J R Moore Trucking Co. LLC Response

JR Moore Trucking Co. Entered into a contract with ******** ***** ************** on March 13, 2024 to lease purchase a tractor and trailer. JR Moore Trucking (Contractor) was under the impression given by ******** ***** that the truck was inspected and safe to operate. Upon taking possession of the truck, contractor found there to not be any current inspection nor DOT required inspection sticker or documents on or inside of the truck. The contractor was then instructed to go to the Carriers shop of preference where they could not find proof of a previous inspection and would give us the inspection. Contractor was then informed to not wait on an inspection and after the carrier spoke with the shop was given a sticker to place on the truck. Contractor never received a copy of the inspection report to place in the permit book and was told we would have it emailed or faxed. To which we still have not received to date. Contractor then went forward with taking a ** to ** load, ** to ** load and picked up a load in ** for ** where the truck experienced its first breakdown. The truck was out of commission for 2.5 days due to this breakdown. From that point forward the contractor would suffer breakdowns and being out of commission/ unable to operate for 6.5 of the 8 weeks contracted to ******** *****. Despite the unreliable equipment and surmounting debt from repairs and loss of revenue, Contractor continued to try and conduct business. On April 29th while contractor was once again headed back to the shop to pickup the equipment from a shop for repairs yet again on the equipment, Robert called to terminate our lease, due to us not operating and booking enough loads for him to profit what he expected to profit. JR Moore Trucking continued to the shop and recovered the truck, cleaned out their personal belongings and prepared to take the truck back to ******** **. On May 1, 2024, contractor left for ******* and once again began receiving engine warning lights, transmission fault codes and service lights and the truck would not shift above 5th gear. Contractor documented all of this with recorded video and upon request of Robert took the truck back to the shop in *********** **. After consulting with counsel and learning of our rights to operate a safe vehicle and our right to refuse operation of the vehicle. JR Moore Trucking chose to refuse to return the equipment, as the contractor has expended all available funds to stay afloat despite all of the unfortunate circumstances arising from this contract and could not afford for the equipment to breakdown mid trip to ******* **. Per our counsels advisement, contractor has ceased communication with ******** *****. As far as ******** ****** claim of contractor using fraudulent practices, the address found on the drivers CDL was the current address for the contractor per Virginia DMV standards until April 24, 2024 when our address was changed from our old PO Box to our new PO Box, which has been updated with the Virginia DMV as of May 3,2024. The address on the contract is still the current and valid address used by the business JR Moore Trucking Co and is registered with the State Commission of Virginia. Therefore keeping us compliant. ******** ***** claims that the contractor’s intention was to break contract, but ******** ***** has no proof thereof beyond assumption. In fact the contractor still had his belongings in the truck and had full intention to continue the lease as agreed before the carrier abruptly ended the contract. The contractor was original in talks with a local company about using the equipment leased to contract loads for ******** *****, after learning of the unsuspected termination of the contractors lease, the local company then offered the contractor a company position so that the contractor could still remain employed and not lose anymore revenue due to the circumstances. JR Moore Trucking Co. Reserves the right to not operate unsafe equipment.
