On February 1st I I asked Patriot Texas to prepare my taxes and providea quote. I've sent them my w2 and other personal information. On February 3rd they replied back with the total of the refund. I was unsatisfied with the amount and chose to file my taxes elsewhere. Patriots Tax sent me an invoice and threatened to use my social security number for collections if I don't pay. Patriots tax states " I will be billed based on agreed price" nowhere on email or verbally have agreed to any price. They have provided me a tax return estimate. No refund document.s were signed to certify the agreement. They are trying to fraud and blackmail me.

Thank you for reaching out to us. Here is our feedback to this false claim.

February 2nd- Mr. Termayne called our office to do his 2021 Taxes

He asked for a quote and we verbally shared that based on the information he provided us about his tax return, it’ll be roughly $475

He agreed to proceed and we explained that he will be receiving an email with the needed document to proceed with the work.

Feb 2nd- Carlo, our CPA, sent him an email requesting the needed documents to prepare his taxes and noted in the request as you can see from the screen shot provided: “Please send me the following information at your earliest convenience to ensure timely filing of your tax return”

Mr. Termayne responded to Carlo’s email with the needed documents. Screen shot also attached. He also noted that he will provide a voided check for the refund direct deposit at the time he comes in to sign the return. Which makes it clear that he agreed to the service and he will stop by to pickup his return.

February 3rd- Carlo completed his tax return and asked him to schedule an appointment to sign it to complete the filing.
We didn’t receive any response from him.

February 15- we followed up again letting him know that the tax return has been completed per his request and is ready for pickup.

February 18- he emailed saying he doesn’t want to file with us anymore, and he decided to file with the mother of his kids, and apologized for not notifying us in advance. Email attached

Obviously, as a well established and highly reputable Tax and Accounting practice, we have spent time and effort completing this professional service therefore, he is liable to pay for this professional service. We notified the client that the bill will go to collection if he does not pay, we never mentioned anything about using his social security.

He claimed that he only needed a quote, no where in his screen shot he shared or what we share with you that claim is noted or even real. No tax business will take time in such busy season to prepare a tax return and request all documents to provide a price. This is not valid and not professionally accepted. He also claimed that we threatened to use his social security, again that is another false claim as you can see from all the communication shared with you.

We obviously aren’t blackmailing him as he also falsely claimed. He clearly requested a service from us, provided all needed documents requested, hidden these facts from you when submitting this claim, and also spreading false accusations about Patriots Tax to avoid payment.

As you can see from all the above, our communication with him was respectful, clear, and professional. We continued to offer to help till the end. We have delivered a professional service that was clearly requested in writing by Mr Davis and he in return chose to not pay, wasted our CPA’s time and efforts, and has submitted false claims against Patriots Tax to the BBB.

Please note that I hid some of the content that’s related to his tax refund and amounts he shared since it’s sensitive private information.

Please note that I was only able to attach 4 images. More backup and data to proof the above is available if needed.

We thank you for your time reviewing this information and please do not hesitate to contact me for any questions.

      Customer response

      02/24/2022

      Better Business Bureau:

I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      ******** ******* ** *** *** *** *** ********* **** **** ************

      Regards,

      ******** *****
During the initial conversation inquiry with Patriots Taxes, when I asked for a estimated quote of what my return taxes would look like, Patriots Taxes should have stated at that time when the representative said “Sure, send me your information. I will send you the link to provide your information”. The cost of providing you a quote of your returns rather you file with us or not, for the efforts of our CPAs the fee will be $****
If Patriots Taxes would have responded with the fee, I would have cancelled the request during the call. However, this did not occur.

Line 9: Patriots Tax states “He claimed that he only needed a quote,…..” They acknowledged that I did ask for a quote of my return. Which is a contradiction to the first comment made in line three.  My request was in the original verbal conversation not when we began exchanging emails. In the verbal and email conversation, I never agreed to Patriots Tax to complete my tax return. And Patriots Tax was taking upon themselves to, without my authorization, use my bank account information from my previous tax returns to file my taxes without my signature until I responded via email stating that I do not wish to file with their company. Which is a violation of the law itself.

If Patriots Tax send this bill to collection, they will be using my social security number in order for this bill to be on my credit. All claims reported to any credit bureau has personal identifiable information attached to properly file the claim. This is why I stated that they were trying to blackmail/threaten me to pay the fee. They never sent the  invoice before the threat to send this claim to collections.

I did get the estimated return amount from you for my federal and state taxes via email, i wasn't satisfied so i went to else where. It has been a lot of miscommunication hopefully we can settle this peacefully and respectfully.
