      My wife and I lived at ************* Apartments in Falls Church, Va., for 9 years. We moved there in May 2014, making a $1,000 security deposit. After we moved out this year, our security deposit was refunded but we did not receive accrued interest, pursuant to our written contracts. Paragraph 42 on Page 6 of our 2014 lease stated, "Within the 45-day period prescribed above, we will refund to you the balance of the security deposit (if any) including accrued interest to which you are entitled, less any amounts that we have properly applied to your obligations under the Lease pursuant to the terms of the lease. "We emailed the landlord, Capital Investment Advisors  (CIA), requesting the accrued interest. Controller *********************************** claimed the language in the lease we signed with the previous landlord, Berkshire, in 2014 was superseded by the lease with CIA in 2016.We told ********************** that ALL our leases, including those under CIA, contain similar language regarding accrued interest. The superseding lease did not negate that they kept our security deposit and the original terms under which it was provided to them. Even if language was changed, when CIA acquired the benefits of the existing tenant agreements from Berkshire, they also acquired the liabilities and responsibilities. Virginia law does not require landlords to pay interest on security deposits. Our leases are controlling unless the language is contrary to the law, and state law does not prohibit the payment of interest on deposits.********************** stated CIA does not invest tenant held security deposits in an interest bearing account. This is unacceptable. Its not our fault CIA failed to invest our deposit. The leases do not specify any interest rate. We claim CIA owes us $423, based on a 4% rate compounded over 9 years. We look forward to resolving this matter.

      I live in ********Apartments in Arlington, VA. There are multiple issues with the property management of the building. The biggest problem is the stealing of packages. I personally have lost six packages worth over $200 (some companies would not give me a refund so I am out the money). Packages are stolen from the lobby or mailroom on a daily basis. I have talked with the office about the situation and they are fully aware of the situation. However, nothing is done. STEALING MAIL IS A FEDERAL CRIME! The company has footage of the people stealing the packages and is doing nothing. A door and fob access for the mailroom seems like a reasonable solution. Next time a package is stolen I will be calling the police and demand that Capital Advisors be charged with aiding and betting in a crime because they are aware of the situation but are doing nothing about it. The second issue I would like to bring up is that my in-unit washer and dryer have been broken for almost a year (pretty much since moving in). At first, maintenance would come and try to fix it. They said it was fine but it was still not working correctly. After months of this, I was told they would replace it. I have now been waiting four months. The last I heard two months ago was that there were not enough maintenance people on staff to replace it and I would have to wait. I have waited long enough. I think four months of waiting is unreasonable.

      We are in receipt of your letter dated March 12, 2023,and wish to offer the following response. 

       

      Response to the first complaint regarding lost and stolen packages.  We offer a secure locker system in our mail rooms where package deliveries are made into a secure and locked locker.  Once the package is placed in the locker by the delivery company, they alert the resident their package was delivered and give them a code to access the lock.  They have up to one week to collect the package. After that, if it is not collected, a small fee is assessed to the resident's account.  Residents must sign up for this service with the community in order to have their packages delivered to the secure locker system.  If they do not sign up to participate in the parcel locker program, the delivery companies will leave the packages in the mail room.  The mail room is monitored with a 24-hour camera.  As the building owner, we cannot guarantee lost or stolen packages.  The packages are the responsibility of the various delivery companies (***************** ******, etc.) as well as our residents to ensure each package is delivered and received.   

      As for the second issue, the dryer not working.  We have a work order system where residents can put in work orders from their computers for any issues they are having in their apartments.  Our last work request was on November 1,2022 for a dryer not working.  A technician visited the apartment and determined the dryer was in normal working order at a temperature of 1340 degrees.  Upon receipt of your letter, dated March 16, 2023, the property manager asked a technician to visit the complainant's apartment.  The technician asked her to run a small load of laundry so he could check the dryer with clothes in it.  She informed him she had nothing to wash.  If the complainant has any further issues with her dryer, we will be happy to take a look at it.  She can either place a work order through the portal, or stop by the managers office, and someone will be happy to complete a work order for her.

      I am rejecting this response because 1) I am part of the locker system and packages are still not left in the lockers. While I agree that it is up to the delivery people to deliver the packages, the company has done nothing to ensure that packages are being delivered safely. They have cameras but they are not monitored and nothing has been done to the individuals stealing the packages. Furthermore, anyone and I do mean anyone can come into the building (because there is no security) to take the packages. This is supposed to be a secured building. 2) I have put in multiple complaints about my dryer to their system. Every other time they come to fix the dryer they say nothing is wrong with it and every other time they say they will replace it. However, apparently taking 4 cycles to dry clothes is normal in this building. I put in a small amount of clothes and the dryer never drys the clothes on the first couple of cycles.
