      In accordance with the Fair Credit Reporting act. This account has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. 15 U.S.C 1681 section 602 A. States I have the right to privacy. I am not liable for this debt with Argent Federal Credit Union, I do not have a contract with them, they did not provide me with the original contract as i requested. 15 U.S.C 1681 Section 604 A Section 2: It also states a consumer reporting agency cannot furnish a account without my written instructions In accordance with the Fair Debt Collection Practices Act. Debt collectors are not allowed to communicate with me under the 15 USC 1692C

      Thank you for reaching out ******************.  We have researched your inquiry and have concluded that you are in fact liable for this debt.  You took out a  car loan with ****************** Credit Union in June 2020. The car was repossessed in January 2021 for non payment on the loan.  The car was sold at auction, but unfortunately  the proceeds did not cover the  balance of the loan.  While you did make some additional payments on the loan, weve not received one from you since April 2023. Partners has since merged into Argent Credit Union.  If you would like to discuss this further, please dont hesitate to call our ************** at ************.

      I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      I noticed amongst all credit bureaus in total, this account list numerous inaccuracies. Experian, Equifax, and TransUnion all show inconsistent information. In accordance with the Fair Credit Reporting act. This account has violated my federally protected consumer rights to privacy and confidentiality as well as accuracy and fairness under 15 USC 1681. 15 U.S.C 1681 section 602 A. States I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2: It also states a consumer reporting agency cannot furnish an account without my written instructions In accordance with the Fair Debt Collection Practices Act.

      I was in a total loss accident on APR 2023. GAP insurance was paid but Argent claims I still owe $1200 for 2 payments. I had utilized their "skip a payment" service 2 times when my military pay was incorrect. I was not informed at the time of using their service that those payments would not be rolled into the loan which is what they claim now. They also claim that GAP is not responsible for the $1200 because it is no longer part of the loan. The only information given at the time that I utilized their skip a payment service is that it would extend my loan 1 month, for both occurrences.

      Argent Credit Union believes that ********** is not due a refund of the $1200.00 that he is requesting. Here are the details of the incident and our involvement to date:


      As ********** points out he utilized our skip a payment loan feature twice. Once in July 2022, and again in March 2023. These payments totaling $1,167.50 would have become due at the end of the loan had the car not been totaled prior to the loan being paid off. The form that ********** was required to sign clearly states You acknowledge that deferring a payment might affect the amount of life, disability or *** claims.

      Our records also indicate that ********** had two overdue payments in 2022 which resulted in additional money due to Argent totaling $58.38.

      ********** reported the loss of his vehicle occurred in April 2023 and Argent Credit Union did not receive the *** Insurance settlement until Oct 31, 2023, at which time we applied the payment to the outstanding balance on the loan.

      ************ initial claim to his *** insurance provider was denied because he had not provided the documentation required by the company to process the claim within the time limit, they required. Argent intervened on ************ behalf and was able to get the claim reopened and approved for payment.

      Because the *** insurance payment was less than the balance due, the loan remains an open loan. On Thursday, Feb 8, ****, *********** contacted Argent and we attempted to make payment arrangements with her regarding the remaining balance but were unable to come to an agreement.

      Interest and late fees continue to accrue on this loan. Argent Credit Union is happy to reach out to ********** to work out payment arrangements and is willing to waive the late fees However, ********** is responsible for the outstanding loan balance resulting from the deficiency in the *** settlement.

      I am self-employed as a notary public since 2012 and I was using this finical institution in 2014 to deposit my "payroll check" into and conduct my finical business from. My account with this institution has been open prior to 2000; they financed my first car. In 2016 and 2017, I began to notice "suspicious" overdraft charges on my account. I called and was told that some of those were not correct and an adjustment would be made, and it was. In hindsight, the adjustments may not have been for the total correct amount. It happened a few times again in 2018, the issues was they were holding my "payroll check" that I deposited on the 15th and 30th of each month for maybe 4 to 5 days longer than before and process my credit payment as overdrafts. So, I stop using that intuition and switched to another bank in 2018 to conduct my financial business and haven't had to deal with that type of issue with this new bank . In 2021, I went to open up a business account for my real estate company and was told about a prior negative account and that it was a notation in some system that did allow me to open an account. It was from that bank I stop using due to the unnecessary overdraft fees. In 2021, I first called the bank to see if they could resolve it but was told it had to be handled at the branch. Went to the branch and an associate had to submit it to someone else to work on it. Next, I received an email and it stated that per review there were 8 "bank errors" and the and adjustment would be made.       We are responding to the complaint filed with the Better Business Bureau by Mr. ***** ********.  We have researched the dates and incidents mentioned in the complaint as some are new and were not part of our previous communications with Mr. ********.
      Mr. ******** opened the checking account on September 4, 2014.   Activity on the account began on April 13, 2015.    There is no indication in our records of any conversations in 2016 or 2017 about adjustments on the account.   There were fees reversed on August 2, 2017 and it appears this was done as a courtesy as the ACH transactions that posted that day resulted in fees, but a deposit was made around the same time as the posting.
      Based on a review of receipts, we can find no instances where check deposits were held in 2018.
      Mr. ******** continued to use the account here until May 2019.     This brings us to the issue that has been the subject of our communications since September 29, 2021 when he contacted the credit union requesting research on his account.
      As communicated to Mr. ******** on January 21, 2022 and on February 28, 2022, the negative balance on the account resulted from transactions that were made and that the credit union paid.  The fees were incurred, in part, from the $**** check deposit made on May 14, 2019, which was placed on hold.   The deposit was made in person at our Oxbridge branch and the check hold information was included on the receipt.   At the time of the deposit, the account had been in a negative balance situation since May 3, 2019.
      Notices and letters were mailed advising Mr. ******** of the negative balance and asking for payment.   Monthly account statements were available until the account was closed which showed the details on the account.   We have no record of any response from Mr. ******** on this matter.   The account was closed and turned over to our collection agency, which mailed multiple letters from June 26, 2019 until the last letter on May 12, 2020.
      In recognition of his long term membership with the credit union, we have reversed all fees associated with the $**** deposit as a professional courtesy.   The balance now owed to clear up the account with the credit union and the reporting agency is $*******    This is a result of three transactions to a life insurance company that were paid by the credit union in June 2019 and the associated fees. why here...

      Their has not been a resolution to the issue. What is the breakdown of time and fees associated with that $*** fee. The insurance payment was $** per month, so how is this amount broken down?
