in Sep 2021, we contracted D&M to replace our roof, install 3 sets of storm doors, windows, screens for the doors, replace existing deck and extend deck around an above ground pool. Mike, the owner, told us he would pull permits, but never did. The roofers left trash, nails, shingles (have pics). They installed Anderson doors & windows (all but one bathroom window, that we all agreed would be done when they returned. They never returned). One set of storm doors leak badly whenever it rains (have video & pics). They said they would fix it, they never returned. After texting, calling, and emailing them, it took, at times, a week or longer to get a response, they would schedule, cancel & reschedule numerous times. In Apr 2022, we texted asking why they kept pushing the date back. Mike called screaming at us, “why are you questioning me, if you don’t trust me, I’ll give your money back". After we pleaded with him to return & finish the job, he said, "Fine, my guys will be there tomorrow”, & hung up. The next morning, a crew arrived at approx 10:30am. Mike & my husband agreed to extend the deck more than originally planned, without my knowledge, so my husband & I asked Mike to extend the deck at a location that was agreeable to all of us. Mike said, “Sure, no problem. This work will be at time & materials when we return”. We said, “Great, sounds good”. After 3 weeks, we texted again, asking when they would return. They gave us a date in May 2022. Mike said we needed to sign a waiver since they left our deck undone (see pics), as we have no railings on the ends of the deck. We never received any waiver. After a month passed, we texted, again, asking when they would return, that we were concerned for safety reasons because the gates were never installed at the top of the two stairs (for pool safety). I provided a written estimate and they signed the contract agreeing to the price, there is no reason for any additional explanation of charges.Permits were not necessary because we were just replacing items, no new construction.Storm door screens are on order and should be in by September. This is out of my control.Railings, posts and security gates were not part of the original contract.Customer response

We have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. Response from D&M Construction: I provided a written estimate and they signed the contract agreeing to the price, there is no reason for any additional explanation of charges. Permits were not necessary because we were just replacing items, no new construction. Storm door screens are on order and should be in by September. This is out of my control. Railings, posts and security gates were not part of the original contract. Response from homeowners (**** and **** *******):This contractor is not truthful. We did NOT sign the contracts. Mike Ilyuk, owner, told us we could reply with an email that we wanted to move forward with the work. He stated on numerous occasions that he would pull the necessary permits. We asked, in writing, if the permits had been pulled and when the inspections would be occurring. He would not respond to those questions. We confirmed with the **** ** ****** **** ******, VaDPOR, and NARI that the contractor should have pulled permits. Copies of all receipts were promised, in writing, by the contractor (both owners - Mike & ***** Ilyuk). We have already attached copies of all emails and texts between us and them to the BBB. As a licensed contractor, to leave a deck without railings, posts, & gates (around an above ground pool) is negligent, hazardous, & illegal. Of course, it was part of the contract. This contractor has screamed at us on numerous occasions, calling us names, and has behaved extremely inappropriate and unprofessional. NO contractor would install a new deck without finishing the work. He has lied repeatedly. ***** communicated with us via text (copies have been attached previously) that they know they need to finish the deck railings, posts, and gates. A week later, Mike screams and yells at us via the phone and states, "Sue me if you want, I will never return to your home, find another contractor.We stated that we no longer want the screens (3-sets), which we already paid them for, and to provide a refund WITH a copy of the receipts. He refused to do so. We have been contacted by several people that stated they, too, entered into contracts with this company, and did not receive the agreed upon work. They are filing complaints, as well.This contractor has been so unprofessional. His response to this complaint is completely unacceptable, unreasonable, and NOT a resolution. Attached is information that customer **** ******* and her husband were happy with the work done. They made payments and even added a tip. They said they will pull permits. We have offered to complete what was remaining in contract to remedy the situation but we have not gotten a reply.Customer response

I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. MESSAGE FROM BUSINESS: Attached is information that customer **** ******* and her husband were happy with the work done. They made payments and even added a tip. From **** and **** *******:If you look closely at our check payment (the business attached), the notes we wrote about the work & tips, clearly indicate that was for the Anderson doors, windows, and support beam in our kitchen, which they did NOT pull permits for either, as they said they would. The picture was showing the windows and doors - deck was not finished as we have attached in our pictures (see dates). Note that this check was written on March 30, 2022.MESSAGE FROM BUSINESS: They said they will pull permits From **** and **** *******:The email stating we would pull permits was on May 21, 2022. This was after we spoke to the **** ** ***** *** **** *** **** asking what we needed to do since the contractor did not pull permits they were required to do (see attached).MESSAGE FROM BUSINESS: We have offered to complete what was remaining in contract to remedy the situation but we have not gotten a reply. From **** and **** *******:See attached entire text thread, which this company conveniently omitted. We did not respond, initially, because we requested they cease & desist (already sent copies of all our emails and texts, between this business and us, to the BBB previously). These copies show that we asked numerous times about them pulling permits and when inspections would be scheduled, they did not reply). In the texts from Jun 7-23, 2022 (see attached, which we already provided to the BBB), shows our attempts to get this company to finish the work they left unfinished and in an unsafe/hazardous condition. You will see Mike Ilyuk's unprofessional, inappropriate, and unstable responses. After we received Mike Ilyuk's unprofessional response today, (also attached), we sent a definition of what Cease and Desist means .Due to Mike and ***** Ilyuk's continual dishonestly, we went ahead and replied today. Everything we stated in our 2nd cease and desist request (see attached) is 100% truthful, we have supporting documentation, and will present this in court.
