what you selected when the home was built.

      We have dealt with Arive for the past 18 months. In this review I just want to concentrate on my sink. We paid an upgrade for our countertops in the kitchen to have quartz installed. You would think with an upgrade, your sink would be at least of similar quality. Whenever I wipe over the sides of the sink it makes a popping sound in multiple locations. It also shows stains whenever I leave a pot and it scratches very easily. The person from the warranty department came out but didn't know what to do about it. Also, I read the requirements of the city of Salem for builders that trees and shrubs are supposed to be planted at the homes, besides the sod. The competitor builders in our neighborhood have fulfilled this requirement but Arive has not. All homes have sod only. When I inquired of the person from Arive in charge of landscaping my phone calls have been ignored.When I started planting in my designated areas I found buckets full of big concrete pieces, nails, staples, and 2x4s under the inch of topsoil and the inch of mulch, that were not cleaned up. I had to clean up everything and would like Arive to add mulch on designated areas where I have holes from pulling out the debris.

      Arive homes has been very difficult and dishonest to work with. Up front this company comes across as very transparent and upfront. Our experience has been completely opposite. Things dont get done when they say it will, zero communication, when they mess up they dont fix it, homes are built very poorly, deadlines are never met. Covid or no Covidthey a horrible company and need to be looked into.

      I see the home is not scheduled to be turned over to your or completed for a few weeks yet to come.  I've also found that our superintendent has had the chance to fix bowed walls that weren't perfect and correct mis orders from superintendents.  We look forward to finishing this home for you over the coming weeks.  I was able to pull your framing inspection completed by your local city and did not find any abnormalities or signs of anyone hiding any issues.  We look forward to completing your home.
