On 5-21-2022, I bought a Barefoot Spa at the SpaBlowout in ******, **. Delivery and set up was completed in a timely manner. All worked well for about eight months, then the heater went out on the Spa. (model 57LP, serial number ***************. I called and told them the problem and they said it was still under warranty, however I would have to pay a $150.00 service fee. I was not happy, but I payed the fee. They said that a service technician would would call to set up an appointment. The technician called and set up an appointment , however he never showed up. I called again he said said that he was really busy and when he was in my area, he would call. I waited several months and no call. I called the main office and talked to a lady named ****** she lookedu up my file and said she would try to take care of the issue. About 2 weeks later the part showed up at my house from Barefoot spas. I called ****** and told her that I have the part, she then called a technician from ********, ******. He called and came to fix it, however when he opened the box the part was broken. He called Spa Blowout and told him what the problem was and sent them pictures, then he requested a new part. He tried to fix it using the old part and the new part, that lasted for about 24 hours. I then call the company again and I spoke to ****** and she said that she would try to get the part out to me. I didn't hear from Spa Blowout for a few months, so I called them back and told them that I needed this fixed that I was getting tired of having a hot tub that didn't get hot. I spoke to ****** again and she mentioned that the part had been out of stock. A new part was eventually sent, so I called and told her it had arrived, only to find out that she did not work there any longer. I spoke with a new fellow and he said that I would have to pay the $150 service charge again. I have called numerous times and they will not call back. I refuse to pay the fee again as the problem was not ever fixed.Business Response

Barefoot Spas have done everything on our end to be complaint with our policies regarding our warranty toward the customer. We sent the part to the customer six months ago along with a field technician shortly thereafter. We have covered certain aspects of the spa equipment as was stated in the warranty. The customer reached out six months later requesting assistance for a different issue, requesting more parts, and we sent more parts out. However, we expressed to the customer early and often of the field technician fee for the issue she had with her spa. Barefoot Spas is ready, willing, and able to continue to assist this customer, however, this part is six months old and never installed on the spa and now it is broken, would not be due to manufacture defect.Customer Answer

For your reference, details of the offer I reviewed appear below.I am not satisfied with this decision as it does not reflect the correct order of events. Plus, it does not fix the issue. Yes, I have received two parts, however the first one was broken. Mr. ***** from ***************************************************, opened the box and found the part broken. He immediately took photos and sent them to Spa Blowout with an explanation of the problem. He asked them to order the SAME part. Several months passed with no word. I called and ****** said that the part was backordered. She mentioned she would check on it and get back with me. Few weeks later I received the SAME part. I called to see when the technician would be here to replace the part. I found that ****** no longer worked there. The new person said I would have to pay the $150 fee again. I feel this is unfair because this began 8 months after I bought the hot tub **** am still dealing with the SAME problem. If they need verification of this they need to call their technician in ********, KS and or ******, their former employee. This whole process has taken way to long to resolve. I would like to use the hot tub, however, the heater STILL DOES NOT WORK. The reply that they sent me was filled with misinformation. There has only been one problem that has not been resolved over the past two years! I would mortified if my company were to take this long to rectify a problem. All I ask is for Mr. ****** to return and replace the part that was sent to me.

Barefoot Spas is committed to assisting our customers with their spa issues; however, we have policy in place, along with a warranty, that guides us and the customer regarding the expectation of what is and what is not covered, and for time periods covered. The field technician fee or trip charge in the amount of $150.00 is part of the warranty, and the customer has been made aware of that cost. As it states in the third paragraph, under the sub-header Performance: "You will be assessed a trip charge prior to a representative being scheduled. In the event the representative determines the defect is not covered under the terms and conditions herein, payment will be the sole responsibility of the spa owner." This portion of the warranty makes the customer aware of any Trip Charges. We have sent out a field technician once and made the customer aware of subsequent trip charges if a technician is needed again. We have also sent the correct part to the customer, and the part was in good condition upon leaving our warehouse. The customer held on to the part for six months and that part is now out warranty. Anything could have happened to the part within that six-month time frame.Customer Answer

I called several times within the time frame provided NO ONE CALLED ME BACK. I paid the fee once and the issue wasn't resolved. Why should I have to pay again when the hot tub was not fixed? Also the part is in the box unopened with a delivery date of May 18, 2024, sitting in my house where it has been since delivery. If my math is correct. That is only 3 months. Just send ************** to fix the thing! I just want a usable hot tub! This is getting ridiculous. Do you stand by your products or not? My next step will be to notify the ************************** I am getting tired of you just blowing me off. I bought the tub, paid for it in a timely manner, enjoyed it for 8 months until the heater broke, called you, and have had nothing but excuses ever since.

