We are building a home with Integrity Homes. We selected cultured marble (solid white in color) for our bathroom vanity countertops. We were recently informed that the vendor no longer makes this cultured marble and Integrity would be substituting with a granite that was gray and black and changes the entire design of the bathroom. Integrity has repeatedly told us we had no choice or say in choosing a replacement and it is too bad we do not like the new color. Our contract states "3.D. Seller also has the right, in its sole and absolute discretion, to: -Substitute materials and equipment of equal quality and similar design". Integrity is saying color is not a design element so this section of the contract does not apply. They are unwilling to work with us to find a reasonable resolution and have stonewalled our efforts to communicate with them to resolve our issue. They initially reply to emails but then become nonresponsive to our numerous emails pointing out the fact they are not adhering to the stipulations in our contract. All we want are countertops that are white installed in our bathrooms, not black, gray and dark. Integrity is unwilling to work with us to resolve this and is breaching the contract with us in regard to substitutions. We are worried they will retaliate by delaying our closing date even more than they already have, which has been over 3 months at this point.Initial Complaint

Our home was purchased from Integrity Homes in February 2021. The ******* for Integrity at that time ********************* along with Integrity documentation stated that right before our one year **** provide them with issues that need to be resolved as part of the one year assessment. Information was provided to ********************************************************* along with multiple requests to reach out to the builder which has been confirmed for requests of status updates. Iniitial correspondence of items needing addressed were submitted Feb '22. To date Integrity has failed to reach out to schedule a walk through on items needing addressed. In the same notion, our neighbor submitted their initial list of items needing addressed a week or two after us and Integrity has already completed their walkthrough as of two weeks ago for them.