Barefoot Spas does apologize for the inconvenience. Our warranty states that the trip charge assessed by the technician is the customers responsibility. Barefoot Spas warranty covers Parts and Labor. This customer was sent a heater under warranty and chose not to pay the technician trip charge. She left the part for three months, who knows what happened in that time frame. It being broken is not due to our manufacturing defect. Barefoot Spas has done everything covered under its warranty and provided the part. At this time the customer has waited long enough call back and state that the heater was broken, that she outside of the warranty time period. She refused to uphold her side of the warranty terms and pay for the trip charge. It does not state that it's one trip charge per issue. I was told there is a 5 year warranty on this hot tub which was purchased 6-28-2019 and now our pump has an electrical burning smell and will not run. I cannot reach them to get into contact and after reviewing the complaints that has been previously made against them, they are not standing good for. This is absurd that customers are lied to and cannot get ahold of them. This hot tub is not even quite 4 years old. I would like to request a total refund of what i paid for this tub if they cannot guarantee and fix the issues with ************ they are selling. The motor is what makes this a Hot Tub SPA! I have been trying to contact them for hours upon hours and am getting no where. No response or nothing. Barefoot Spas is ready, willing, and able to honor its warranty. At the time of purchase every customer is sent an email with a warranty registration to our website. On the website it breaks down what is covered under warranty. Barefoot Spas does not manufacture the pumps in our hot tubs. Therefore, they are covered by their own manufactures warranty which is one year. Barefoot Spas only warranties items manufactured by Barefoot Spas. That is the case for every manufacture. No one covers other manufactures items under their warranty. *************************** purchased a Custom Order Swim Spa from a Spa Blowout event on January 15th, 2023. ******* had his wife and children at the event, and were super excited at time of purchase. ******* signed the purchase agreement and paid for the Swim Spa in full. The intent to purchase was present. On the purchase agreement that ******* has attached to this case, is his signature, right about his signature is the statement "ALL SALES ARE FINAL, NO REFUNDS, NO RETURNS, NO EXCHANGES". In the paragraph below the statement, it says " No oral agreements or understandings shall be binding. The first contact for a requested refund was not done by *******, his son, ****, tried to cancel the order. ************* told **** its policies and that we can not talk with him about a purchased agreement under a different name. ******* then reached out and was told the same policies and that he signed a contract stating those policies. ************* will cancel *******' order if he wishes, however, per our policy any payment made in any form by any entity up to the time of cancellation are considered a restocking fee and are forfeited. ************* is ready, willing, and able to deliver ******* his product.

I am not satisfied with the business response. We will not accept delivery of the spa. The ********************************** is looking into this via a claim and our party its consulting with our attorneys now for further actions. This business uses high pressure sales tactics and tells blatant lies to the consumer to secure sales. We wouldn't have purchased the spa had *********************** not stated many times over that the product was returnable at any time for a full refund. We weren't sure if we could use the spa at our house due to lay down space and our HOA approval process so Spa Blowout/Barefoot Spas promised the purchase could be fully refunded upon the cancelation of the order. Our party has four witnesses to this verbal agreement made by Spa Blowout. Nor did any representative offer to walk through the final contract terms with us other than the verbal agreement mentioned above. From the looks of the BBB complaints (over 50 complaints over the last three years against Spa Blowout and another 46 complaints against Barefoot Spa over that same time span) and many dissatisfied customer reviews on ******* Yelp, ********************. It seems you have basically no customer service to back up the product you sale. This is clearly a predator company that preys on the few consumers that take the bait. I am appalled that there are companies like yours that are allowed to do business in your home state or the states that you travel to for the Spa Blowouts selling below inferior product with lies and manipulation to secure these deals. You are traveling gypsy spa dealers. You've simply taken advantage of us and we want our money back. We don't want the "custom" spa that has been sitting in your warehouse for the last several years. You'll be hearing directly from the court system.

We also saw ads for Spa Blowout in ************ and thought a Swim Spa might be a good. We have no intention of buying one, just want to see one in person We are not buying today, just looking. After checking out their swim spas, we liked one. ****** informed us that we could lock in the price for 12 months for $100. If we proceed it would go towards the purchase. If we change our mind they will refund the $100.We gave ****** the $100 cash and signed the agreement as we continued to walk around the spa and ask questions. When we arrived at home we thoroughly read thru this price lock agreement we signed and it is a purchase agreement. Not what we agreed to. No price lock guarantee. Looks like we purchased a swim spa. And we did NOT. At 5:56pm. I texted ****** and told him we want the agreement canceled. He responds that this is just how they record a price lock. I tell him we are not comfortable with this and to cancel the agreement and send me a cancellation confirmation. He agrees and says he will cancel it. No cancellation confirmation arrives. On Tuesday, January at 10:58am a female calls from ************ and congratulates me on my spa purchase. I informed her that I did not purchase a spa, I canceled the price lock I did request and I am waiting for my cancellation confirmation. She was very rude, said yeah, OK, whatever and hung up. I texted ****** again, reviewed the call and again asked for my cancellation confirmation. Later the same day I received a second call with a male asking when I would like my spa delivered. I again went over the situation & asked that he provide me with a cancellation confirmation. He hung up on me.Again, I texted ******, asking for a cancellation confirmation. ****** ignored all recent texts. What I want is a cancellation confirmation. We put $500 down on a hot tub to be delivered in August or September as soon as we were ready is what we were told, our project was behind and this was relayed to customer service however we would be ready end of sept beginning or October is what I told them. Purchases a Barefoot spa from Spa Blowout on 2/2/2022. Delivery was fine, no complaints. I have been using the spa now for 2 years and one of the pumps has stopped working correctly. No problem, it has a 5 year warranty. Called the customer service and was told that the pump is out sourced so it is not covered under the warranty provided by barefoot spas. The manufacturer of the pump only warrants it for one year. This is not addressed anywhere in the warranty paperwork nor is there anyway to know that the pump is outsourced. This information is not provided at the time of purchase. I now have a $7000 tub of cold water that they are telling me I need to pay to have fixed. The pump is what makes that tub of water a spa! The warranty is basically a useless piece of paper that covers only the shell, nothing inside that shell.Business Response

I purchased a barefoot spa model 77np from spa blowout on 05/27/2022 in ************** **. Itbwas delivered about a week later filled the tub and treated water the way there instruction say. About one month later the tub has a white scum all over the inside. Water had been treated and tested weekly. Started looking for the drain to drain and clean the tub there is no drain where user manual says it is suspose to be. Called customer servive severalntimes over week and half leaving messages and never recieved call back. After about 20 attempts to call them someone finally answer the call. Stated that there is no way of draining thatbinwould have to go purchase a sump pump and pump water out. Which doesn't get all the water removed, We scrubed and sanatized the tub refilled the water tested treated the water weekly according to there directions and 6 weeks later we have the same issue. Company wont answer calls or retun call when asked about the problem. I have owned and maintained a hot tub for 10 years and have never had the problems that inhave had with this company or there products.Business Response

We were finally able to get ahold of **************** this morning, and his complaint is about the lack of a drain valve on the spa. Unfortunately this is not a feature that we have on our spas, and **************** has been in formed of this previously. We have suggested that if he would like to winterize the spa, he can siphon the spa and just shop-vac in the jets, but we do not recommend winterizing the spas.
He continued to be upset, but we have no way of adding a drain to the spa, and we as a company do not provide them as they are often points of bacterial growth.

Purchased a 12 swimspa on 28 May 2022. Was told delivery would take 4-6 weeks. Still dont have a delivery date as of ***************************************************************************************** my area to make delivery economical. Was not advised that would be a condition of delivery at purchase, and while I was willing to tolerate some delay I am not comfortable with it being indefinite. Company has stopped returning calls in recent weeks. 7/30/2022 Purchased a 5 x 7 Barefoot Spa,Contract states it would Include a Deluxe ultra cover.Delivery date of Spa was 8/5/2022 No cover was with the Spa,Contracted customer service, spoke to ****** ***** day of delivery and told us we should have the cover by the end of the week, which would have been 8/12/2022. called again on 8/15/2022 spoke to ****** *****, told us the covers were on back order and that they should be arriving on 8/16/2022. We asked that when ours is put out for delivery that received either an email or phone call with a tracking number and she reassured me that she or one of her staff would call or email me that information, never received a tracking number or confirmation of our cover being shipped. I have left 2 messages since speaking to ****** ***** and did not receive a return call. I called and texted another manager named, *********************** yesterday 8/31/2022 through text said he would call ****** right now, he never replied after this, and i did send follow up text and told him that we are uphappy with their service ( not In those exact words) and said that our next step would be to contact the BBB we didn't hear back from *********************** or ****** *****. All we want is an apology and our Spa cover in a timely manner along with the tracking information.
